About this file
This is a Request for Substitution or Exemption form issued by the City of Phoenix Public Transit Department for the Disadvantaged Business Enterprise - Neutral (DBE-N) Program. The form serves as the official mechanism for prime contractors to request approval for modifications to their Small Business (SB) utilization commitments on contracts under solicitation 02_26-IFR. Contractors must submit this form to the City of Phoenix Public Transit Department Compliance Section prior to implementing any changes to their proposed Statement of Small Business Utilization or the Contractor's Monthly Statement of Small Business Utilization Form. The form permits prime contractors to request exemptions for four specific actions: releasing a proposed SB subcontractor, substituting an SB subcontractor, changing the scope of work assigned to an SB subcontractor, or reducing the dollar amount originally proposed for an SB subcontractor.
The form requires prime contractors to demonstrate good faith efforts in identifying alternative Small Business participation when requesting exemptions. All submissions must include the prime contractor's contract number, project number and description, identification of affected SB subcontractors, and detailed documentation of the scope of work affected by the requested change. The Contract Compliance Specialist reviews each request and determines approval status, with the option to revise the Small Business commitment amount. No SB subcontractor may be substituted, terminated, have their scope reduced, or have their proposed amount changed without written approval from the Contract Compliance Section, ensuring accountability and adherence to Small Business utilization goals on City of Phoenix contracts.
