About this file
This document is a Request for Special Procurement Amendment No. 1 submitted by the Department of Administrative Services, State Procurement Services (DAS SPS) on behalf of the Oregon Employment Department (OED) to amend the existing Master Customer Agreement with The Conference Board Inc. (TCB). The special procurement amendment seeks to reinstate, extend, and increase funding for TCB's Help Wanted On-Line (HWOL) Statistical Time Series and Job Listing Subscription services. The HWOL subscription provides daily job listings scraped from thousands of websites and job listing analytics tools that support OED's Job Finder and Occupational Profile website tools, which assist job seekers in locating employment opportunities and provide labor market analysis. The agreement term is proposed to extend through December 8, 2028, with no renewal options mentioned. No bidders' meetings, site visits, or specific response dates are identified in this amendment request, as this is a continuation of an existing sole-source agreement originally established in 2009.
The total estimated cost for the three-year amendment period is $170,272, bringing the cumulative maximum not-to-exceed compensation for the agreement to $1,032,970. The pricing is structured as follows: Year One (December 9, 2025 to December 8, 2026) at $55,823; Year Two (December 9, 2026 to December 8, 2027) at $56,940; and Year Three (December 9, 2027 to December 8, 2028) at $57,509. TCB, a non-profit entity, is the incumbent contractor and has provided subscription services at an affordable rate since the original agreement's approval in December 2020. The special procurement justification centers on TCB's unique ability to provide continuous data streams required for longitudinal research and OED's operational continuity during its ongoing Workforce Modernization Integrated Labor Exchange and Workforce Management project. The amendment was approved by the State Chief Procurement Officer on January 22, 2026, retroactively effective to December 9, 2025, pending completion of the required seven-day public notice period and resolution of any protests.

9. Title: Supplies and/or Services to be acquired: The Conference Board’s Help Wanted On-Line (“HWOL”) Statistical Time Series and Job Listing Subscription (collectively “Services”)
10. Amendment Request, Background, Current Need, and Proposed Contracting Procedure:
a. Amendment Request:
DAS SPS, on behalf of OED, requests approval of this Special Procurement (“SP”) No. REQ-DASOBO- 00167424 (previously Original SP-1257-20), Amendment No. 1 (“SP AMD-1”) to amend Master Customer Agreement No. 10-196 (“Agreement”) (ORPIN #ED-1011-09) with The Conference Board Inc.
(“TCB” or “Contractor”) as follows:
1. reinstate the Agreement in accordance with Oregon Administrative Rule (“OAR”) 125-246-0570, making the Agreement in full force and effect as of December 9, 2025;
2. extend the Agreement term through December 8, 2028;
3. increase the Agreement NTE by $170,272 for a new Agreement NTE of $1,032,970 for the
Services listed in Section 9 above; and
4. replace the Oregon Employment Department with the Department of Administrative Services, State Procurement Services, as the party to the Agreement, which may also result in a change to the Agreement number.
b. Background:
The Mission of OED is to support economic stability for Oregonians and communities during times of unemployment through the payment of unemployment benefits and to serve businesses by recruiting and referring the best qualified applicants to jobs and providing resources to diverse job seekers in support of their employment needs.
OED entered into Master Customer Agreement #10-196 with The Conference Board Inc., through a Sole Source and was advertised on the Oregon Procurement Information Network (“ORPIN”) Notice
SP #REQ-DASOBO-00167424 (1257-20)_AMD-1_HWOL_OED Page 2 of 5
No. ED-1383-09 on September 16, 2009, for an annual subscription to provide daily job listings used in OED’s website.
The HWOL subscription provides listings for online advertised employment opportunities and related job demand data, providing a comprehensive list of online employment opportunities for job seekers and labor market analysis, which is a leading indicator of the overall health of the labor market and economy. The data provided by the HWOL subscription is routinely evaluated, in partnership with the State Labor Market Information Directors (“SLMID”) and others and is vital to the recommendations the SLMID make in directing much needed resources to Oregonians.
TCB provides two critical services to OED:
1. A daily download of job listings scraped from thousands of websites, and
2. Access to job listing analytics tools.
Daily Download of Job Listings The daily download of job listings is used to assist job seekers through OED’s Job Finder and Occupational Profile website tools. The Job Finder tool allows job seekers to search for job openings in specific occupational fields and geographic areas. The Occupational Profiles tool incorporates current job openings into its reports of occupational information, which also includes wages, education and licensing requirements, employment projections, etc. for specific occupational groups.
The job listings are updated daily using three (3) custom processes developed by the OED Information Technology (“IT”) staff in cooperation with the OED Workforce and Economic Research Division System staff that:
1. Accept the daily job listing file submission into the OED IT system,
2. Cleans the job listings by removing inappropriate job ads, and
3. Updates OED’s Job Finder and Occupational Profile website tools with the latest job listings.
TCB job openings are provided along with, but separate from, job openings that have been listed with the Oregon Employment Department directly. Although numbers fluctuate daily, the approximate volume of OED job listings is about 20,000, and TCB provides another 30,000 job openings daily.
Although it is possible that there is some overlap between these two sets of job openings, the sets seem largely independent. Over time, employment service staff have come to rely on this substantial supplemental pool of job openings when assisting customers with their job search.
