About this file
This is a Justification for Other Than Full and Open Competition (JOFOC) for an unevaluated lease renewal filed by the U.S. General Services Administration (GSA), PBS Office of Leasing.
Project Overview and Requirements:
The GSA seeks to renew the lease for office space occupied by the Equal Employment Opportunity Commission (EEOC) at 33 Whitehall Street, New York, NY. The current lease expires September 17, 2026. The renewal consists of a five-year term with a three-year firm commitment option for 24,733 ABOA/39,721 rentable square feet (RSF) of office space. The agency submitted a continuing need letter on May 6, 2026, for 39,721 RSF to support the EEOC's long-term strategic requirements. The estimated cost is calculated at a fully serviced rental rate per RSF per year for an annual cost and total contract value across the five-year renewal period.
Justification Basis:
GSA invokes 41 U.S.C. 3304(a)(1) and GSAR 570.402 to justify sole-source negotiation with the incumbent lessor. The justification rests on cost-benefit analysis demonstrating that relocation would result in substantial duplication of costs that cannot be recovered through competition. Market research conducted by Jones Lang LaSalle on May 12, 2026, using CoStar listings and local broker outreach identified no potentially acceptable alternative locations within the delineated area that would meet the agency's needs. GSA posted an advertisement on SAM.gov on May 27, 2026, for 15 days; only the incumbent lessor expressed written interest in retaining the EEOC's tenancy. The proposed rental rate is deemed fair and reasonable based on current market range data for the Manhattan submarket. No vacant federal space is available.
