Written notification of the CAL FIRE’s intent to award will be made to all bidders, and posted on Cal eProcure, in the Event’s attachment. If a bidder, having submitted a bid, can show that its bid, instead of the bid selected by the State, should be selected for contract award, the bidder will be allowed two (2) business days to submit a protest to the Intent to Award, according to the instructions contained in paragraph titled “Protests” of this RFQ.

CAL FIRE’s RIGHT TO REJECT A submitted bid may be rejected if it is conditional or incomplete, or if it contains any alterations of form or other irregularities of any kind. Incomplete or omitted documentation requested will be rejected. CAL FIRE may reject all proposals and may waive or reject any immaterial deviation in a proposal/quotation. CAL FIRE’s waiver of immaterial defect shall in no way modify the RFQ document or excuse the bidder from full compliance with all requirements if awarded the agreement. CAL FIRE reserves the right to reject all proposals for reasonable cause. Bid submissions received after the due date and time will be refused.

PROTESTS

Any bidder’s issues regarding solicitation requirements must be resolved (or attempts to resolve them must have been made) before a protest may be submitted according to the procedure below. These issues will be first resolved by the contact for the solicitation as indicated in the INQUIRES/QUESTIONS section, or if they result in a protest, the protest will be submitted to the DGS Procurement Division Protest Coordinator, Support Services Unit, to hear and resolve issues and whose decision will be final.

If a bidder believes CAL FIRE has incorrectly selected another bidder for award, based on the evaluation procedure in this solicitation, and believes that their bid was fully responsive to the requirements of this RFQ, the bidder may submit a protest as described below. Protests regarding selection of the “successful vendor” will be submitted to the DGS Procurement Division Protest Coordinator, and ultimately heard and resolved by the Victim Compensation and Government Claims Board whose decision will be final.

The Cost Quote Sheet will be used solely for computing the cost as a fair and equitable formula to determine the low bidder and is not bidding on the contracting agency.

This solicitation will be awarded on an “All or None” basis to the lowest responsive and responsible bidder meeting all administrative and technical requirements, terms, and conditions of this solicitation.
