About this file
This document is a justification and approval for a sole source brand name contract award. The Naval Surface Warfare Center Port Hueneme Division requires National Instruments circuit card assemblies and chassis to support testing equipment used on aircraft launch and storage systems. The government conducted a trade study and determined National Instruments products are the only technically viable option that is compatible with existing software and can meet performance requirements. Identifying and qualifying alternative brands would result in significant duplication of costs not expected to be recovered through competition. The solicitation seeks National Instruments products including chassis, interface modules, oscilloscopes, serial interfaces, and digital input/output devices with a total estimated value of $1,000,000 to be awarded under contract number N63394-21-Q-0055 to support the Department of the Navy Naval Sea Systems Command.

JUSTIFICATION AND APPROVAL
JUSTIFICATION
1. Contracting Activity
The Naval Surface Warfare Center, Port Hueneme Division, (NSWC
PHD).
2. Description of the Action Being Approved
NSWC PHD intends to award a single contract on the basis of other than full and open competition as a Brand Name requirement for National Instrument (NI) circuit card assemblies and chassis required in support of Air Dominance Department (Code A57).
This hardware will be used on the to support
3. Description of Supplies/Services
NSWC PHD Air Dominance Department (Code A57) requires the
National Instrument circuit card assemblies and NI chassis for use in the The is a that stores and launches a variety of types. The National Instrument circuit card assemblies are part of the test sets. The test set will be used to verify the electrical integrity of the new production versions of and 29V
Assembly of the The assembly is a subassembly of the programmable power supply (PPS) module of The test set shall be used to verify the electrical integrity of the new production versions of
Hazard Control Module (HCM) or Hazard Electronic Box (HEB).
These modules are part of the Baseline VII
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
The total estimated value of the requirement is and is composed of the following funding sources reflected in Table

4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c)(1) as implemented by the Federal Acquisition
Regulation (FAR) 6.302-1(a)(2), Only One Responsible Source and
No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use Of Cited Statutory Authority has tested and integrated various NI circuit card assemblies and NI chassis for use in the and test sets. The Government conducted a trade study in which the program office and Technical Design Agent (TDA), determined that the use of the NI circuit card assemblies and NI chassis in these test sets is the only technically viable option that meets requirements to support the platform. This was based on the
NI cards compatibility with existing software (LabVIEW and
Measurement Studio), as well as backwards compatibility with other applications. These NI circuit card assemblies and NI chassis are currently part of the Technical Data Package (TDP).
The Navy would incur a non-recurring cost approximately of in order to identify and qualify alternate brands of equipment that are capable of meeting requirements. The estimate derives from the Baseline VII Tech
Refresh efforts from 2011-2016 which included taking steps to ensure that new sources were capable of producing a product that met the established performance requirements. This included the costs for the Government to conduct research, integrate the new system, First Article Tests, Confidence and Functional testing for form, fit and function. Additionally, the existing software programs (LabVIEW and Measurement Studio) would have to be modified to ensure compatibility, and Shock and Vibration testing would need to be performed. Further, even if an alternate brand of parts were determined to be qualified and meet requirements, all applicable documentation would need to be updated through Engineering Change Process (ECP) to introduce the new alternate brand part into the system. Therefore, an attempt to identify and qualify alternate brand parts for the manufacturing of equipment that will meet the requirements will cause a substantial duplication of cost to the Government that is not expected to be recovered through competition.
Without the required NI circuit card assemblies and NI chassis, the Government cannot have a functional Automatic Test Equipment
(ATE) to test the system.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
The Government had reached out and found various vendors who will sell the NI circuit card assemblies and NI chassis. A
Sources Sought Notice was posted to SAM.gov/Contract
Opportunities with five responses received from small business entities identified as authorized distributors/resellers of NI products.
7. Determination Of Fair And Reasonable Price
The Contracting Officer shall determined that the anticipated cost to the Government for the supplies covered by this J&A will be fair and reasonable.
8. Actions To Remove Barriers To Future Competition
NSWC PHD will continue to conduct market research as warranted to provide a broader vendor base as applicable for the types of supplies/services covered by this document. If another potential source emerges, NSWC PHD will assess whether competition for future requirements is feasible.
