Memorandum for Record – Limiting Competition at or below the Simplified
Acquisition Threshold
1. Contracting Activity: U.S. Army Contracting Agency, Aberdeen Proving Ground, Huachuca Division, Directorate of Contracting, 600 Augur Street, Building 22208, Fort Huachuca, AZ 85613-7070.
2. Description of Action: The United States Army Garrison (USAG) Directorate of Plans, Training, Mobilization and Security (DPTMS) is requesting a Brand Name new requirement to procure X-Pander IED/EOD Training Flashbang Simulator purchase order. This purchase order will be awarded a firm fixed priced purchase order, utilizing Operations & Maintenance, Army (OMA) Fiscal Year (FY) 2023 funds.
3. Description of Services or Supplies: Requested supplies and quantities are as follows:
• IED/Explosive Ordnance Disposal (EOD) Training Flashbang Simulator with Pneumatic Battlefield Effects (NSN: 6910016896936) o QTY: 1
• Large Pneumatic Battlefield Effects Simulator with Key Fob Remote Control o QTY: 2
• Drop Fired Mortar Kit that includes:
o 1 Mortar Tube Simulator o 8 Mortar Round Simulator Inserts o 50 CO2 Cartridges o 50 Burst Disks o 50 oz. Visual FX Powder o 1 Hard Carrying Case

• Distraction Device Flashbang Grenade Simulator Kit that includes:
o 10 Distraction Devices o 50 CO2 Cartridges o 50 Burst Disks o 50 oz. Visual FX Powder o 1 Hard Carrying Case

4. Authority: FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited: These Simulators will be used for Urban Operations Training/Field Training and to enhance the Counter Improvised Explosive Device (CIED) training strategies, which focus on current Improvised Explosive Device (IED) threats used by enemy forces in Afghanistan and other terrorist organizations (both foreign and domestic) .The devices used in conjunction with CIED devices currently in the TSC inventory will effectively allow commanders to train their soldiers in individual and unit level skills throughout the CIED skill level spectrum. These devices can also be used by the Fort Huachuca SRT for Installation Force Protection and Critical Incident Resolution (active shooter, barricaded suspects, etc.) and other Federal Agencies in support of the Homeland Security Mission.
It is a requirement for acquired simulators to interface with current simulator suite within the Training Support Center(TSC) inventory. Not utilizing this brand would require replacement of all other simulators with this brand name currently within the TSC inventory.
Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Additional costs would include both financial and negative impacts to mission. Impacts if these simulators are not purchased through the requested manufacturer could be the loss of individual and unit level CIED skills, resulting in deploying soldiers and units that are not trained to standard in effective techniques to combat the most prolific casualty-producing threat used against U.S. Forces in Operating Environments. It also has the potential to decrease the mission effectiveness of the SRT and Homeland Security Agencies training at Fort Huachuca.
6. Publicizing Contract Actions: For FAR Part 13 actions, Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.
7. Market Research: Research for alternative vendors or products was conducted by USAG/DPTMS March 2023 via written quote requests and world wide web inquiries.
Based on the results of the market research, alternative and cost-effective sources are not viable at this time. The research was conducted over a period of six months. Salient characteristics were used in the search process; however, no other simulator manufacturers met the training needs. The proposed Contractor can provide all of the requested Simulators at a lower cost than other identified vendors of this brand name equipment.

9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
10. Contracting Officer Certification/Approval: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based upon price analysis. I certify that this justification is accurate and complete to the best of my knowledge and belief, and that completing this purchase as a sole source is in the best interest of the Government. Additionally, I approve this justification to limit competition subject to the availability of funds and provided that the services or supplies herein described have otherwise been authorized for acquisition.
