About this file
This is a Sole Source Justification (SSJ) for a federal contract action under the Simplified Acquisition Threshold.
The Armed Forces Medical Examiner System Division of Forensic Toxicology (AFMES-DFT), under the Defense Health Agency Contracting Activity (DHACA), is procuring computers and software upgrades to comply with a Defense Health Agency mandate for Windows 11 operating system upgrades. The sole source vendor is ABSciex, LLC, identified as the only company that sells the proprietary software required to operate and compile data on AFMES-DFT instruments used for forensic toxicology testing. The procurement is structured as a new fixed-price purchase order with a base period from September 30, 2026, to September 29, 2027, with an estimated value of $109,963.35 funded through FY2026 Operations and Maintenance. The justification authority cited is RFO 12.102(a), which permits sole-source acquisitions valued at or below the simplified acquisition threshold when only one source is available. Market research conducted from January to March 2026 by John Kristofic and Heather Cook confirmed that alternative vendors through CHESS, SEWP, GSA, AbilityOne, and Unicor do not offer the required proprietary software. The justification emphasizes that purchasing computers from alternative sources would result in warranty limitations and additional service costs, whereas computers purchased directly from ABSciex can be added to the existing maintenance contract (HT9425-24-P-0104) upon warranty expiration. Without this sole-source approval, instruments dependent on the upgraded computers and software will become non-functional once the current software version reaches end-of-service, directly impacting AFMES-DFT's ability to screen and confirm test results for autopsies, aircraft incidents, DWI/DUI investigations, and fitness-for-duty evaluations.

4. Authority:
Revolutionary FAR Overhaul (RFO) 8.401 & Subpart 538.7104-3(a) –The ordering activity contracting officer must determine in writing that the circumstances of the acquisition deems only one source reasonably capable of providing the products, services, or solutions (e.g., urgency, exclusive licensing agreements, items particular to one manufacturer).
X☐ RFO 12.102(a) – For acquisitions valued at or below the simplified acquisition threshold (SAT), document the decision that only one source is available and the basis for the decision.
☐ RFO 16.507-6(b)(1) -- The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
☐ RFO 16.507-6(b)(2) -- Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
☐ RFO 16.507-6(b)(3) -- The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
CUI
☐ RFO 16.507-6(b)(4) -- It is necessary to place an order to satisfy a minimum guarantee.
☐ RFO 16.507-7 -- Items Peculiar to One Manufacturer
5. Reason for Authority Cited:
a. While addressing the DHA-mandated upgrades to the Windows 11 computer operating system, the Armed Forces Medical Examiner System Division of Forensic Toxicology (AFMES-DFT) staff discussed whether or not to purchase any new computers from a different source, and to then have the AB Sciex LLC-specific software installed. As computers purchased from a CHESS or SEWP vendor do not have maintenance plans beyond the one-year warranty, service would be a separate cost and would likely incur additional costs from ABSciex LLC for software reinstalls, upgrades, etc. However, computers purchased from Sciex can be added to the current maintenance contract (HT9425-24-P-0104) once the one-year warranty expires. Another complicating factor is the projected end of service for the current version of software several of the instruments depend on for functionality and data collection.
b. If this SSJ is not approved, the instruments which depend on these computers and upgrades will no longer function due to the above-mentioned end of service; once that date passes, the software will no longer receive upgrades or service of any kind. As that occurs, instruments will be taken out of service which will affect DFT’s ability to screen and confirm test results for autopsies, aircraft incidents, DWI/DUI and other fit for duty investigations.
c. ABSciex LLC is the only company that sells the proprietary software needed to operate and compile data on their instruments.
6. Market Research:
CHESS and SEWP vendors were considered for the computers in this requirement, as well as any vendors selling on GSA, AbilityOne and Unicor. The required software was not available on any of the vendors above, and purchasing the computers via CHESS or SEWP vendors leads to issues with warranty and service issues.
This requirement is a sole source because the only vendor that sells the required, proprietary software upgrades is AB Sciex LLC. Another vendor’s similar products will not meet the governments needs because the instruments needed upgraded computers and software are AB Sciex LLC branded, and need AB Sciex LLC branded items in order to function.
Market research was conducted from January to March of FY2026.
