SUBJECT PROPERTY
PECO Tract 102-44 The property consists of two residential lots in Santa Fe County, New Mexico. The property is as combined generally rectangular with 311 feet of frontage on State Road 50 along the north, with depths of approximately 328 feet to 380 feet and the south boundary of 189 feet that is in and along Glorieta Creek and is about 2.18 acres. The property is not currently owner-occupied but has been improved with a Lodge building with an addition that contains three former rental apartments at the back. There is also a former coffee house on property. The septic tank and leach field are onsite. The zoning of the subject lot is Residential limited by ¾ acre lots and approximately one-third of the property is within the 100-year flood plain. The Lodge is approximately 8,070 sq. ft.
and was originally built in the 1930’s. There is a separate building (former garage) located between the lodge and Glorieta Creek and a small wooden storage shed along the western boundary.
Legal Description
TRACT 102-44
Situated in the State of New Mexico, County of Santa Fe, in a portion of the south half (S1/2) of the southwest quarter (SW1/4) of section 35 of Township 16 North, Range 11 East of the New Mexico Principal Meridian, being more particularly described as follows:
BEGINNING at the southeast corner of Tract 3A-2B, as shown on Family Transfer Land Division Plat by Morris A. Apodaca, New Mexico P.L.S. 5300, filed in the Santa Fe County Clerk’s Office on October 19, 2007, and recorded in Plat Book 667, Page 011, FROM WHICH the south quarter corner (S1/4) of section 35 bears S. 57° 28' 58" E., a distance of 1534.71 feet;
THENCE, N. 60° 59' 50" W., along the south boundary of said Tract 3A-2B, a distance of
122.95 feet, to a 1/2-inch rebar with cap marked “PLS 5300”;
THENCE, continuing said bearing of N. 60° 59' 50" W., along the south boundary of Tract 3A- 2A, a distance of 66.18 feet to a survey monument;
THENCE, N. 00° 15' 05" W., along the west boundary of said Tract 3A-2A, a distance of 379.53 feet to a survey monument;
THENCE, S. 61° 07' 00" E., along the southerly right-of-way line of New Mexico State Highway 50, a distance of 233.15 feet, also being the northern line of said Tract 3A-2A to a survey monument and point of curve;
THENCE, along the arc of a curve to the right, having a radius of 2878.70 feet, a delta angle of 00° 12' 13", an arc length of 10.23 feet and a chord which bears S. 61° 02' 38" E., 10.23 feet, to a 1/2-inch rebar with cap marked “PLS 5300” and a point of compound curvature, also being the northern point of the boundary line between Tracts 3A-2A and 3A-2B;
THENCE, along the arc of a curve to the right, having a radius of 2878.70 feet, a delta angle of 2° 48' 02", an arc length of 140.71 feet and a chord which bears S. 59° 32' 31" E., 140.70 feet;
THENCE, S. 30° 38' 56" W., along the east boundary of said Tract 3A-2B, a distance of 328.18 feet to the POINT OF BEGINNING containing 2.18 acres.
BACKGROUND
Since 1971, the acquisition of land for a variety of government programs and projects has been subject to the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (the Uniform Act). The Uniform Act provides for fair and equitable treatment of persons whose property will be acquired or who will be displaced because of programs or projects financed with Federal funds. Congress amended and updated the Uniform Act in 1987.
All Federal, State and local public agencies (and others receiving Federal financial assistance for public programs and projects requiring acquisition of real property) must comply with the policies and provisions set forth in the Uniform Act and its amendments.
The controlling Federal authority for Uniform Relocation Assistance and Real Property Acquisition for Federal and Federally assisted programs is Section 213, Uniform Relocation
Assistance and Real Property Acquisition Policies Act of 1970, Public Law 91-646, 84. Stat.
1894 (42 U.S.C. 4601) as amended by the Surface Transportation and Uniform Relocation Assistance Act of 1987, Title IV of Public Law 100-17, 101 Stat. 246-256 (42 U.S.C. 4601 note).
To support current National Park Service (NPS) and Department of the Interior (DOI) goals to comply with the Uniform Act, relocation and moving costs should be calculated prior to or during land purchases and transactions. To facilitate this process we seek assistance with relocation and moving cost estimates and services. The relocation assessment and services will include an analysis of the residential property and moving costs for the landowner of the property. The goal of the relocation/site assessment is to identify the estimates and costs for replacement housing and/or moving costs and to help conduct and complete the relocation segments of the land transaction. Relocation services and estimates should be conducted by a learned professional who is familiar with the Relocation Act and all processes and procedures for relocation.
All relocation services will be performed according to regulations and laws as stated in the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended (the Act), and as adopted by New Mexico State law, unless otherwise directed by the client.
CONTRACT RELOCATION SERVICES
Provide for the comprehensive management of relocation assistance for one (1) residential household move, requiring compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended.
1. BASE EFFORT: Meet with the displaced party at their residence to explain the relocation process and benefits, ascertain their desires, intentions and needs. Maintain ongoing dialogue and contact with NPS representative Realty Specialist, Heather Horton and the displacee throughout the process.
2. BASE EFFORT: Provide regular progress updates by phone or email, bi-monthly and as needed. Advise NPS immediately of any unique issues that are encountered along the way during the relocation process.
3. OPTION EFFORT: Provide all phases of Relocation Assistance Advisory Services and
Financial Assistance pertaining to Replacement Housing Payment to include Price Differential Payment, Mortgage Interest Differential Payment, and Incidental Expenses.
In addition provide information for moving costs of personal property using the Fixed Residential Move Cost Schedule, or a commercial moving company based on estimates received or a hybrid move combination of the self move and the commercial company move.
4. OPTION EFFORT: Assist displacee in preparation of any and all relocation claim forms required for reimbursement payments from the National Park Service relocation account.
5. Project Administration.
6. Final File Disposition. Submit copies of all relocation documents created and completed to Lands Resource Program Center.
7. Must be registered in www.sam.gov in order for us to award a contract for these services.
OPTION WORK
There are two options for work under this contract; the base effort and the option effort. All options for additional work must follow the requirements of this SOW as specified for the base effort. At the option of the Government, the scope of work performed under this contract may be increased by the Contracting Officer to include one or all of the following:
1. Base Effort (items 1-2 from above)
2. Option Effort (items 3-4 from above)
3. Items 5-7 from above apply to both the Base Effort and the Option Effort
SCHEDULE
It is expected that the base effort will be in effect until or completed within 30 days of the Offer to Sell being sent to the landowner. It is further expected that the option effort will be completed within 90-180 days or a set time decided by the relocation firm and the NPS Realty Specialist following the closing and recordation of deed of the acquired real estate described in “Project Name”. This timeline can be delayed or extended with mutual agreement of all involved parties and will be documented through contracting procedures.
