About this file

This document is a Non-Competitive Procurement Justification Memo from the Naval Surface Warfare Center Crane Division (NSWCCD) for a sole-source services contract with Southwest Research Institute (SwRI). The requirement is for human injury risk simulations and analyses using the Incapacitation Prediction for Readiness in Expeditionary Domains: an Integrated Computational Tool (I-PREDICT) Human Body Model. The contractor will perform deterministic and probabilistic simulations to assess injury risks for submarine personnel under various accelerative deck loading profiles, both belted and unbelted.

The justification for sole-source procurement is based on SwRI's unique access and in-depth knowledge of I-PREDICT, which has been developed with Office of Naval Research investment since 2018. The document argues that bringing in another contractor would require significant time to develop the tool, potentially affecting submarine survivability and mission capabilities. The contract is for one year, with SwRI utilizing models from their previous FY25 contract, and the total procurement is expected to be under the simplified acquisition threshold. The memo includes technical certification and contracting officer approval, dated 29 OCT 2025 and 06 JAN 2026 respectively.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025

MEMORANDUM FOR FILE

FROM:

CODE: 665

TO: Code 02

DATE: 24 OCT 2025

SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer

3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)

The NSWCCD’s Code 665 requires a services contract to perform human injury risk simulations and analyses and report the findings using the Incapacitation Prediction for Readiness in Expeditionary Domains: an Integrated Computational Tool (I-PREDICT) Human Body Model (HBM). The Government will use reporting results to assess the injury risk of submarine personnel subjected to various accelerative deck loading profiles in a seated configuration both belted and unbelted. The contractor shall perform simulations both deterministically and probabilistically, which provides a more realistic risk of injury that accounts for uncertainty and variability in the human and environment. In this task, the contractor will apply human digital twin models with the intention of predicting injuries to crew members. The output from these models will guide future SSNX vulnerability assessments that PMS351 requires. The period of performance for this purchase is one year from date of contract award.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.

1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment

Manufacturer (OEM).

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025

3. Federal Supply Schedule (FSS) IAW FAR 8.405-6(b).

4. Other Reasons.

B. SOLE SOURCE. (select all that apply)

1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. Other Reasons.

This services acquisition should be limited to the sole source for the following reasons:

Since 2018, Office of Naval Research has invested to develop and maintain I-PREDICT. SwRI is the only contractor that has access and in-depth knowledge of I-PREDICT. Significant amount of time would be needed for an additional contractor to be stood up to develop I-PREDICT, which could affect the survivability and mission capability of SSNX. SwRI will utilize models that were built for the FY25 contract (N0016725P0040) in the FY26 contract; if another contractor takes this project this could cost the government not only in funds but in time. If this is not sole sourced, substantial duplication of costs to the US Navy, which would not be recovered through competition, would take place.

4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)

a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or

c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal

Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
