About this file
This document is a Justification for Other Than Full and Open Competition (JOFOC) for a succeeding lease of office space for the Transportation Security Administration (TSA) in Franklin, Wisconsin.
The GSA currently leases 10,554 ABOA/11,820 rentable square feet of office space for the TSA at 9809 S Franklin Drive, Franklin, WI. The current lease expires on 7/24/2021 and the GSA is seeking to negotiate a 15-year succeeding lease with the incumbent lessor without full and open competition. The TSA has a continuing need for office space within 15 minutes of the Milwaukee airport, and the incumbent lessor is the only responsible source that can meet this requirement. Market research identified no other potentially acceptable locations. The estimated annual cost for the succeeding lease is $XXX per rentable square foot, which is deemed fair and reasonable based on local market data. No other sources expressed interest after the GSA placed an advertisement on FedBizOpps.

Attachment 1: Sample Justification for Other Than Full and Open Competition, Succeeding Lease
U.S. General Services Administration
GSA Region 5
Real Estate Division
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
PROJECT NUMBER: 8WI2189
Agency Name: The Transportation Security Administration
1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The General Services Administration currently leases 10,554 ABOA/11,820 rentable square feet (RSF) of office space at 9809 S Franklin Drive, Franklin, WI 53132-8885 under lease number GS-05-LWI17818 for the Transportation Security Administration (TSA). The current lease expires 7/24/2021. Approval is requested to negotiate a succeeding lease with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The right to pursue a succeeding lease is detailed in GSAR 570.402: Succeeding Leases.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
(INCLUDING ESTIMATED VALUE).
TSA submitted a continuing need letter on 11/24/2019 for 11,820 rentable square feet of office and related space. To satisfy the TSA’s mission requirements, the facility must be within 15 minutes from the Milwaukee airport.
This requirement is for 10,554 ABOA/11,820 RSF of space for a 15 year term to commence on 7.25/2021. The estimated cost of this lease is $XXXX per rentable square feet per year for an annual cost of $XXXXXXX and a total contract value of $XXXXXXXX. The delineated area is
• North Boundary: W. Howard Avenue
• East Boundary: WI-32
• South Boundary: WI-100
• West Boundary: S 51 Streets
3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. In accordance with FAR 6.302-1 and GSAR 570.402, it is determined that award to any other offeror would result in substantial duplication of costs to the Government that are not expected to be recovered through competition.
4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.
DocuSign Envelope ID: 69A80620-F8D3-4229-9CF0-DD1796F77A5A
It is in the best interest of the Government to remain at the current location. Pursuit of the TSA’s mission requires they be located near the airport. Expanding the delineated area would conflict with their mission.
No one responded to the ad.
5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS IS PRACTICABLE.
Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on FedBizOpps (FBO) on 4/6/2020 for 14 days. In addition, JLL conducted market research using CoStar and outreach over the phone.
6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO
THE GOVERNMENT WILL BE FAIR AND REASONABLE.
Recent market surveys conducted by JLL in Franklin, WI showed the rental rate within the delineated area ranges from $XXX-$XX per RSF. Market data was gathered from both REIS and CoStar to determine this range.
Therefore, the proposed rental rates for this succeeding lease of $XXXXX/RSF, are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.
7. DESCRIPTION OF MARKET RESEARCH CONDUCTED AND THE RESULTS.
GSAR 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis shows that the Government cannot expect to recover relocation and duplication costs through competition.
In 8/20/2019, PBS conducted market research using Reis and CoStar and identified 8 potentially acceptable locations 9 plus the incumbent) that might meet the agency’s needs within the delineated area. In addition, PBS placed an advertisement conforming to GSAR 570.402-2 on the Federal Business Opportunities Web site (fedbizopps.gov) on 4/6/2020. The incumbent Lessor was the only response to the ad.
8. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
Property management was contacted 8/14/2019 at which time they had no concerns about this lessor.
The latest inspection report dated 4/3/2019 showed no deficiencies.
9. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE
ACQUISITION.
No Buildings responded to the advertisement.
10. STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME
ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION.
In advance of an existing lease contract’s expiration, considerations will be given to allow for sufficient time to conduct a full and open procurement. The Government will consider the time and cost of moving from the existing location, and the time and cost to build out new space when deciding whether it is economically advantageous to stay at the existing building or to undergo a competitive action.
Additionally, consideration will be given to the customer agency’s mission and security requirements (if applicable) to include limiting any agency space requirements that may be deemed unduly restrictive and thus favor the incumbent. The Government will remain conscious of the effort to continuously encourage competition when practicable.
