Due to the circumstances described below in Sections V, IX, and XI, there are no immediate actions that could be taken to develop competition. Therefore, it is considered appropriate to seek approval for more than one fiscal year. If other qualified or approved sources become known during the life of this contract, full and open competition will be considered and utilized to the maximum extent practicable.

IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION

10 U.S.C. 2304 (c) (1), as implemented by FAR 6.302-1(a) (2)(iii).

V. DEMONSTRATION THAT THE CONTRACTOR’S UNIQUE QUALIFICATIONS

OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE

AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY)

Moog, Inc, Cage: 0UES3 is the only known source that has demonstrated the capable repair procedures, parts, expertise, tools and test equipment necessary to sufficiently meet the Government’s needs. USAF does possess qualification requirements for the cold spray repair of the KC-135R Electrical Housing. Moog Inc, has successfully demonstrated the capability to meet the high quality bond strength required to perform the non-structural types of cold spray repair nessesary to return the Electrical Housing back to serviceable A condition. Moog Inc, have demonstrated that they have test equipment, acceptance test procedures, theory of operation/architecture, assembly/ disassembly procedures, material provisioning and selection criteria, fault diagnostics, shop practices, replacement parts and trained personnel, and technical data to satisfy the Air Force’s repair requirement. This service provides repair of KC-135R Electrical Housings which is part of the KC-135R Integrated Drive Generator which provides primary AC power on the KC-135R weapon system.

The 422 SCMS believes that award to any other source other than Moog, Inc., at thise time, would result in unacceptable delays in fulfilling the Air Force’s requirements. The Air Force has not received any additional written responses interested in the cold spray repair. Should a source approval request (SAR) for cold spray repair be submitted by a vendor, a period of at least 2-3 years may be required to demonstrate, process and validate an alternate supplier’s approach. As the Government is not aware of any vendor SARs at present to initiate this process, the proposed sole-source approach is the Air Force’s remaining alternative to execute the requriements between now and the need date for the repair items. It is estimated if the contract is not awarded by 01 December 2020 Mission Impaired Capability Awaiting Parts (MICAP) are imminent. In the event of war and “SURGE” is activated an increment of 25% is included in the dollar estimate to address any impact on funds which may arise due to any possible surge requirements associated with this acquisition.

Accordingly, Moog, Inc is the only firm capable of providing the service described in section III above without the U.S. Air Force experiencing unacceptable delays in fulfilling its requirements.

VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED

PRACTICABLE

This requirement will be synopsized in http://www.beta.sam.gov as a notice of proposed contract action IAW FAR 5.201. 08 September 2019 was the posting date.

A Sources Sought Synopsis (SSS) reference number FA8117-19-SS-0042 was posted on 8 September 2019 in support of market research to identify potential repair sources. The SSS closed on 07 October 2019, with one business, Moog, Inc, responding.

VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE

The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. The contractor may be required to provide other than certified cost or pricing data. A detailed cost analysis and price analysis will be accomplished. The Defense Contracting Management Agency (DCMA) and/or Defense Contract Audit Agency (DCAA) may be contacted to assist with the analysis, and may assist with inputs throughout the life of the contract.

VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE

RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS

NOT CONDUCTED

As described in Section VI above and IAW FAR Part 10, market research was conducted by Sources Sought Synopsis posted 08 September 2019. Additionally, a multi-functional team consisting of the Engineer, Contracting Officer, and Production Management Specialist conducted further research by reviewing Parts Manufacturer Approval (PMA), Haystack, web searches, and completed on the 07 October 2019. Market research did reveal some potential sources, however, SAR packages have not been received by 422 SCMS engineering. As a result, Moog, Inc. Cage 0UES3 is currently the only approved source to meet this repair requirement and is identified in the Contract Repair Screening Analysis Worksheet (CRSAW).

IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION

This part requires engineering source approval by the design control activity in order to maintain the quality of the part. Existing unique design capability,engineering skills, and repair knowledge by the qualified source(s) require repair of the part from the approved source(s).

The government realizes that it has unlimited rights to form, fit, and function data, including source qualification data, as well as data related to operation, maintenance, installation, and training. However, such rights are insufficient to satisfy the current need.

Access to production level drawings, “A”condition test assets , and validated repair data is necessary to accomplish the tasks for this acquisition. Efforts by the government to acquire a license and test assets from the OEM have been unsuccessful. Only proprietary data have been provided at PM request (6/14/2019) for the assembly and outline of the integrated drive generator, which is insufficient to validate product test and repairs.”

An alternate source must qualify in accordance with the design control activity's procedures, as approved by the cognizant Government engineering activity. The qualification procedures must be approved by the Government engineering activity having jurisdiction over the part in the intended application. Accordingly, Moog, Inc is the only source to have responded and demonstrated that they have met the qualification requirements set forth by the USAF to repair the KC-135R Electrical Housing.

XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED

The 422 SCMS will continue to monitor the marketplace for potential repair sources, commercial and non-commercial. Qualification requirements exist for this repair are noted in the sources sought synopsis. The Governemnt will continue to synopsize requirements for potential repair sources and periodically screen the item for future repair activities.

As a result of continued refusal by the Sole Source contractor to provide or license data as well as the unacceptable delay of developing additional sources per Sections V and IX, there are no known additional actions which can be taken to remove barriers to competition and therefore, specific actions and milestones cannot be established.”

(Note: There are some items/services we know will never be competitive i.e. items coded 3V.)

Per PGI 206.304(a)(S-70)- As indicated by signature on the Coordination and Approval Document, the previous Single Source Justification has been reviewed and the Approval Authority determines that all stated actions to remove barriers to competition have been accomplished.

XII. CONTRACTING OFFICER’S CERTIFICATION

The contracting officer’s signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief.

XIII. TECHNICAL/REQUIREMENTS PERSONNEL’S CERTIFICATION

By their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified as accurate and complete all supporting data, which is their responsibility, contained herein IAW FAR 6.303-2(c).
