JUSTIFICATION & APPROVALS FOR FAR SUBPART 16.5 ACQUISITIONS

EXCEPTION TO FAIR OPPORTUNITY

Purchase Request Number:

Contract Number:

Task/Delivery Order Number: TBD Procurement Title: JIPM Engineering and Acquisition Support Contracting Office: DITCO/NCR Estimated Value:

Authority: FAR 16.505(b)(2)(i)(C)

JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

Upon the basis of the following justification, I, as the Contracting Officer, hereby approve this exception to fair opportunity pursuant to the authority of FAR 16.505(b)(2)(i)(C).

1. REQUIRING AGENCY AND CONTRACTING OFFICE:

Requiring Agency:

Defense Information Systems Agency

Contracting Activity:

Defense Information Technology Contracting Organization (DITCO) National Capital Region (NCR)

2. NATURE/DESCRIPTION OF ACTION(S):

This is a logical follow-on to ENCORE II task order HC1028-08-D-2015 VC08 with Booz Allen Hamilton which ends on 31 July 2013. All ENCORE II awardees were given a fair opportunity to be considered for the original order. The proposed contract action is a Firm-Fixed Price task order to be awarded to Booz Allen Hamilton under their ENCORE II contract HC1028-08-D-2015 utilizing FY13 Procurement funds.

3. DESCRIPTION OF SUPPLIES/SERVICES:

DISA's Joint Internet Protocol Modem Program Management Office (JIPM PMO) is responsible for developing and executing a more comprehensive, capabilities-based, strategic approach for planning, provisioning, acquiring, and deploying the JIPM. Because of the complex and often unknown nature of the Department of Defense Information Network (DoDIN), in-depth knowledge of the Department of Defense (DoD) Teleport Program, Joint Internet Protocol Modem and how the JIPM integrates into these efforts is required. This contract action will provide DoD, DISA, and the federal government with acquisition, program integrated solutions management, security engineering certification and accreditation, business process reengineering, asset management, product integration, test and evaluation, as well as enterprise IT policy and planning support necessary to complete the JIPM PMO’s final acquisition milestone: Fielding Decision Review (FDR). These activities include: Performance of an operational test in support of the Joint Interoperability Test Command (JITC) operational assessment of the JIPM; performance of engineering efforts to integrate the JIPM hubs into Gateways and field remote terminals; achievement of a 3-year Authority To Operate (ATO); and completion of acquisition milestone documentation. The period of performance is from 1 August 2013 through 31 December 2013.

4. SUPPORTING RATIONALE, INCLUDING A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE OF AN EXCEPTION TO FAIR OPPORTUNITY:

(a) Exception to Fair Opportunity. The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.

(b) Description of the Justification.

In order to achieve worldwide operations; the JIPM PMO must complete the JIPM sustainment actions and satisfy Milestone (MS) C liens to achieve a Full Deployment Decision with a threshold of April 2014. These required activities include: Performance of an operational test in support of JITC operational assessment of the JIPM; performance of engineering efforts to integrate the JIPM hubs into Gateways and field remote terminals; achievement of a 3-year Authority To Operate (ATO); and completion of acquisition milestone documentation. During the Milestone C Acquisition Review Board (ARB), the Component Acquisition Executive at the request of the Test and Evaluation Office imposed additional Operational Assessment testing to be accomplished prior to the April 2014 deadline and to be conducted parallel to a Teleport test event in December 2013.

Given the short requirements period, BAH is uniquely situated as the only company that can provide these services without incurring unacceptable delays to the achievement of the JIPM PMO’s FDR threshold of April, 2014 which would occur during the transition to a new contractor. Utilizing this approach is a logical means to capitalize on efficiencies in terms of cost, schedule, and similarity of scope.

Booz Allen Hamilton (BAH) has provided these services to the JIPM PMO for over 4.5 years under the current task order. BAH possesses and have demonstrated the experience and expertise needed for the JIPM PMO to achieve the near-term goals. They are currently delivering technical and programmatic services necessary to achieve a Full Deployment Decision prior to the April 2014 threshold for achieving an FDR, a 3 year ATO prior to November 2013 (end of current ATO), and a Post-Implementation Review decision prior to October 2014 (Threshold). The required activities to meet JIPM’s FDR milestone are already within the scope of services which BAH is currently providing to the JIPM PMO. The period of performance for this logical-follow-on is for a five-month period at which point all activities in support of the FDR acquisition milestone will be completed and the requirement for JIPM Variant 1 support will cease to exist.

