About this file
This justification document is for a sole source renewal of an OpenEye Scientific software maintenance contract with the National Institutes of Health National Library of Medicine National Center of Biotechnology Information. The contract renewal is for a base year plus two option years from July 2023 through July 2026 with an estimated total value of $237,073.66. OpenEye Scientific software tools have been used by PubChem developers since 2004 to add small molecule structures and bioactivity assay results to NCBI's PubMed search system and perform chemical normalization, descriptor computation, and IUPAC naming. As the sole proprietor of the software, OpenEye Scientific is the only source that can provide the required technical support. The contracting officer will determine price reasonableness by evaluating the vendor's price against the government's independent cost estimate and past purchase information.

Justification for Other than Full and Open Competition:
at or Below the Simplified Acquisition Threshold Project Title: OpenEye software Renewal
I. Identification of the agency and contracting activity: National Institutes of Health, National Library of Medicine, National Center of Biotechnology Information Requestors name: Chandra Porchia Requestors phone number: 301-435-5963 Requestors email address: porchia@ncbi.nlm.nih.gov Address of the requesting lab/office: 8600 Rockville Pike, Bldg. 38A/Rm. 3N311Q , Bethesda, MD 20892
II. Description of the project, and supplies or services required to meet the agency’s needs (including the estimated value) A. Type of action:
☐ New requirement ☒ Follow-on Name of the previous contractor(s): OpenEye Scientific Sequence number(s), if available: 467-MZ-401682 initial purchase; 75N97021P00031 last option plus two base year renewal for years 7 July 2020 – 6 July 2023 renewal Was the initial and any subsequent awards competed? ☒Yes ☐ No B. POTS Sequence number for this requirement:
C. Total estimated dollar value of the requirement (including options, if applicable): $237,073.66 D. Period of performance, inclusive of options: 7 July 2023 – 6 July2026 E. Project Background: This order provides a base plus two option year maintenance support for OpenEye software previously purchased by NCBI to support the PubChem project. This order will provide software updates, bug fixes and technical support for three one-year periods. PubChem developers have used OpenEye software tools since 2004. The software makes it possible for PubChem developers to add small molecule structures and bioactivity assay results to NCBI's PubMed search system. PubChem is an archive of small molecules and their biological activities. Incoming chemical structure content is subjected to a custom designed normalization procedure written in C++ that ensures uniform chemical structure representation. In addition, chemical descriptors and properties are computed including IUPAC names.
F. Description of the supplies/services to be purchased: Maintenance renewal contract for Lexichem TK, OEChem TK and QUACPAC OpenEye Scientific software.
iii. Identification of the statutory authority permitting other than full and open competition (SELECT ONE) ☒ 41 USC 1901(e)(2) and FAR Part 13.106-1: Only one responsible source/Brand Name ☐ F AR P a r t 8 . 40 5 - 6 : Federal Supply Schedule (FSS), limited competition/Brand Name ☐ 41 USC 3304(a)(5) a n d F A R P a r t 6. 302 - 2: Authorized or required by statute/Brand Name
iv. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
A. Name and address of the proposed contractor(s) OpenEye Scientific 9 Bisbee Ct, Suite D Santa Fe, New Mexico 87508 B. Describe why only the requested brand or brand name feature of the supply/service will meet the government’s needs.
PubChem is an archive of small molecules and their biological activities. Incoming chemical structure content is subjected to a custom designed normalization procedure written in C++ that ensures uniform chemical structure representation. In addition, chemical descriptors and properties are computed including IUPAC names. OpenEye Scientific is the sole proprietor of OpenEye software and is the only company that provides technical support for the software. The PubChem developers have used OpenEye Scientific software tools since 2004 to develop molecular designs in pharmaceuticals and biotechnology applications.
v. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable. In the absence of competition, the vendors price will be evaluated against the governments IGCE and previous purchase information to determine fairness and reasonability.
vi. Certification This is to certify that the justification for the proposed acquisition has been reviewed and that to the best of my knowledge and belief the information and/or data provided to support my request (for the requestor) and approval (for the CO) of is accurate and complete.