History of the Agreement:
December, 2020: SP-1257-20, was approved to reinstate, amend, and extend the Agreement from December 9, 2020 through December 8, 2022, for a two (2) year cost of $105,340, with options to extend for up to an additional three (3) years with a NTE total of $268,090.
January, 2021: Amendment No. 8 to the Agreement was issued to add five (5) years and establish a new NTE of $862,698.
For additional historical and background information see SP Attachment-1 Original SP-1257-20

c. Current Need:
The term of the Agreement expired on December 8, 2025, and OED wishes to reinstate and extend the Agreement to continue the subscription with TCB for three (3) years through December 8, 2028.
OED is currently driving the Workforce Modernization Integrated Labor Exchange and Workforce Management project, which is still in process. Extending the Agreement with TCB will act as a bridge for OED until it can be determined if the Modernization project will include the same type of data that OED receives from HWOL. OED will make this determination within the next three (3) years. The cost table for three years of subscription(s) are listed in Table 10.c below:
Table 10.c
Renewal Dates Pricing:
Year One - December 9, 2025- December 8, 2026 $55,823 Year Two - December 9, 2026- December 8, 2027 $56,940 Year Three - December 9, 2027- December 8, 2028 $57,509 Total Cost for three (3) Years: $170,272
d. Proposed Contracting Procedure:
1. As required by OAR 125-247-0287, DAS SPS will issue public notice (“Notice”) of approval of this SP Amd-1 on the OregonBuys eProcurement system. This Notice will remain posted for a period of seven (7) calendar days.
2. The Notice will include provisions allowing any Affected Person(s) to submit a protest regarding the approval of the SP AMD-1.
3. DAS SPS, in collaboration with OED, will review and resolve all protests received, if any.
4. If no protests are received or sustained, DAS SPS will proceed with amending the Agreement as set out in Section 10.a above.
5. DAS SPS and OED will work with DAS Enterprise Information Services (“EIS”) to obtain its endorsement prior to executing the Agreement amendment, as required.
6. Pursuant to OAR 137-045-0015, DAS SPS will work with Oregon Department of Justice (“DOJ”) to obtain legal sufficiency approval prior to executing the Agreement amendment, as required.
11. Justification for use of Special Procurement: Describe the circumstances that justify the use of Special Procurement. Attach relevant documentation.
After the Original SP was approved, the Agreement became authorized within the provisions of the SP.
Consequently, any amendments to the Agreement outside of the approved Original SP—whether for additional time, services, or related costs—must first be requested and approved by DAS SPS through an amendment to the SP under Oregon’s Public Contracting Code (the “Code”), set out in Oregon Revised Statutes (“ORS”) Chapters 279A, 279B, and 279C. The Agreement cannot be reinstated and amended as outlined in Section 10.a above, without first obtaining approval of this SP_Amd-1 request.
DAS SPS, on behalf of OED, has determined that a Special Procurement Amendment is the most appropriate solution for continuing its Agreement with the Contractor for the following reasons:
1. The Conference Board is a non-profit entity.
2. The Conference Board has provided ongoing Subscription Services at an affordable rate.
SP #REQ-DASOBO-00167424 (1257-20)_AMD-1_HWOL_OED Page 4 of 5
3. Approval of this SP AMD-1 request will allow the OED sufficient time to work through the Workforce Modernization Integrated Labor Exchange and Workforce Management project, which is in process as described in Section 10.c above.
4. TCB’s subscription is critical to OED’s mission. A disruption in data would:
• Jeopardize the ability of OED to meet the needs of job seekers in the State of Oregon.
• Reduce Oregonians’ access to essential employment opportunities, economic data, and employment trends.
12. Findings to Satisfy the Required Standards: This proposed special procurement:
___X__ (a) will be unlikely to encourage favoritism in the awarding of public contracts or to substantially diminish competition for public contracts because:
Market research has determined alternative products do not meet OED’s needs at this time.
The same findings of fact provided in the Original SP (SP_Attachment-1) still apply.
and
______ (b)(i) will result in substantial cost savings to the contracting agency or to the public because:
or
__X_ (b)(ii) will otherwise substantially promote public interest in a manner that could not practicably be realized by complying with the requirements of ORS 279B.055, 279B.060, 279B.065, or 279B.070, or any rules adopted thereunder because:
Maintaining the subscription with TCB’s HWOL will promote the public’s interest by consistently pulling a constant stream of data information to support OED’s mission to Oregonians. To maintain the integrity of the information and subsequent analysis, the data stream must continue to match results from the past 16 years. This is a requirement for any type of longitudinal research work, where consistent variables are required for valid and repeatable results. Additionally, the information that OED Research division uses from HWOL is directly transferable to OED’s software format, without requiring the OED Research division to search, reformat or validate the data.
The same findings of fact provided in the Original SP (SP_Attachment-1) still apply.
13. Signature: The actual signature of the Agency Head or designee (e.g., Designated Procurement Officer) is not required on the Request submitted through OregonBuys®. Agency may elect to attach a signed Request as a pdf file through OregonBuys® or submit a signed hard copy Request.
Signature: e.g. Electronically in OregonBuys® _________________ Name/Title: Date:
