About this file

This document is a Limited Source Justification for the Naval Sea Systems Command Naval Surface Warfare Center Panama City Division to award a firm fixed price contract for Seal Delivery Vehicle (SDV) Reset/Override Switch Cable Assemblies.

The requirement is to purchase SDV Reset/Override Switch Cable Assemblies, including a specified quantity of assemblies per drawing, cable components, and shipping. The government has determined that Brantner & Associates Inc. dba TE Connectivity MOG and Teledyne Instruments Inc. dba DGO Teledyne D.G. O'Brien Division are the only approved sources that can meet this requirement, as their products are the only ones compatible with the existing SDV MK8 system. No other sources will be considered, as testing to ensure compatibility would be prohibitively costly and time-consuming. The Contracting Officer has determined this order represents the best value to the government. The requirement will not be synopsized, and will be awarded via limited competition to one of the two approved sources.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements.

This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c) (1) [10 U.S.C. 3204(a)(1)] - Only one responsible source and no other supplies or services will satisfy agency requirements, FAR 6.302-1.

The NSWC PCD has a requirement to acquire Off-Gas Testing of SIR ISA Sensors & Cables.

This purchase is not suitable for full and open competition for the following reasons. NAVSEA Drawing 8437022, Rev A lists the following providers as approved sources of supply: Brantner & Associates, Inc doing business as TE Connectivity MOG; Teledyne D.G. O’Brien, Inc; and Ocean Design, Inc. Ocean Design, Incorporated was bought by Teledyne D.G. O’Brien, Inc.

Teledyne D.G. O’Brien, Inc. is now Teledyne Instruments, Inc. doing business as DGO, Teledyne D.G. O’Brien Division. As the only approved sources of supply, no other brands are approved.

If other sources were to be used, their products would have to undergo extensive testing to assure compatibility with the SDV MK8 system. These tests would be prohibitively costly and could take up to 8 months to complete. As such, the government does not expect significant savings through full and open competition, and it is more advantageous to the Government to award on a limited competition basis to one of the companies referenced in Section 2 for the Reset/Override Switch Cable Assemblies as listed in paragraph 3 above.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, the companies referenced in Section 2 are the only sources that can meet the Government’s needs. This requirement will not be synopsized on the Contract Opportunities website at sam.gov.com per FAR Part 5.2.

7. Any other facts supporting the justification. None.

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, the companies referenced in Section 2 are the only approved sources that can meet this requirement.
