JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

1. CONTRACTING AGENCY: U.S. Army Corps of Engineers, Alaska District, Contracting Division, P.O. Box 6898, JBER, Alaska 99506-0898

2. DESCRIPTION OF ACTION: This is a Justification and Approval (J&A) for Other than Full and Open Competition for a sole source AE contract action for Power Coordination Studies, Technical Assistance Requirements, and Sequence of Operations Working Group for the Long Range Discrimination Radar (LRDR) Campus at Clear AFS, Alaska. The estimated contract value is $xxxxxx with an eighteen (18) month period of performance.

3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:

The A-E will provide engineering services in support of the LRDR Site Activation Temporary Power Working Group Sessions up to the completion of the LRDR Power Plant (LPP) December 2021.

PROJECT OVERVIEW: This refresh study will perform an analysis of the existing power load of the CAFS, to include the CLR039 program and anticipation of future projects that may possibly restrict the available power of the CAFS substation. The anticipated projects for CAFS include a Dormitory, Administration Facility, Fire Station, and Road Infrastructure that will be ongoing during the CLR039 campus construction (completion date 31 December 2021).

There will be no options on this contract; however, to ensure that the services covered under this contract are available to contract completion FAR clause 52.217-8 Option to Extend Services will be included in case the expected completion date is not met.

4. AUTHORITY CITED: Other than Full and Open Competition is authorized pursuant to 10 U.S.C. 2304(c)(3), FAR 6.302-3 Industrial mobilization; engineering, developmental, or research capability; or expert services. 6.302-3(b)(2)(ii) Establish or maintain an essential capability for engineering or developmental work calling for the practical application of investigative findings & theories of a scientific or technical nature.

5. REASON FOR AUTHORITY CITED:

a. Background: This work was started under ID-AE Contract W911KB-12-D-0005 Task Order 0008; the base contract has expired and the period of performance for the task order ended in February 2020. PDC is the original designers of the transmission lines and CLR substation with all design signed and stamped. This contract is to complete the work started under the original AE contract, any future electrical work after construction is complete at the LRDR campus will be competed or placed as a task order under an exisiting ID-AE contract vehicle.

b. Justification: This will be a negotiated procurement with PDC, Inc, DUNS

623437605, Cage Code 0DZG9. A sole source procurement is required due to the knowledge and expertise on the CLR039 LRDR projects of this AE firm.

PDC will be able to provide the expertise required at contract award without disrupting the ongoing construction activity, power supply to completed construction projects, or construction schedule.

c. Impact: This is a cannot fail activity as to not interrupt the current radar mission onsite. In order to bring a new engineering firm on board and up to speed for the ongoing power requirements (temporary and permanent), it would cost in excess of double the expected $xxxxxx cost of this sole source action.

d. Alternatives: There are no alternatives that would not impact the ongoing construction or performance of completed construction projects.

6. EFFORTS TO OBTAIN COMPETITION: Based on the information in paragraph 5, above, competition for this contract is not feasible. There is no sub-contracted work expected for this contract.

7. ACTIONS TO INCREASE COMPETITION: Based on the information in paragraph 5, above, competition for this contract is not feasible. There is no sub-contracted work expected for this contract.

8. MARKET RESEARCH: Existing ID-AE contract vehicles were reviewed to determine if capability and capacity were available to meet this requirement; however, all existing ID-AE contract with capacity are slated for other projects and could not be utilized. Based on the information provided in paragraph 5 it is not feasible to bring a new AE on for the remaining portion of this work.

9. INTERESTED SOURCES: To date, no other sources have expressed an interest in writing.

In accordance with FAR 5.102(a)(6), this J&A will be included with the notice of intent to award a sole source contract published in the GPE prior to award of the contract..

10. Other Facts: Discuss any other facts supporting the use of other than full and open competition, such as the following:

a. Procurement history. ID-AE Contract W911KB-12-D-0005 Task Order 0008

b. Acquisition data availability. The base contract listed above expired in 2017; the task order period of performance ended in early 2020.

c. Unusual and compelling urgency. N/A

d. Subcontracting competition. There will be no subcontracting opportunities for this procurement.
