About this file
This document is a Memorandum for Record regarding the limited competition for a contract to provide semi-preventative maintenance service on a Marietta Digital X-Ray Machine and Enclosure. The Army Contracting Command - Redstone Arsenal - Corpus Christi Army Depot is the contracting activity. The contract will be awarded as a new requirement under a Purchase Order. The proposed contractor is Marietta Non-Destructive Testing (NDT) LLC, a large business. The justification for limiting competition is that the equipment requires proprietary Marietta application software to operate, which cannot be procured from any other company. Previous contracts for this requirement were sole-sourced to Marietta NDT due to the need for software enhancements. Market research was conducted, and a source sought notice was posted, but no other vendors could provide the required proprietary software. The base period is 27 November 2024 to 26 November 2025, with two 1-year option periods. Pricing will be fixed-price.

6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 apply and will be followed.
7. Market Research: Market Research conducted by Gilbert Sanchez, Industrial Specialist and Terry Clark, Contract Specialist from 01 July 2024 – 24 September 2024.
Mr. Sanchez contacted Lee Stanton from Marietta, service manager on 01 July 2024 and Mr. Stanton provided the specific tasks performed on the Preventative Maintenance (PM) and certifications required to perform those tasks. John Quesada, NDT Inspector Level III, contacted 01 July 2024. Mr. Quesada provided his knowledge of the equipment and Corpus Christi Army Depot (CCAD) requirements for personnel performing the PM.
Mr. Sanchez reviewed previous contracts W912NW-17-P-0011, W912NW-20-P-0024 and W912NW-21-P-0080. The Digital X-Ray system requires proprietary Marietta Application Software to operate. Marietta X-ray is in the process of upgrading and retrofitting the X-ray system including the software. The software cannot be procured from any other company. The equipment requires this software to function and must have critical updates and fixes when necessary or it will be rendered useless.
W912NW-17-P-0011 and W912NW-21-P-0080 were sole sourced to the OEM, Marietta Nondestructive Testing LLC due to software enhancements being required and each was a 3-year contract. W912NW-20-P-0024 was a Small Business Set Aside because no software upgrades were required, and it was only a 1-year contract.
On 16 September 2024 the Contract Specialist posted a source sought on SAM.GOV until 24 September 2024 and received some interest from outside sources. However, these contractors (Newco NDT, Cenmed Enterprises, and ERS Medical Inc.) do not have access to Marietta’s proprietary software application.
On 12 September 2024 the Contract Specialist reviewed SAM.GOV to confirm the company is still active and to determine the business size. The Contract Specialist reviewed PCF on the previous contract for this requirement and confirmed it is the same sole source vendor.
