ORDER >SAT
FAR PART 8.405-6
Acquisition Plan Action ID:_36C249-21-AP-1066_______
(1) Contracting Activity: Department of Veterans Affairs, VISN 09, Robley Rex VA Medical Center, Network Contracting Office 9, 1639 Medical Center Parkway Ste 400, Murfreesboro, TN 37129.
2237: 603-21-2-025-0170
(2) Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). This is a new urgent requirement for 5 Certified Nursing Assistants to be on-site at the Robley Rex VAMC for a base period of 6 months with one 6 month option period.
Order against: FSS Contract Number: __V797P-7345A__________
Name of Proposed Contractor: Medical Staffing Solutions, LLC
Street Address: 8601 North Kentucky Avenue
City, State, Zip: Evansville, IN 47725
Phone: 812-568-0118
(3) Description of Supplies or Services:
The estimated value of the proposed action is $ XXX,XXX.00
The Robley Rex VAMC has an emergency need for 5 Certified Nursing Assistants (CNAs) to perform on-site at the medical center. Currently, the facility has a total of 15 vacancies throughout the nursing department for these positions. The current staff is overworked and cannot continue to perform all the overtime necessary to make up for the shortage in staffing.
Overworked and tired staff could negatively affect patient care. The Medical Center Director approved the emergency request for the CNAs. A total of 5 CNAs are required now to allow for Robley Rex to continue recruitment for the positions and to put a longer term contract in place for staffing shortages. The task order will be in place for a base period of 6 months, with one 6-month option period for a maximum period of one year.
(4) Identify the Authority and Supporting Rationale FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: Due to staffing shortages at the Robley Rex

VAMC, an urgent and compelling need exists for 5 CNAs to be on-site to alleviate the burden on the current staff and minimize potential patient care issues due to current staff being overworked. A short-term task order is needed for a base period of 6-months with one 6-month option while a long-term competitive contract is being put in place.
FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;
FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.
FAR 8.405-6(b): Items peculiar to one manufacturer:
A patent, copyright or proprietary data limits competition. The proprietary data is:
These are “direct replacements” parts/components for existing equipment.
The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing.
(5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Medical Staffing Solutions has provided an hourly rate of $XX, all inclusive of travel, lodging, etc during market research. Comparing this rate to other nursing assistant hourly rates found on GSA shows that this is the best value to the Government. For example, A-Team Solutions charges an hourly rate of $33.02 and that rate does not include travel and lodging that might be necessary for the CNAs to come to Louisville, KY. Medical Staffing Solutions has indicated that they have 5 CNAs that could be on-site to begin performing on 1 March 2021, which is when the facility states they need them. Another company, Ghost RX, charges an hourly rate of $43.50 and that rate does not include travel and lodging that might be necessary for the CNAs to be in Louisville, KY.
(6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. The Robley Rex VAMC initially conducted market research by reaching out to local companies nearby Louisville, KY that might be able to provide the CNAs needed. Medical Staffing Solutions, a small woman-owned business, located in Evansville, IN, was able to provide the 5 CNAs needed to Robley Rex within the time frame needed. A search on GSA e-library shows Medical Staffing Solutions currently has an FSS contract. The search also shows a total of 17 SDVOSB/VOSBs listed. As an emergency need exists, it is not practicable to solicit every vendor on the Federal Supply Schedule that may
VHAPM Part 808.405-6 Limiting Sources Page 3 of 4 Revision 02 Eff Date: 02/21/2020 or may not be able to provide 5 CNAs by 1 March 2021. This would result in unnecessary delays by asking the vendors if they have 5 available to start on 1 March and then waiting on the vendors to query their databases, reach out to potential candidates to determine availability, and then provide feedback to the Contracting Officer, who would then need to obtain approval of the candidates by the Robley Rex VAMC. A contract will be put into place for these services on a long-term basis. During that procurement, appropriate time will be given to conduct more thorough market research to potentially set the long-term contract aside for SDVOSB/VOSB.
(7) Any Other Facts Supporting the Justification: None
(8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:
An emergency need currently exists for 5 CNAs to be on-site at the Robley Rex VAMC. A long-term contract is being prepared and will be a competitive action conducted IAW with all applicable FAR, VAAR, and VHA policies, rules and regulations.
(9) Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this limited sources justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by FAR Subpart 8.4.