(c) Justification:

(1) Minimum Government requirements. Completion of activities required for Milestone C approval.

(2) Proposed sole source contractor. This contract action must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on for services currently under contract with Booz Allen Hamilton (BAH). At the time of award of the original order, fair opportunity was given to all contract holders under ENCORE II. BAH possesses the experience and expertise needed for the JIPM PMO’s requirement. BAH’s current experience with the program makes their support vital in meeting the Milestone C Approval threshold of April 2014. Not awarding this follow-on to BAH would result in a duplication of cost estimated to be at least an additional $ due to the time required to transition the new contractor to an acceptable level of technical expertise. This additional cost would be coupled with an unacceptable delay of up to 90 days which would result in the inability of the JIPM PMO to meet their Fielding Decision Review threshold date.

(3) Discussion regarding cause of the sole source situation. Additional, unforeseen testing requirements were imposed during the Milestone C ARB. In order to meet the short deadlines, the contractor must possess the ability to satisfy Systems Engineering and these Test & Evaluation liens prior to 31 December 2013 and ensure that all FDR milestone documentation is complete in order to meet the JIPM FDR threshold of April, 2014. At the present time, only Booz Allen Hamilton is capable of providing the supplies or services required in the time frame required and at the level of quality required because the supplies or services ordered are unique or highly specialized.

(4) Demonstration of unique source. This contract is a logical follow-on intended to maximize efficiencies and realize monetary cost savings for the JIPM PMO and other dependent programs. The contractor must possess the ability to satisfy Systems Engineering and Test & Evaluation liens prior to 31 December 2013 and ensure that all FDR milestone documentation is complete in order to meet the JIPM FDR threshold of April 2014. At the present time, only BAH is capable of providing the supplies or services needed in the time frame and at the level of quality required. At the conclusion of the Period of Performance, all activities in support of the FDR acquisition milestone will be complete and this requirement for JIPM V-1 support will cease. Given the short requirements period, BAH is uniquely situated as the only company that can provide these services without incurring unacceptable delays which would negatively impact mission achievement.

(5) Procurement discussion. The current constraints placed on this procurement are schedule risks. As stated above, the JIPM PMO has been tasked with meeting certain activities prior to the approval of Milestone C. BAH has been supporting to the JIPM PMO in laying the foundation for this approval by providing acquisition, program integrated solutions management, security engineering certification and accreditation, business process reengineering, asset management, product integration, test and evaluation, as well as enterprise IT policy and planning support. Continued support will ensure the JIPM PMO can meet the April 2014 threshold despite the unexpected requirement of an additional assessment testing in December 2013.

(6) Impact. Competing this requirement would have unacceptable detrimental effects on the JIPM program. The loss of efficiencies, institutional program knowledge, combined with an estimated 60-90 days of transition time needed for a new contractor would put critical deadlines at immediate risk: achievement of the 3-year ATO, Post-Implementation decision, as well as the required testing in December. Delays would result in a schedule slip where the JIPM PMO is no longer able to meet the April 2014 threshold for the FDR which would lead to a serious disruption in the JIPM transition to operations efforts and could cause delays that would have a negative impact on JIPM’s customers, particularly the warfighter who is anticipating this capability to provide their Global Broadcast Service feeds.

5. COST/PRICE FAIR AND REASONABLE DETERMINATION:

The Contracting Officer will make a final determination regarding price fair and reasonableness by utilizing techniques listed in FAR 15.404 “Proposal Analysis.”

6. MARKET RESEARCH:

The JIPM PMO conducted various forms of market research in order to determine an acquisition strategy for the award of the original task order. BAH was awarded the original task order based on fair opportunity given to all contract holders under ENCORE II. Given the fact that these requirements are essentially the same as currently being performed, the short period of performance and the aggressive schedule to meet all deadlines, it was determined that no other contractor could be placed under contract without negative impacts on the mission requirements.

7. ANY OTHER SUPPORTING FACTS:

None

8. ACTIONS THE AGENCY MAY TAKE TO REMOVE OR OVERCOME BARRIERS THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY:

At the conclusion of the Period of Performance, all activities in support of the FDR acquisition milestone will be complete and this requirement for JIPM V-1 support will cease.

9. REFERENCE TO THE APPROVED ACQUISITION PLAN (AP):

This effort does not meet the threshold requirement for an approved Acquisition Plan.
