2.9 EVALUATION AND AWARD PROCESS
Basis for Award
The selection of the quoter with whom the FBI will establish a Single-Award Firm Fixed Price Contract will be based on best value to the Government. Award will be based on the determination of best value to the government based on the evaluation factors listed below.
Evaluation of Quote
Quotes shall be evaluated to ensure that all mandatory requirements set forth in the RFQ can be met.
Exception to the terms and conditions will be determined technically unacceptable.
The Government will evaluate the submitted quotes against the criteria set forth below and award a contract to the responsible offeror whose quote which is conforming to the solicitation will be the Best Value. Award will be made in accordance with the basic contract ordering procedures and the procedures specified in the request for quote.
The Government intends to make award based on the initial quote submissions without conducting interchanges. Therefore, each offer should contain the Offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to hold interchanges if, during the evaluation, it is determined to be in the best interest of the Government. Interchanges are fluid interaction(s) between the Contracting Officer (CO) and the contractors that may address any aspect of the quote and may or may not be documented in real time. However, the Government reserves the right to conduct interchanges using Interchange Notices (IN). Offeror responses to INs will be considered in making the order selection decision.
The quote shall address the Offeror’s experience, capabilities and the means proposed to satisfy the requirements stated in the RFQ and attached Statement of Work. The offeror shall provide information to facilitate the Government’s consideration of the evaluation factors defined below.
Volume I- Factor 1 Technical Capability:
Quotes will be evaluated by use of the color-coded and/or adjectival rating system below for the Technical Factors and/or sub-factors. This system will allow the Technical Evaluation Team to assign an overall rating based upon identification of strengths, weaknesses, deficiencies, and risks associated with each Factor and Sub-factor identified in each Quoter’s proposal. The intent of the rating system is to add objectivity to the evaluation process such that meaningful and consequential differences between the proposals are recognized, and insignificant differences are not considered.
The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. The following rating definitions will be used in the assessment of Technical Factors and/or sub-factors:
Color Rating Description
Blue Exceptional Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Exceeds performance or capability standards noticeably by demonstrating multiple significant strengths. No weaknesses or deficiencies noted. Risk of unsuccessful performance is very low.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements.
Weaknesses are minor or will have little or no impact on contract performance. No deficiencies exist. Risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal does not clearly meet requirements and does not demonstrate an adequate understanding of the requirements. Errors and omissions may exist. One or more weaknesses or significant weaknesses are noted. Risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements and contains one or more deficiencies. Risk of unsuccessful performance is guaranteed.
Evaluation Definitions
“Significant Strength” means an outstanding or exceptional aspect of the approach that greatly exceeds the acceptable level of quality and provides a beneficial capability.
“Strength” means a significant aspect of the approach that exceeds the acceptable level of quality and provides a beneficial capability.
“Weakness” is a flaw in the approach that increases the risk of unsuccessful performance.
“Significant Weakness” is a flaw in the approach that greatly increases the risk of unsuccessful performance.
“Deficiency” is a material failure of a proposal to meet the minimum acceptable level of performance or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful performance to an unacceptable level.
Volume II- Factor 2 Past Performance:
The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant, recent, and quality past performance information that pertain to the vehicles outlined in the solicitation requirements. Recency is considered to be within the last 7 years from the date of the solicitation.
Relevant is where the past performance is similar to the vehicle requirement, complexity, dollar value, and contract type. Quality is how well the offeror has performed on the past contracts. An overall rating shown below will be applied to each past performance.
Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown*.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort.
* In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance.
In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
In conducting this evaluation, the Government reserves the right to use past performance information provided by the offeror and data obtained from other sources available to the Government, to include, but not be limited to, the Contractor Performance Assessment Reporting System (CPARS) or other databases; interviews with Program Managers and Contracting Officers (COs).
Volume III- Factor 3 Price:
For the quote to be considered complete, the Offeror must provide all data that is necessary as identified in Attachment 2 – Pricing Spreadsheet.
