About this file
This is a Brand-Name Justification (J&A-26-0393) for a delivery order under an Indefinite Delivery Indefinite Quantity (IDIQ) contract. The U.S. Department of Homeland Security's Immigration and Customs Enforcement (ICE) Office of Acquisition Management proposes to award a delivery order on behalf of the Office of the Chief Information Officer for video conferencing software and licenses. The order will be placed under the NASA Solutions for Enterprise-Wide Procurement (SEWP) V Government Wide Acquisition Contract (GWAC), specifically within Group B (Total Small Business) category as a Firm-Fixed Price contract. The 12-month base period runs from September 24, 2026, through September 23, 2027, with funding from FY 2026 Base Operations.
ICE requires a specific brand-name product and Expressway software licenses to support unified hybrid licensing, free remote endpoint registration, device licensing, hybrid calendar/directory functionality, PSTN deployment options, real-time collaboration with video calling and file sharing, and platform connectivity for remote users and Executive Office for Immigration Review (EOIR) court appearances. Market research conducted May–June 2026 evaluated competing products including O365/Microsoft Teams and Pexip Software but determined they are incompatible with ICE's existing Expressway network infrastructure and cannot provide a FedRamp-secured VTC SaaS platform compatible with multiple external stakeholders. The justification emphasizes that the required brand-name product offers unified hybrid licensing (covering both on-premises and cloud deployments), built-in Mobile and Remote Access via Expressway without VPN requirements, and flexible device licensing tailored to modern work environments—capabilities competitors lack. The contracting officer determined the anticipated price will be fair and reasonable based on adequate price competition, with multiple NASA SEWP contract holders providing this software and an expectation of receiving at least three quotes from authorized resellers.

XXXXXXX has integrated secure multi-platformed video conferencing hardware and software applications to extend organizations ability to communicate from both centralized and remote end-user locations more effectively. XXXXXXXXX are the current infrastructure for existing Video Teleconferencing (VTC) and Session Initiation Protocol (SIP).
XXXXXXXXXXXXXX provide productivity improvement tools for use in offices, on mobile devices and remote when the mission requires it. The XXXXXX software tools are used extensively throughout DHS and ICE with great benefits to ICE across Homeland Security Investigations (HSI) and Enforcement and Removal Operations (ERO) for both internal and external video teleconferencing meetings and training activities.

The period of performance will consist of:
12-month Base period of September 24, 2026, through September 23, 2027.
(a) Include a table similar to the following for all actions:
Period Time Price Total Base 12 mos. $XXXXXXX $XXXXXX
Total Value $XXXXXX
4. Statutory Exception and Rationale.
Exception:
The specific exception for providing for brand-name awards under multiple award contracts is RFO FAR Subpart 16.507-7(a). An item peculiar to one manufacturer can be a particular brand-name, product, or a feature of a product peculiar to one manufacturer.
A brand-name item, even if available on more than one contract, is an item peculiar to one manufacturer. Brand-name specifications must not be used unless the particular brand-name, product, or feature is essential to the Government's requirements and market research indicates other companies' similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency's needs.
Rationale:
OCIO/OPS/ISB/VOS requires a brand name justification for the XXXXXXXXXXXXX software licenses because they are the only product that meets all the current Infrastructure requirements needed to communicate between the Immigration Judges and the ICE Detention Centers. Market research was conducted May – June 2026. During that time, we reviewed Market Research reports from similar previous requirements, and other competitors. The competitors researched were O365/Microsoft Teams and Pexip Software, and it was determined that the brand name XXXXXXXXXXXXX is the only one that can meet all of ICE’s requirements. OCIO conducted market research on the following products: O365/MS Teams and Pexip Software. The results of the market research indicate that these products are similar but are not compatible with what the ICE Detention Centers are currently using to communicate with the EOIR and Department of Justice (DOJ) Immigration Judges. Based on that, the other competitors do not meet our requirements. Specifically, none of the other products were able to interconnect and function with current ICE Expressways network architecture, maintenance platforms and configuration, and provide Host licenses for a FedRamp secured VTC SaaS platform that is compatible with multiple external stakeholders.

Unified Hybrid Licensing provides a single licensing agreement (flex plan) which covers on-premises and cloud deployments while the competitors are mostly cloud-only. XXXX licensing includes Built-in MRA (Mobile and Remote Access) via expressway while the competitors need to rely on a VPN or require costly alternatives. xxxxxx licensing provides flexible workspace device licensing vs competitors only provide per-user or separate room licenses. This is important because Unified Hybrid Licensing from XXXXX offers a more flexible, cost-effective, and comprehensive approach compared to competitors. Single License for Both On-Prem and Cloud. Organizations transitioning from on premises to the cloud or running hybrid environments don’t need to purchase separate licenses for each setup. This reduces complexity and cost; streamline operations and procurement. Built-in MRA (Mobile and Remote Access) via Expressway.
Provides secure remote access without the need for traditional VPNs or expensive third-party tools. Enhances user experience and lowers operational overhead, while ensuring secure connectivity for hybrid and remote workers. Provides Flexible Device Licensing. XXXXXX offers licensing tailored to how workspaces are used (shared spaces, hotdesking, meeting rooms), not just individual users. Adapts better to modern work environments, avoids unnecessary user-based charges for shared devices, and provides cost savings. Competitors are often cloud-only, requiring multiple licenses if hybrid models are used. They may lack built-in secure access options, forcing reliance on VPNs or extra software. Many enforce strict per-user or separate room licenses, limiting flexibility and increasing costs. Unified Hybrid Licensing gives xxxxxxx a strategic advantage, supporting a broader range of deployment scenarios with more agility, lower total cost of ownership, and simplified management. This is especially important for large or evolving organizations navigating hybrid work models.
Procuring an alternate product other than XXXXXXXX software will require complete infrastructure replacement with a significant increase in cost and it would not meet all the operational needs.
5. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
The contracting officer determines that the anticipated price(s) will be fair and reasonable based on adequate price competition. Multiple NASA SEWP contract holders provide this brand name software, so the government has a reasonable expectation that at least three (3) quotes from authorized resellers will be received.
6. Any other facts supporting the justification.
This would involve purchasing and configuring the new equipment, implementation, and changing control appliances. It is not likely the ICE Expressway IT infrastructure will change before this contract ends. In addition, it is not likely that another service provider will have a compatible FedRamp SaaS VTC platform approved and available for purchase during the period of performance. However, OCIO Solutions Delivery Division (SDD) and IT Operations (OPS) will continue to monitor available VTC software license offerings.

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for supplies or services is made.
As ICE continues to be proactive in integration and modernization of its information systems, and as improvements are made to technology, ICE will continuously update its market research to determine if other competitors will offer the features needed to fulfill the requirement.
8. OAQ intends to:
Post the justification and supporting documentation on the agency website used to solicit offers for orders under the contract in accordance with RFO FAR 16.507-7 (c )(l)(i);
X Provide the justification and supporting documentation along with the solicitation to all (IDIQ) contract awardees under the [name the IDIQ functional category or tract being used] in accordance with RFO FAR 16.507-7(c)(l)(ii).
