Written notification of the CAL FIRE’s intent to award will be made to all bidders, and posted on Cal eProcure, in the Event’s attachment. Protests regarding selection of the “successful vendor” will be submitted to the DGS Procurement Division Protest Coordinator and ultimately heard and resolved by the Victim Compensation and Government Claims Board whose decision will be final.

All protests of award must be made in writing, signed by an individual authorized to bind the bidder contractually and financially, and contain a statement of the reason(s) for protest; citing the law, rule, regulation or procedure on which the protest is based. The protestor must provide facts and evidence to support the claim. Protests must be emailed to the following addresses:

Only bids quoted on CAL FIRE’s Cost Quote Sheet will be considered. Bids submitted referencing attachments which include legal terms and conditions that conflict with the State’s General Provisions will be considered non-responsive and will be rejected.

The Cost Quote Sheet will be used solely for computing the cost as a fair and equitable formula to determine the low bidder and is not bidding on the contracting agency.

However, the actual costs quoted within the cost sheet will be binding for the term of the Agreement, once awarded.

This solicitation will be awarded on an “All or None” basis to the lowest responsive and responsible bidder meeting all administrative and technical requirements, terms, and conditions of this solicitation. In the event of a tie, a coin toss will be permissible tiebreaker. Such event will be conducted by the Procurement Official and observed by a state employee as a witness.
