Title: Procurement of lateral flow cassettes for the rapid HIV nucleic acid diagnostic test.

SECTION 1 –

BACKGROUND

The Centers for Disease Control and Prevention (CDC) estimates that one in seven individuals living with HIV in the United States (US) do not know that they have it, and three in five persons diagnosed find out more than a year after acquiring the virus. Knowledge of one’s status is critical for connecting HIV patients to care and starting treatment with antiretroviral medications which will prolong life and help to prevent further transmission. In many resource-limited settings, opportunities for healthcare providers and community-based organizations to provide diagnostic services are rare. Furthermore, connecting patients to care is even more difficult when diagnostic results are not available until days after an appointment. Current rapid diagnostic tests only screen for antigen and antibody which are most effective only after the early acute infection window after a newly infected person is most transmissible. Thus, an HIV nucleic acid test (NAT) that can provide sensitive and accurate diagnosis within the early acute transmission window (2 weeks to 2 months post exposure) would significantly improve the ability of healthcare providers to identify and link new patients to HIV care.

The Government has developed a rapid HIV-1 nucleic acid test (NAT) based on loop-mediated isothermal AMPlification (LAMP). This diagnostic assay is a simple, rapid, and low-cost alternative to traditional diagnostic nucleic acid assays that do not require complicated and expensive thermal cycling equipment and expert-trained staff. This assay can reliably and specifically amplify HIV nucleic acids within 30-40 minutes when using a lateral flow device for detection.

This contract is for the development and production of 2000 lateral flow devices for evaluation of the rapid nucleic acid test. The lateral flow device must be able to house a lateral flow strip for the detection of amplified HIV DNA.

Further, the lateral flow device must be designed such that the amplified HIV-specific deoxyribonucleic acid (DNA) will be seamlessly transferred from the amplification tube to the lateral flow device and then contained with the sealed apparatus. The contractor has the option of designing the lateral flow devices and reaction tubes de novo or use existing technology. The contractor must deliver high quality, robust lateral flow devices meeting the characteristics outlined in Section 3 for evaluating the rapid nucleic acid test in both pre-clinical and clinical settings.

SUBSECTION A – DEFINITIONS

EHE – Ending the HIV Epidemic in the US – HHS initiative to end the HIV epidemic in the US HIV NAT – Nucleic Acid Test – a highly sensitive detection method for HIV genomes allowing early diagnosis compared standard diagnostic tests.

LAMP – Loop-mediated isothermal amplification – a nucleic acid amplification assay that can be easily implemented in low resource settings

SECTION 2 – PURPOSE

Whether designing the devices de novo, using existing technology, soliciting sub-contractors, or a combination of all three, the Contractor is responsible for the design and validation of the lateral flow cassettes, lateral flow strips, and reaction tube. The Government will provide technical input in designing the device and required performance characteristics. The Contractor will need to send a batch of lateral flow devices prototype to the Government. The Government will evaluate the performance of a prototype with the goal of providing feedback within the contract period and may require the Contractor to perform additional device revision to fulfill the contract. The Contractor will consult with the Government during the contract period. Development will occur at the Contractor’s facility.

SECTION 3 – SCOPE OF WORK

The Contractor, a commercial medical device company with demonstrated success in designing and producing lateral flow kits, will produce 2000 lateral flow devices and supporting plastic consumables that meet the following specifications:

a. The reaction tube must be RNase and DNase free and suitable for the LAMP reactions.

b. The cap for the reaction tube should lock onto the tube to prevent re-opening of the tube once the reaction material has been added.

c. The reaction tube (and cap) must interface seamlessly with the lateral flow cassette and allow delivery of the reaction tube contents to the lateral flow strip. Piercing of the cap must allow flow of reaction tube contents onto the lateral flow strip without leakage and must be irreversibly attached.

d. All components must be designed to prevent environmental contamination by encapsulating amplified material during heating and subsequent readout when transferred to the lateral flow cassette.

e. The cassetted lateral flow strip results must be reproducible. 100 of each prototype design(s) must be sent to CDC for independent evaluation of reproducible performance.

f. The contractor must address performance aspects deemed necessary by CDC prior to a final production phase.

g. The final product must be cost-conservative to facilitate future manufacturing.

The Contractor may design plastic consumables internally or source appropriate materials from third party vendors.

The Government anticipates that the Contractor will need to design some aspects of consumables to facilitate seamless flow reaction mixtures to the lateral flow device readout.

The contractor must make all necessary adjustments to the devices to meet performance expectations within the contract period for delivery of the total number of units of final design devices.

SECTION 4 – TASKS TO BE PERFORMED

The Contractor shall perform the following tasks:

Task (1) Hold bi-weekly meetings alternating between technical discussions that will be accompanied by a technical presentation/report outlining progress to track deliverables and development schedule.

