About this file
This document is a Non-Competitive Procurement Justification Memo from the Naval Surface Warfare Center Carderock Division (NSWCCD) for a sole-source procurement of military batteries. The procurement involves acquiring five (5) MIL-PRF compliant Li6T batteries from Saft America, Inc., specifically the Saft 1B-55 variant intended for use in lab testing related to the US Army's FMTV Anti-idle kit (AIK). The justification for sole-source procurement is based on Saft's proprietary design and manufacturing processes, with the batteries having unique electrical and chemical characteristics that require specific safety approvals.
The procurement is being conducted under the simplified acquisition threshold, with expected delivery by September 11th. Saft is the only manufacturer capable of producing these modified batteries, which have a National Stock Number (NSN) but cannot be obtained through standard Defense Logistics Agency (DLA) channels. The memo highlights that only this exact battery variant will be tested and qualified for the specialized enclosure and platform, making Saft America the exclusive source for this specific requirement. The document includes technical certification and contracting officer approval, with the contracting officer digitally signing the document on July 30, 2025.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025
MEMORANDUM FOR FILE
FROM:
CODE: 635
TO: Code 02 DATE: 24 July 2025 SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer
3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)
Code 635 requires five (5) MIL-PRF compliant military Li6T batteries from Saft America, Inc. intended for use in lab testing. They are expected to be delivered by September 11th.
MANUFACTURER: Saft America, Inc.
ADDRESS: 107 Beaver Court, Cockeysville MD 21030 Phone: 410-568-2708 POC: John Hazel
Estimated Total Price (including options if applicable):
III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.
1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM).
3. Federal Supply Schedule (FSS) IAW FAR 8.405-6(b).
4. Other Reasons.

B. SOLE SOURCE. (select all that apply)
1. Restrictive Rights. The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
Saft has established proprietary design and processes which are required to satisfy stringent military requirements.
Saft sells their MIL-PRF Li6T batteries directly to the Government for military use. While Saft has a network of distributors to include sales only Saft is capable of manufacturing these batteries and performing the requested modifications, which must be performed during the manufacturing process. The required Saft battery has an NSN assigned but cannot be obtained through DLA due to the required need for modified batteries.
2. Exclusive Licensing Agreements. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. Other Reasons.
The US Army is fielding the Saft 1B 55 MIL PRF compliant Li6T in their FMTV Anti idle kit (AIK). Only this exact battery variant will be tested, qualified, and lithium battery safety approved for that platform and the specially developed enclosure that we are testing. Li6T batteries all have unique electrical and chemical characteristics, and the safety and hazards presented by each are unique. Thus, we can only conduct our abusive testing for the FMTV platform with the Saft 1B 55 (MIL PRF rated) Li6T.
4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)
a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or
c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.
IV. CERTIFICATIONS & APPROVALS
A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.
