About this file
This is a Request for Special Procurement by Rule memorandum from the Oregon Department of Fish and Wildlife, dated July 9, 2025, requesting approval to purchase a used semi-truck trailer for the Ladd Marsh Wildlife Area. The procurement seeks to acquire one used semi-truck trailer capable of transporting specialized tracked equipment across paved roads within the wildlife area. The special procurement procedure is authorized under ORS 279B.085 and OAR 125-247-0288(10) for the purchase of used personal property, with an estimated total cost of $35,000 and a contract period from July 1, 2025, to June 30, 2026. The proposed contracting procedure involves a targeted search for used semi-truck trailers from qualified sellers, including used equipment dealers, with competitive quotes to be solicited if multiple suitable options become available. The purchase decision will be based on the condition, availability, and cost of the trailer at the time of procurement.
The memorandum justifies the special procurement on two grounds: first, that competition will be limited due to the specialized nature and limited supply of suitable trailers, thereby avoiding favoritism or substantial diminishment of competition; and second, that significant cost savings will be achieved by procuring a used trailer rather than a new one, with projected savings of $90,000 or more compared to the estimated cost of $125,000 or more for a new trailer meeting the agency's specifications. The procurement was funded through a waterfowl stamp grant awarded to the Ladd Marsh Wildlife Area. Approval of this special procurement request was signed by April Brenden-Locke, Contracts Manager, on August 18, 2025, activating the proposed contracting process.

RE: Request for Special Procurement by Rule—Purchase of Used Personal Property Per ORS 279B.085 and OAR 125-247-0288 Semi-Truck trailer
Wildlife Division requests a determination of use of Special Procurement by Rule under ORS 279B.085 for the Semi-Truck trailer project. This project requires a contracting procedure that differs from the procedures described in ORS 279B.055, 279B.060, 279B.065 and 279B.070 for the procurement of a used semi-Truck trailer. This request outlines the situation, the justification for the Special Procurement, and findings to satisfy the required standards. Approval of the request activates the proposed process to produce the needed Public Contract.
Special Procurement Under Rule as per OAR 125-247-0288 (10)
Type: Purchase of Used Personal Property
Time Period Requested: From: July 1, 2025 To: June 30, 2026
Total Estimated Cost: $_35,000_______ Limited to $250,000 as per OAR 125-247-0288 (10)
Request, Background, Current Need, and Proposed Contracting Procedure:
a. Request:
I am requesting to purchase a used semi-truck trailer.
b. Background:
Ladd Marsh Wildlife Area is 1 of 4 major wildlife areas in the NE region. The four areas work together and share unique equipment to help limit total program capitol outlay. Equipment that has tires or rubber tracks can cross paved roads where metal tracked equipment cannot. Currently when Ladd Marsh borrows these metal tracked items, they cannot be moved to alternate location on Ladd Marsh because of the major roads that traverse the wildlife area. Ladd Marsh requested funding for the purchase of a semi-truck trailer capable of hauling this type of equipment to expand our ability to manage the property and be more productive when
Special Procurement Semi trailer_DRAFT_V1_abl.docx Page 2 of 2 we have access to this type of equipment. Ladd Marsh was awarded a waterfowl stamp grant to purchase the trailer.
c. Current Need:
The Ladd Marsh Wildlife Area needs a semi-truck trailer to transport specialized tracked equipment across paved roads on the property. This capability is essential for efficient and effective wildlife management.
Without the trailer, moving critical equipment is significantly hindered, which negatively impacts operational efficiency and conservation efforts.
d. Proposed Contracting Procedure:
Competition may be limited; however, competitive quotes will be solicited if multiple suitable options become available. The purchase decision will be based on the condition, availability, and cost of the trailer at the time of the purchase. The contracting procedure will involve a targeted search for used semi-truck trailers from qualified sellers, including, but not limited to, used equipment dealers.
12. Findings to Satisfy the Required Standards: This proposed special procurement:
___X__ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
Finding a vendor that has a suitable trailer at or below the amount of the grant will be limited and will potentially require patience, as they are limited in supply. Procurement of the trailer will be solely based on availability and price.
and
__X___ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
The cost of a new trailer meeting my needs is $125,000 and up. By selecting a good quality used item, I can achieve my project goals with considerable cost savings of $90,000 or more.
or
______ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
