SOLE SOURCE JUSTIFICATION
From:
To: Cognizant Code 02 Acquisition Branch
Subj: SOLE SOURCE JUSTIFICATION FOR ENGINE FAMILIARIZATION
TRAINING
1. DESCRIPTION OF REQUIRED SUPPLIES/SERVICES, ESTIMATED
VALUE, AND DELIVERY REQUIREMENTS.
Naval Surface Warfare Center, Carderock Division (NSWCCD), Code 8311, requires familiarization training and services for diesel engine installation, as well as field services in support of Government developmental and operational testing. The requisite training and services is needed for existing OXE Marine AB-branded diesel engines manufactured by the original equipment manufacturer identified below:
OXE MARINE AB (OXE)
Hortensiagatan 6 SE - 256 68 Helsingborg
SWEDEN
NSWCCD intends to solicit this requirement on a sole source basis to Diesel Outboards, LLC (Diesel Outboards) [1500 NW 62Nd St. STE 104 Fort Lauderdale, FL 33309-1848, USA]. The estimated cost for this procurement is $
2. SUPPORTING DOCUMENTATION FOR SOLE SOURCE BASED ON
CONTRACTOR’S UNIQUE QUALIFICATIONS OR NATURE OF THE
ACQUISITION
NSWCCD intends to solicit this requirement on a sole source basis under the authority of FAR 13.106-1(b)(1)(i), which states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g.,urgency, exclusive licensing agreements, brand-name or industrial mobilization).
Due to the immediate need of Explosive Ordinance Disposal (EOD) Group Two N8 and Office of the CNO OPNAV N957, to transition outboard diesel engines, NSWCCD acquired OXE -branded diesel engines to mitigate gasoline combustion risk during deployment, via ship and aircraft transport, enable a standard fueled engine to increase operational availability from a ship or sea base, as well as meet the objective requirement of the EOD MERC Letter of Requirements. Rapid transition of the diesel outboard program is imperative for EOD to support joint and naval underwater operations to locate, render safe, and/or recover submerged objects, and ordinance, harbor clearance/search and expeditionary salvage missions.
NSWCCD now requires familiarization training and services for those existing OXE-branded diesel engines, as well as field services in support of Government developmental and operational testing of those engines. The results of the Contracting Officer’s informal market research identified two companies that are authorized to sell OXE-branded diesel engines: (1) Diesel Outboards; and (2) Mack Boring and Parts Company (Mack Boring). However, only Diesel Outboards possesses the required certification to provide the requisite training and services need by NSWCCD. Diesel Outboards possesses the master technician and master trainer certification. The contractor will also provide training and support for Diesel Outboard’s intellectual property, the Containerized Combat Ready Equipment SparesTM (C-CRES). NSWCCD obtained the C-CRES with the previous purchase of the OXE -branded diesel engines without the training included.
Therefore, in accordance with FAR 13.106-1(b)(1)(i), the Contracting Officer has determined that the circumstances of the contract action deem only Diesel Outboard as the source available for the required training and support services.
3. MARKET SURVEY
As discussed above, the Contracting Officer’s informal market research identified two companies that are authorized to sell OXE-branded diesel engines: (1) Diesel Outboards;
and (2) Mack Boring and Parts Company (Mack Boring). However, only Diesel Outboards is authorized and certified by OXE to provide the requisite training and services. Diesel Outboards possesses the necessary master technician and master trainer certification required to provide training on OXE-branded diesel engines. Note, the Contracting Officer inquired with Mack Boring about its capability to provide the needed training. The Contracting Officer received no response from Mack Boring. Additionally, a review of Mack Boring’s website indicated that installation and operation training for OXE-branded diesel engines is not offered by the company.
