About this file
This document outlines the requirements for a state and local government contract opportunity related to the sale of firearms and related accessories. To participate, bidders must hold a valid Federal Firearms License (FFL) of specific types, a Certificate of Eligibility (COE), and a Dangerous Weapons Permit (DWP) in order to sell assault weapons, short barrel rifles/shotguns, and machine guns in the state of California. Out-of-state dealers must also hold a valid FFL and be authorized to sell firearms in their home state, but will need to ship the weapons through a California dealer with a DWP. The role and any associated fees of the DWP must be documented and included in the bid. Specific FFL license types are listed, along with the relevant California Penal Code sections.
Pricing terms, set-asides, incumbent information, funding details, and other salient commercial terms are not provided in this document. The focus is solely on the licensing and permitting requirements for qualified bidders to participate in this state and local government firearms and accessories procurement opportunity.

Requirements
California Dealers…
• Must hold and provide a copy of a valid Federal Firearms License (FFL) Type 1, 7, 9, or 10, a Certificate of Eligibility (COE) and a Dangerous Weapons Permit (DWP). The DWP is required to sell assault weapons, short barrel rifles/shotguns and machine guns, see PC 31005, and short barrel rifles, see PC 33300.
• FFLs without a DWP cannot offer for sale any assault weapons or short barrel rifles, see PC 30600 and PC 33210
• If a bidder has a DWP for the purposes of sales to law enforcement, they can drop ship or deliver to the agency.
Out of state dealers…
• Must hold and provide a copy of a valid Federal Firearms License (FFL) Type 1, 7, 9 or 10 for firearm sales and be authorized to do so in the state they do business in.
• These weapons are assault weapons and illegal in California to possess for most dealers in the state, therefore, they will need to be transferred through a dealer in California with a Dangerous Weapons Permit (DWP) for the importation and delivery to DOJ. They cannot be shipped directly to DOJ from out of state. They may, however, be shipped to DOJ directly from the manufacturer.
• Pursuant to PC 32610, the role of the DWP and any associated fees must be documented. This documentation must be included in your bid.
