About this file
This is an approved special procurement document from the State of Oregon's Department of Consumer and Business Services (DCBS) for laboratory equipment. Special Procurement #REQ-DASOBO-00215997 authorizes the acquisition of a TSQ Spectrometer through a non-competitive procurement process. The procurement was approved pursuant to Oregon Administrative Rules (OAR) 125-247-0287, which permits special procurements under specific circumstances. The document serves as official public notice of the approval, allowing affected persons the opportunity to file protests against the procurement within established timeframes.
The special procurement process enables DCBS to proceed with the equipment acquisition without conducting a competitive bidding process. This procurement method is typically utilized when circumstances warrant deviation from standard competitive procurement requirements, such as equipment with unique specifications, sole-source availability, or other justifications outlined in Oregon administrative rules. The TSQ Spectrometer represents specialized laboratory equipment necessary for DCBS operations, and the approved special procurement allows the state to acquire this equipment through an expedited process while maintaining transparency through public notice and protest provisions.

In addition, Thermo Fisher Scientific field service engineers are the sole certified and factory trained engineers available to service the instrument.
d. Proposed Contracting Procedure:
In conjunction with the Department of Administrative Services, State Procurement Services (DAS SPS) and approval of Delegation Agreement #REQ-DASOBO-00211796, Agency will issue a public notice (Notice) on OregonBuys®, as required by Oregon Administrative Rules (OAR) 125-247-0287, regarding approval of this Special Procurement request for a period of seven (7) calendar days.
The Notice will include provisions that any Affected Person(s) may protest the approval of the Special Procurement.
At the completion of the seven (7) day notice period, if no protests are received and sustained, Agency will proceed with issuing a Purchase Order (PO) to acquire the system, with a term of five (5)
REQ-DASOBO-00215997_Thermo_DCBS Page 5 of 7 years for the related Services, and $400,000 in compensation. Agency will amend the Purchase Order for additional years of Supplies, Services and Maintenance along with the associated compensation, as allowed under this SP approval.
Agency will obtain Enterprise Information Services (EIS) endorsement (if required), the Department of Justice (DOJ) legal sufficiency as required by Oregon Revised Statutes (ORS) 291.047 and OAR 137-045-0015, and contract verification as required by ORS 279A.161, prior to executing the Purchase Order or any related PO amendments.
11. Justification for use of Special Procurement: Describe the circumstances that justify the use of a Special Procurement. Attach relevant documentation.
Oregon’s Public Contracting Code (the “Code”), set out in ORS Chapters 279A, 279B, and 279C, is predicated on the principles of competition. However, it has been established that the Supplies and Services outlined in Section 9 (above) are only available from Thermo Electron North America, LLC as a subsidiary of Thermo Fisher Scientific Inc. Therefore, outside of ORS 279B.065 Small procurements, which limits the maximum compensation of a direct awarded purchase to $25,000, there are only two procurement methods defined in statute through which the request articulated in this SP can be solicited and approved:
o ORS 279B.075 Sole-source procurements o ORS 279B.085 Special procurements
A Special Procurement is the appropriate sourcing method that can be used for the required Supplies and Services, because Thermo Fisher Scientific is the sole provider of all component parts, spare parts, software, technical support, software upgrades and engineering resources to maintain the Ion Chromatography System. Thermo Fisher Scientific field service engineers are the sole certified and factory trained engineers available to service the instrument. The Special Procurement sourcing method allows for possible future SP amendments, if needed. Whereas the Sole-source sourcing method does not currently allow for future Sole Source amendments.
12. Findings to Satisfy the Required Standards: This proposed special procurement:
___X___ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
This purchase will not encourage favoritism, because Agency already has a substantial investment in laboratory equipment through Thermo Electron and any subsequent laboratory equipment that interfaces with this existing equipment must be compatible.
and
______ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
or
REQ-DASOBO-00215997_Thermo_DCBS Page 6 of 7
___X___ (b)(ii) will otherwise substantially promote the public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
ORS 279A.015 lists the State’s policy in enacting the Public Contracting Code. In maintaining the existing Thermo Electron Supplies and Services, the Agency is promoting the efficient use of state resources by maximizing the economic investment already invested into the Supplies and Services.
Agency requires a replacement mass spectrometer to conduct analysis of isocyanates for assessment of employee exposure to isocyanates relative to Agency permissible exposure limits (PELS), primarily in spray finishing of cars, trucks, and other equipment.
Approval of this SP will mitigate or avoid state business disruptions, provide cost savings opportunities, and will substantially support the interests of the State, OR-OSHA, and Oregon taxpayers.
13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request if it is submitted through OregonBuys®. Agency may elect to attach a signed Request.
