About this file

This is a Non-Competitive Procurement Justification Memorandum for a sole-source acquisition of Fidelity Pointwise software maintenance and support from Cadence Design Systems Inc. The Naval Surface Warfare Center Carderock Division (NSWCCD) and Ship Engineering and Analysis Technology Center (SEATech) require annual renewal of Fidelity Pointwise software licenses and maintenance, which serves as a mission-critical tool for generating high-fidelity computational grids for hydrodynamic modeling, design, and analysis. Cadence Design Systems Inc., located at 2655 Seely Avenue, Building 5, San Jose, CA 95134, is the sole source of this software and its authorized support services.

The justification establishes that Fidelity Pointwise is the only source capable of providing the required specialized meshing capabilities for complex geometries, including advanced techniques such as T-Rex anisotropic tetrahedral extrusion. While alternative solutions such as Ansys Meshing exist in the market, Fidelity Pointwise is uniquely suited to NSWCCD's requirements for turbomachinery design analysis and fluid simulations. The renewal maintains continuity of naval engineering projects and avoids projected unprogrammed costs and an 18-month operational delay that would result from non-renewal. The procurement is being conducted under simplified acquisition procedures on a sole-source basis, with Cadence holding proprietary rights and exclusive licensing agreements for the software. A capabilities statement deadline of May 26, 2026, at 12:00 PM has been established for interested parties, though this notice is not a request for competitive proposals and represents a sources sought opportunity.

MEMORANDUM FOR FILE

TO: Code 02

DATE:

SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer

3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)

This request is for the annual maintenance renewal of Fidelity Pointwise software for the Naval Surface Warfare Center Carderock Division (NSWCCD) and the Ship Engineering and Analysis Technology Center (SEATech). Fidelity Pointwise is a mission-critical tool used to generate high-fidelity numeric grids for hydrodynamic modeling, design, and analysis.

MANUFACTURER: Cadence Design Systems Inc. ADDRESS: 2655 Seely Avenue, Bldg. 5 San Jose, CA 95134 PHONE: 817-720-1414 POC: tcarriga@cadence.com

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

☒ B. SOLE SOURCE. (select all that apply)

Fidelity Pointwise serves as the foundational component of SEATech’s Computational Fluid Dynamics (CFD) workflow. It allows engineers to create complex computational grids required to solve hydrodynamic modeling equations with high precision. Market research identified several CFD solutions, such as Ansys Meshing. While both Ansys Meshing and Fidelity Pointwise offer several components in CFD design, Fidelity Pointwise is considered a specialized meshing tool with advanced features for generating complex geometries and high quality meshes particularly for intricate geometries where accurate meshing is crucial for creating animations.

Pointwise software leads in generating turbomachinery design analysis and reports that communicate findings effectively for fluid simulations. This is why SEATech has requested to renew and stick with the existing Fidelity Pointwise software. The renewal will allow our experienced users to continue creating high-quality meshes faster than going with other CFD automated tools, especially for complex geometries. This translates to lower labor

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025 costs and faster turnaround times for simulations. The structured and unstructured meshing capabilities, along with advanced techniques like T-Rex (anisotropic tetrahedral extrusion), contribute to this efficiency.

Renewal of the Fidelity Pointwise maintenance agreement is required to maintain the continuity of current Naval engineering projects. For over a decade, this software has enabled NSWCCD to meet stringent government requirements for hydrodynamic research. Retention of this software is vital to avoid a projected $ in unprogrammed costs and an 18-month operational delay. Failure to renew would cause significant program delays, introduce unnecessary financial burdens, and compromise the accuracy of critical fluid flow simulations.

☒ 1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

Fidelity Pointwise software is the property of Cadence and/or its licensors. Only Cadence or its authorized resellers/distributors can provide genuine license software products. Please review the attached Fidelity Pointwise Sole Distributor letter.

· 2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

· 3. Other Reasons.

· 4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)

· a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

· b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or

· c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

IV. CERTIFICATIONS & APPROVALS

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
