Justification for Other than Full and Open Competition – FAR Part 13 Acquisitions under the SAT
V 1.3 (28 June 2018)
MEMORANDUM TO THE FILE
Subj: JUSTIFICATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
FOR A FAR PART 13 ACQUISITION UNDER THE SIMPLIFIED ACQUISITION
THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement (or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Training and Education Command (TECOM) has a requirement to obtain Marine Corps Junior
Reserve Officers’ Training Corps (MCJROTC) Cadet Leadership Camp (CLC) training support.
The contractor shall provide all personnel, equipment, supplies, facilities, tools, materials, supervision, and other items and non-personal services necessary to provide the specified facilities, lodging, logistical support, training areas, and training activities as defined in this

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS
BASED ON THE FOLLOWING (select all that apply):
A. _X__ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
Justification for Other than Full and Open Competition – FAR Part 13 Acquisitions under the SAT
V 1.3 (28 June 2018)
2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. _X__ OTHER REASONS.
Golden Spread Council is a Boy Scouts of America Council that is dedicated to shaping the character of young men and women around the United States to include MCJROTC cadets.
The Golden Spread Council Campgrounds at Camp Don Harrington provides training venues not found at any local establishments or camps, which ensure successful, safe and positive training of MCJROTC Cadets. Camp Don Harrington is uniquely positioned to provide this training support to high school age cadets that are equal and comparable to their own cadets.
They provide the needed support and are familiar with the needs of the JROTC programs of instruction. Boys Scouts of America and the JROTC programs have developed a unique working relationship to train the cadets with maximum returns and minimal costs. Camp Don
Harrington offers the use of their facilities to include living, dining, and training facilities for both male and female Marine Corps JROTC cadets.
Camp Don Harrington’s is the only identified camp within current travel restrictions that can provide lodging accommodations for approximately 100 MCJROTC cadets and provide the training necessary for the cadets to earn merit badges through the Boy Scouts of America.
The camp is located in Canyon, Texas, 13 miles from Caprock High School. Camp Don
Harrington’s close proximity to Amarillo, coupled with an array of training venues unlike any other resourced, adequately meets all training objectives set forth by the Director of the
Marine Corps JROTC program.
