MEMORANDUM

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION UNDER

THE SIMPLIFIED ACQUISITION THRESHOLD

Ref: (a) PR Number(s): 1301223976

I. BACKGROUND:

1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).

2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

1. Provide a description of the item or service required, to include

Ocean Guard (for Support Buoy, SB-50 and Chain Thru Buoy, CTB 275, 2-1/2" chain capture plate)

Sea-Link (for 2-1/2" Double Nut Shackle, Anchor Style Regular Jaw and 1-3/4" Double Nut Shackle, Anchor Style Regular Jaw)

Samson Rope (for 1-1/4" Quantum 12, 300 feet w/ 30 foot 2-1/4" RP12 mooring tail with Cor- Gard covered eyes and Chafe-Pro FS, size D)

b) the required delivery date/period of performance and

RDD 07/01/2025; PoP 08/01/2025 09/01 2025

c) its intended use.

The materials to be procured will be used to support safe mooring of the USNS Choctaw County in MARAD s James River Reserve Fleet while the vessel is maintained as a logistics support asset for an anticipated period of at least three years.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED

a. CRITICAL SHIP EQUIPMENT: The required item is critical ship equipment, the failure of which poses a hazard to the ship, the crew or the environment.

These brand names are being selected under the direction of MARAD s James River Reserve Fleet and represent products that have been used by the reserve fleet successfully to moor other vessels in their anchorage. As the operators of the reserve fleet, MARAD is the entity that is responsible for providing safe mooring, as well as caretaking, for USNS Choctaw County and has selected products that have performed reliably within their anchorage for many years and have technical characteristics that are compatible with their intended mooring.

c. FORM, FIT, AND FUNCTION: Item is direct replacement parts / components for existing equipment and must be compatible in terms of form, fit, and function with existing equipment / configurations.

d. X OTHER: These brand names are being selected under the direction of MARADs James River Reserve Fleet and represent products that have been used by the reserve fleet successfully to moor other vessels in their anchorage. As the operators of the reserve fleet, MARAD is the entity that is responsible for providing safe mooring, as well as caretaking, for USNS Choctaw County and has selected products that have performed reliably within their anchorage for many years and have technical characteristics that are compatible with their intended mooring. MSC cannot deviate as MARAD will be responsible for mooring of the vessel and as such MSC must adhere to their requirements. Any deviation could result in MSC being held liable.

4. UNUSUAL AND COMPELLING URGENCY: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:
