About this file
This is a Justification and Approval document for a sole-source contract modification under Simplified Procedures for Certain Commercial Items.
The United States Army Garrison (USAG) Wiesbaden, through the Directorate of Public Works and the 409th Contracting Support Brigade Regional Contracting Office in Germany, seeks to modify existing Firm-Fixed Price IDIQ contract W912CM-22-D-0002 with incumbent contractor Gama Tronik Brandschutzsysteme GmbH. The modification increases the contract ceiling from $3,250,000.00 ($3,023,475.00 €) to $4,250,000.00 ($3,953,775.00 €), enabling issuance of a new $1,000,000.00 (€930,300.00) task order for maintenance, inspection, testing, and repair of fire alarm and detection systems at USAG Wiesbaden facilities. The task order covers a one-year performance period from May 30, 2026, to May 29, 2027. The services are mission-critical life-safety operations governed by U.S. National Fire Protection Association (NFPA) 72 standards and German DIN regulations, including quarterly, semi-annual, and annual testing of initiating devices, battery load testing, smoke detector sensitivity testing, and voice alarm communication system verification, all performed by qualified certified technicians.
The justification for sole-source procurement cites an inadvertent disclosure of historical pricing data during the pre-award phase of a competitive solicitation (W912CM26QA016), which resulted in cancellation on April 28, 2026. The Government determined that competitive re-solicitation cannot occur before the current contract expires on May 30, 2026, without creating a service gap. The Government is developing a Germany-Wide Multiple Award Task Order Contract (MATOC) for long-term competition, but requires this interim extension to maintain uninterrupted critical fire and life-safety services. The modification was approved based on determination that only the incumbent possesses the resources, mobilization, and system certification to continue performance without delay or service interruption during the constrained timeline.

JUNE 2025
Justification and Approval Other than Full and Open Competition
Only one responsible source and no other supplies or services will satisfy agency requirements
1. Requiring Activity: Directorate of Public Works (DPW), United States Army Garrison
(USAG) Wiesbaden, Germany.
2. Contracting Activity: 409th Contracting Support Brigade (CSB), Regional Contracting
Office (RCO) Wiesbaden, Germany.
3. Description of Action: The Directorate of Public Works (DPW) requests approval to modify existing Firm-Fixed Price (FFP) IDIQ contract W912CM-22-D-0002 to increase the overall contract ceiling to allow for the issuance of a new Task Order within the final ordering period, which expires on 30 May 2026, for the continuation of critical services, including the maintenance, inspection, testing, and repair of fire alarm systems.
The reason this modification is necessary is due to a pre-award protest that resulted in the cancellation of the solicitation. Since there is not enough time to re-solicit the requirement before the current contract expires, and because a MATOC is being contemplated vice another single award IDIQ, it is in the best interest of the Government to extend the services on the current contract for up to one year, during which time another vehicle will be put in place.
Therefore, the Government intends to execute a sole source action to the incumbent, Gama Tronik Brandschutzsysteme GmbH (Gama Tronik). The estimated value of the new Task Order is $1,000,000.00 (930,300.00 €), increasing the current contract ceiling from $ 3,250,000.00 (3,023,475.00 €) to $ 4,250,000.00 (3,953,775.00 €).
4. Description of Supplies/Services: This modification to increases the ceiling and issue a new
Task Order will allow the Government to continue ordering non-personal services for the continued maintenance, inspection, testing, and repair of fire alarm and detection systems located in facilities at USAG Wiesbaden. These services are critical for life safety, fire prevention, and the protection of Government property and personnel. This action ensures continuity of service while a long-term, competitive replacement contract (Germany-Wide MATOC) is solicited and awarded. These services are determined to be mission essential.
These services are strictly governed by U.S. National Fire Protection Association (NFPA) 72 standards, which mandate rigorous quarterly, semi-annual, and annual testing intervals performed by qualified and certified technicians. Required tasks include comprehensive functional testing of initiating devices, battery load testing and mandatory 5-year replacement, smoke detector sensitivity testing, and voice alarm communication system verification, all of which must be thoroughly documented for review by the Authority Having Jurisdiction (AHJ).
on 28 April 2026. Consequently, the Government requires a short-term action to maintain continuous, critical life-safety services while a long-term, competitive Germany-Wide Multiple Award Task Order Contract (MATOC) is established. Modifying the existing IDIQ to increase the ceiling and issue a new 12-month Task Order ensures there is no lapse in mandatory fire and life-safety coverage.
b. No Alternatives Available: Modifying the existing IDIQ to increase the ceiling and issue a new Task Order is the only viable solution. Gama Tronik has the resources in place and established expertise to perform the required services immediately. Executing this modification, while a follow-on MATOC is being fully competed (current proposed solution, pending market research), would allow for consistency and continuity in lifesafety services without a gap in service. A competitive acquisition for a short-term solution is impractical given the unforeseen time constraints caused by the pre-award protest and resultant corrective action taken by the Government.
c. Justification: Maintenance and Repair (M&R) of Fire Alarm Systems are legally mandated life-safety services required to ensure the safety of personnel and maintain regulatory facility occupancy at USAG Wiesbaden. Gama Tronik Brandschutzsysteme GmbH is the only responsible source capable of providing these services for a one-year period without causing unacceptable delays in fulfilling the agency's requirements and creating a substantial duplication of cost to the Government that is not expected to be recovered through competition.
Gama Tronik currently has an active IDIQ contract in place that performs the necessary services. Issuing a modification to increase the IDIQ ceiling, allowing for the issuance of a 12-month TO, is the simplest and fastest method to ensure uninterrupted services versus pursuing a bridge contract. While both actions would require a justification and legal approval to proceed, the bridge contract would require a re-solicitation versus the task order which would prevent any interruption in services. The re-solicitation would result in a gap in service. The IDIQ modification would accomplish the same goal as the bridge contract, without the inevitable gap in service.
d. Impacts if not approved: A break in service would present unacceptable risks.
The following itemizes the impacts if this contract modification is not approved:
- Life-Safety Violations: Facilities will be without legally required maintenance, inspection, and repair capabilities.
- Unacceptable Risk of Loss: Inoperable or unmonitored fire alarms create an immediate risk of injury, loss of life, and catastrophic damage.
- Work Stoppage: DPW will be unable to certify buildings for occupancy if fire alarm systems cannot be verified as functional.
7. Efforts to Obtain Competition: A Notice of Intent to Sole Source this modification will be published to SAM.gov, and any capability statements received shall be considered. However, given the unacceptable delays associated with a competitive action for these urgent life-safety services on this constrained timeline, competition for this contract modification and subsequent task order is not feasible.
8. Actions to Increase Competition: No additional actions are being taken to increase competition for this action. However, the 409th CSB/RCO Wiesbaden is actively developing a Germany-wide MATOC to ensure robust, long-term competition for the future requirement (current proposed solution, pending market research).
9. Market Research: Market research for the canceled competitive solicitation confirmed multiple vendors are capable of performing these services under a normal timeline. However, for this urgent requirement, only the incumbent can continue performance without a service gap within the constrained timeline, as they are already mobilized and certified on the installed systems and have performed these same services over the last two iterations with acceptable performance.
10. Interested Sources: To date, no other sources have written to express an interest in this requirement.
12. Technical Certification: I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
13. Requirements Certification: I certify that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
14. Fair and Reasonable Price Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable. This determination will be made using price analysis, comparison to historical pricing, and comparison to an independent Government estimate.
15. Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief
