About this file

This document is a Sole Source Memorandum from the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD) for technical support training of Persistent Systems LLC products. The memorandum justifies a sole source, firm fixed price purchase order to train up to 15 personnel on the Wave Relay MAC with EMIC elements, involving a five-day training course that includes classroom and laboratory sessions on theory, applications, maintenance, and troubleshooting.

The justification for sole source procurement is based on the unique and customized nature of the equipment, which requires hands-on training from the Original Equipment Manufacturer (OEM). The government determined that Persistent Systems LLC is the only source capable of providing the specialized training, and that competitive bidding would not yield significant savings. The contracting officer has assessed the order as representing the best value and lowest overall cost alternative to meet the government's specific training needs.

Subj: SOLE SOURCE MEMORANDUM FOR TECHNICAL SUPPORT TRAINING OF

PERSISTENT SYSTEMS LLC PRODUCTS. (REDACTED)

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”

This is a Sole Source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a sole source, firm fixed price purchase order to Persistent Systems LLC

(REDACTED) to train up to 15 personnel on usage, applications, maintenance and troubleshooting of the Wave Relay MAC with EMIC elements at NSWC PCD.

3. A description of the supplies or services required to meet the agency’s needs.

(including the estimated value). The contract effort is to acquire the following:

REDACTED.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

10 U.S.C. 2304(c)(1) - Only One Responsible Source and No Other Supplies or Services

Will Satisfy Agency Requirements FAR 6.302-1.

The equipment purchased by NSWC PCD from Persistent Systems, which was customized to suit our particular use-case, is complicated and requires hands-on training in the scenarios that the equipment was designed for. Only the Original Equipment Manufacturer (OEM) can provide this service properly. The procured items exhibit certain capabilities that the manufacturer is aware of and only they can train in the best use for their products. Additionally, alternative training is based on “classroom” training, where Persistent Systems is providing both a classroom training environment AND hands on laboratory training of their designed equipment.

As such, the Government does not expect significant savings through competition and it is more advantageous to the Government to award on a sole source basis to Persistent Systems LLC the acquisition of a training course.

5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

For the reasons specified in paragraph 4 above, Persistent Systems LLC is the only source that can meet the Government’s needs. REDACTED

7. Any other facts supporting the justification.

None

8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Persistent Systems LLC is the only source of equipment that can meet the Government’s needs.
