About this file

This document contains a justification and approval for other than full and open competition as well as a related federal contract opportunity solicitation. The justification approves a sole source award to GDCA, Inc. for 26 AVME9427-I-L and 33 AVME9432-I-L circuit card assemblies required to support a Solid State Transmitter. It cites that these assemblies are the only ones that meet form, fit and function requirements, have undergone compatibility testing, and are listed in technical manuals and training curriculum. The solicitation seeks quotes for the same assemblies from GDCA, Inc. as the intended sole source, referencing the justification. The Naval Surface Warfare Center Port Hueneme Division will award a contract for the circuit card assemblies to support equipment on naval ships.

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Surface Warfare Center Port Hueneme Division (NSWC PHD).

2. Description of the Action Being Approved

NSWC PHD intends to award a single contract on the basis of other than full and open competition as a Sole Source requirement for

26 AVME9427-I-L each and 33 AVME9432-I-L each required to support

Solid

State Transmitter (SSTX).

3. Description of Supplies/Services

NSWC PHD is procuring 26 AVME9427-I-L and 33 AVME9432-I-L circuit

Card assemblies.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c)(1) as implemented by the Federal Acquisition

Regulation (FAR) 6.302-1, Only One Responsible Source and No

Other Supplies or Services Will Satisfy Agency Requirements. The particular sole source, product, or feature is essential to the

Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular features, do not meet, or cannot be modified to meet, the agency’s needs.

NCH 53.6-2

NSWC-PHD-JA-21-102

5. Rationale Justifying Use of Cited Statutory Authority

The AVME9427-I-L and AVME9432-I-L CCAs are required to support future production onboard naval ships. These CCAs are specifically listed in onboard Allowance Parts Lists (APL), Technical Manuals and supported by Naval Education and Training curriculum and the

Naval Repair Facility rotational pool system. The technical data package specifically identifies the AVME9427-I-L and

AVME9432-I-L CCAs. Further, these CCAs have been tested and verified to be compatible with equipment. No other CCAs have undergone first article testing and been verified to be compatible with equipment.

The OEM of the AVME9427-I-L and AVME9432-I-L CCAs is Acromag, Inc. However, Acromag, Inc. has stopped producing and repairing these CCAs and will no longer sell these products to the

Government. The design is proprietary to Acromag, Inc., who transferred the Intellectual Property (IP) rights only to GDCA and has agreed to provide technical support to GDCA if needed during production. There is no change to design, and direct replacement is applicable. There are no third party vendors. GDCA is the only source.

GDCA is a legacy electronics equipment manufacturer (LEM) that maintains established relationships with original equipment manufacturers (OEMs). GDCA offers alternative manufacturing and support capability that reestablishes the manufacturing capability for commercial off-the-shelf (COTS) and custom circuit card assemblies (CCAs) whose supply chains have been broken by electronics obsolescence. Supported by legal license agreements that protect the OEM, GDCA provides a second source of supply

(SSoS) that reestablishes the manufacturing capability to support ongoing production of obsolete parts that were previously discontinued by the board OEM. These license agreements provide

GDCA with the needed materials, including board schematics and related information to build these discontinued products identically to the OEM specification. This offers customers a

"plug & play" solution without sacrificing compatibility to the original product specification.

Due to hardware and software requirements, 100% form, fit, and function are required from both CCAs. The CCAs must interface with each other and the equipment exactly as the previous

CCAs did. NSWC PHD tested GDCA Inc.’s AVME9427-I-L and AVME9432-

I-L CCAs prototypes and determined that GDCA’s CCAs are comparable to the OEM Acromag, Inc. (legacy) components.

Therefore, GDCA’s CCA prototypes are deemed acceptable. The

Government (S53 Diminishing Manufacturing Sources and Material

Shortages (DMSMS) team) was unable to locate alternate CCAs that provided the required form, fit, and function.

Since no other vendors can provide the AVME9427-I-L and AVME9432-

I-L CCAs, procuring from a source in place of the GDCA, Inc, would require other vendors to manufacture VME I/O Input CCAs that are form, fit and function, and undergo first article testing (FAT) to verify compatibility with equipment. An engineering change proposal (ECP) would also need to be processed. The estimated cost to do FAT with a new vendor is about $130K. This estimate is based on the cost to undergo FAT for the verified AVME9427-I-L and AVME9432-I-L CCAs received from vendor. This is a substantial duplication of cost that cannot be recovered through competition. Also, processing ECP would take another 3 to 4 months which would impact installation schedule. This estimate is based on a flow chart for the ECP process with time established in NSWC PHD. If, after testing and verification, the Government is unable to identify a source that can provide VME I/O Input CCAs with 100% form, fit, and function, the Government would be required to redesign the system.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

The AVME9427-I-L and AVME9432-I-L CCA are not available in the

Navy Supply System. After exhausting all Navy Supply resources, Quotes were obtained from GDCA, Inc.

7. Determination of Fair and Reasonable Costs

The Contracting Officer shall determine that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. There is Navy Supply System pricing to compare to the market pricing from GDCA, Inc. to support the fair and reasonableness.

8. Actions to Remove Barriers to Competition

NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