Task (2) Create, maintain, and deliver a Design History File including final design.

Task (3) Deliver 100 of each prototype cassette(s) with lateral flow strips, reaction tubes, and caps for test procedure evaluation by the Government. The Government will provide feedback.

Task (4) Send 2000 final lateral flow device kits for pre-clinical and clinical evaluation of the complete test procedure.

Task (5) Provide final design specifications and instructions for assembly of the final lateral flow device kits as well as specifications (including CAD files) and plans suitable for cost-effective mass production.

SECTION 5 – GOVERNMENT FURNISHED MATERIALS

In the event the Contractor undertakes the design of devices, the Government will offer proprietary prototypes to facilitate initial designing of lateral flow devices. Additionally, the Government will provide the lateral flow test strips.

(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.232-33 Payment by Electronic Funds Transfer-System for Award Management.

As prescribed in 32.1110(a)(1), insert the following clause:

Payment by Electronic Funds Transfer-System for Award Management (Oct 2018)

(a) Method of payment.(1) All payments by the Government under this contract shall be made by electronic funds transfer (EFT), except as provided in paragraph (a)(2) of this clause. As used in this clause, the term "EFT" refers to the funds transfer and may also include the payment information transfer.

(2) In the event the Government is unable to release one or more payments by EFT, the Contractor agrees to either-

(i) Accept payment by check or some other mutually agreeable method of payment; or

(ii) Request the Government to extend the payment due date until such time as the Government can make payment by EFT (but see paragraph (d) of this clause).

(b) Contractor's EFT information. The Government shall make payment to the Contractor using the EFT information contained in the System for Award Management (SAM). In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to SAM.

(c) Mechanisms for EFT payment. The Government may make payment by EFT through either the Automated Clearing House (ACH) network, subject to the rules of the National Automated Clearing House Association, or the Fedwire Transfer System. The rules governing Federal payments through the ACH are contained in 31 CFR part 210.

(d) Suspension of payment. If the Contractor’s EFT information in SAM is incorrect, then the Government need not make payment to the Contractor under this contract until correct EFT information is entered into SAM; and any invoice or contract financing request shall be deemed not to be a proper invoice for the purpose of prompt payment under this contract. The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.

(e) Liability for uncompleted or erroneous transfers.

(1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor’s EFT information incorrectly, the Government remains responsible for-

(i) Making a correct payment;

(ii) Paying any prompt payment penalty due; and

(iii) Recovering any erroneously directed funds.

(2) If an uncompleted or erroneous transfer occurs because the Contractor’s EFT information was incorrect, or was revised within 30 days of Government release of the EFT payment transaction instruction to the Federal Reserve System, and-

(i) If the funds are no longer under the control of the payment office, the Government is deemed to have made payment and the Contractor is responsible for recovery of any erroneously directed funds; or

(ii) If the funds remain under the control of the payment office, the Government shall not make payment, and the provisions of paragraph (d) of this clause shall apply.

(f) EFT and prompt payment. A payment shall be deemed to have been made in a timely manner in accordance with the prompt payment terms of this contract if, in the EFT payment transaction instruction released to the Federal Reserve System, the date specified for settlement of the payment is on or before the prompt payment due date, provided the specified payment date is a valid date under the rules of the Federal Reserve System.

(g) EFT and assignment of claims. If the Contractor assigns the proceeds of this contract as provided for in the assignment of claims terms of this contract, the Contractor shall require as a condition of any such assignment, that the assignee shall register separately in SAM and shall be paid by EFT in accordance with the terms of this clause.

Notwithstanding any other requirement of this contract, payment to an ultimate recipient other than the Contractor, or a financial institution properly recognized under an assignment of claims pursuant to subpart 32.8, is not permitted. In all respects, the requirements of this clause shall apply to the assignee as if it were the Contractor. EFT information that shows the ultimate recipient of the transfer to be other than the Contractor, in the absence of a proper assignment of claims acceptable to the Government, is incorrect EFT information within the meaning of paragraph (d) of this clause.

(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information made by the Contractor’s financial agent.

(i) Payment information. The payment or disbursing office shall forward to the Contractor available payment information that is suitable for transmission as of the date of release of the EFT instruction to the Federal Reserve System. The Government may request the Contractor to designate a desired format and method(s) for delivery of payment information from a list of formats and methods the payment office is capable of executing. However, the Government does not guarantee that any particular format or method of delivery is available at any particular payment office and retains the latitude to use the format and delivery method most convenient to the Government. If the Government makes payment by check in accordance with paragraph (a) of this clause, the Government shall mail the payment information to the remittance address contained in SAM.

(End of clause)
