About this file

This is a Justification for Other than Full and Open Competition (JOFOC) memo documenting a lease extension under the Simplified Lease Acquisition Threshold.

The Small Business Administration is extending its existing lease for office space in Seattle, Washington (Lease Number GS-10P-LWA07480, Project Number 6WA0545). The leased space comprises 12,867 rentable square feet, with a proposed extension term of 60 months. The contracting officer, Joel Wilson, is justifying direct negotiation with the current lessor rather than conducting full and open competition, citing the authority under GSAM 570.405(c) and FAR 6.302-1. The justification basis is that the agency is expecting to reduce its space requirements and is finalizing specifications for a new full and open procurement, making this extension necessary to bridge the transition period. The contracting officer certifies that the award is in the Government's best interest, that the anticipated cost is fair and reasonable, and that no potential acceptable alternative locations were identified through advertisement or market survey. The memo was last revised on January 11, 2021.

Project Number: 6WA0545

Agency Name: Small Business Administration

City, State: Seattle, Washington

Lease Action Type: Extension

Rentable SF: 12,867

This Memorandum documents that the contracting officer did not identify any potential acceptable locations through advertisement or market survey and serves as the written justification to negotiate directly with the present lessor in accordance with GSAM 570.402-4, No Potential Acceptable Locations, and FAR 6.3, Other Than Full and Open Competition.

In accordance with GSAM 570.405(c), Lease Extensions, FAR 6.302-1 permits contracting without providing for full and open competition when the property or services needed by the agency are available from only one responsible source and no other type of property or services will satisfy the needs of the agency. This authority applies to lease extensions in situations such as, but not limited to, the following:

The agency encounters unexpected delays outside of its control in acquiring replacement space

MISSION BASIS AND/OR RELEVANT FACTS FOR STAYING IN PLACE

Agency is expecting to reduce space and is finalizing their requirements for a new full and open procurement. This extension will provide time for that to happen.

CONTRACTING OFFICER CERTIFICATION
