About this file
This document is a Justification for Other Than Full and Open Competition for a Succeeding Lease issued by the General Services Administration (GSA) Region 10 Leasing Division.
The document justifies the renewal of a lease for 71 reserved parking spaces at 999 3rd Avenue, Seattle, WA under lease number GS-10B-07456 for the Executive Office for Immigration Review (EOIR), Internal Revenue Service (IRS), and U.S. Senate. The current lease expires on 9/21/2024, and approval is requested to negotiate a 10-year renewal with the incumbent lessor without full and open competition. The statutory authority cited is 41 U.S.C. 3304(a)(1), as no acceptable alternatives were identified that could satisfy the agencies' parking requirements. The annual cost of the lease is $517,164, with a total contract value of $5,171,640. The GSA Lease Contracting Officer determined the proposed rental rates of $607 per month per parking stall to be fair and reasonable based on market research.

Justification for Other Than Full and Open Competition, Succeeding Lease
U.S. General Services Administration
GSA Region 10
Leasing Division
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
PROJECT NUMBER: 1WA2229
Agency Name: Executive Office for Immigration Review (EOIR)
Internal Revenue Service (IRS) Senate (Senators Cantwell and Murray)
1. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.
The General Services Administration currently leases 71 reserved, structured parking spaces at 999 3rd Avenue, Seattle, WA under lease number GS-10B-07456 for the EOIR, , IRS, and Senate. The current lease expires 9/21/2024. Approval is requested to negotiate an added renewal with the incumbent Lessor without full and open competition for continued occupancy at this leased location. The procedures for pursuing an added renewal are detailed in GSAR 570.401: Renewal.
2. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
(INCLUDING ESTIMATED VALUE).
A Continuing Need Letter and/or a signed Client Planning Agreement (CPA) was received from each agency, expressing a continuing need for reserved parking for Government owned vehicles. All of the agencies require parking spaces within adequate walking distance, or adjacent to, their direct office space.
No vacant federally-controlled space is available that satisfies the parking requirement for all agencies listed under this lease.
This requirement is for a 10-year term to commence on 9/22/2024. The cost of this lease annually is $517,164.00 with a total contract value of $5,171,640.00.

3. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN
COMPETITION.
41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. This statutory authority is implemented through GSAR 570.401.
4. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED.
It is in the best interest of the Government to remain at the current location; in accordance with GSAR 570.402-4, because no acceptable alternatives were identified that could satisfy this parking requirement, a cost-benefit analysis is not required for this justification.
5. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS
MANY POTENTIAL SOURCES AS IS PRACTICABLE.
Per the requirements of GSAR 570.402, the GSA Lease Contracting Officer placed an advertisement on the Contracting Opportunities domain of SAM.gov on 12/21/2023 for 14 days.
6. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE
GOVERNMENT WILL BE FAIR AND REASONABLE.
GSA conducted independent market research and was unable to locate an acceptable alternative to the current location with a fixed rate per space, for a 10-year term. Maintaining a long-term, 10-year lease with firm pricing at this location versus negotiating multiple, shorter-term leases, saves duplication of efforts among the agencies. Therefore, the proposed rental rates for this succeeding lease of $607/month/parking stall, are within the current market range for this submarket and are deemed fair and reasonable by the GSA Lease Contracting Officer.
7. OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION.
