About this file
Summary
This is a Memorandum for the Record documenting a sole source justification for a simplified acquisition threshold procurement. The document authorizes the use of other than full and open competition for the acquisition of Ladish Valves, specifically model 7275 valves, required for overhaul of sea valves on T-AKE Class vessels with a delivery date of January 12, 2027. The contracting officer determined that only one responsible source is available based on multiple factors: Ladish owns proprietary rights to the valve drawings; the valves are available only from Ladish and their authorized distributors under exclusive licensing agreements; standardization requirements per COMSCINST 4790.3 necessitate the specified make and model to maintain fleet configuration baseline; and the product serves as a direct replacement part that must be compatible with existing equipment on the vessels.
The justification cites three primary grounds for the sole source determination within Section 3.a (Only One Responsible Source): restrictive rights held by Ladish regarding proprietary drawings; exclusive licensing agreements limiting availability to the OEM and authorized distributors; and compatibility requirements for replacement parts on T-AKE Class vessels. The document includes certification fields for technical and requirement verification and references applicable regulations including FAR 12.102(a) and GSAR 538.7104-3 and -4. The procurement does not exceed the simplified acquisition threshold, and the required product is not designated as critical ship equipment per COMSCINST 4490.1 series and SMS Procedure 10.6-002-ALL.
