COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:
(X) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business
5. Demonstration that the Cont s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): VAAR 819.7007 and VAAR 819.7008 authority allows sole source awards to a SDVOSB/VOSB based on 38 U.S.C.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies:
This contract will be for a limited time of only 1 year. If it is determined these services are still needed, then a long-term contract will be solicited as an SDV set aside. A sources sought was not posted because a qualified SDVOSB is already known.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The vendor has published rates for security guard services at GSA eLibrary, which provides information to assist in the determination of fair and reasonable pricing for these services.
Additional discount will be requested before placing an order.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted:
A contract for similar services was established recently (Nov 2019) for VA Palo Alto Healthcare System after setting the requirement aside competitively for SDVOSBs. The competitive stage of the procurement took 3 months from the time the solicitation was issued to time of award to allow a sufficient time to promote competition, conduct technical evaluations, and do a comparative analysis among the vendors. There is a real possibility that a competitive process would take several months longer in the case of a protest. Consequently, it is in the best interest of the Government to meet the immediate need by utilizing the statutory authority to negotiate on a sole source basis to a SDVSOB that recently demonstrated through a highly competitive process that it is fully capable of meeting the at a fair and reasonable price.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
Surveillance Security, Inc.
175 S Hamilton Pl Gilbert, AZ 85233 DUNS: 967461153 (VetBiz verified)
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
The VA has statutory authority to make a sole source award to a SDVOSB. This is not a barrier to competition, but rather a procedure authorized by Congress through statute. Any long term need for this service will be competed.
If subsequent requirements are needed, the Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed.
