Justification for Sole Source Acquisitions
Under 41 U.S.C. 1901(e)(2)
Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency
Requirements
Pursuant to the requirements of the Competition in Contracting Act (CICA) as implemented by
FAR 6.3 and in accordance with the requirements of FAR 6.303-1, this justification for the use of the statutory authority under FAR 6.3 is justified by the following facts and rationale required under FAR 6.302-1(b)(1)((ii) as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS) and the United States Coast Guard (USCG), propose to enter into a contract on a basis of other than full and open competition.
(2) Nature and/or description of the action being approved.
USCG has a requirement on a sole source basis to provide tailoring services for USCG recruits at
Training Center Cape May, Cape May, NJ (TCCM) at an estimated cost of $568,756.00. The period of performance for this requirement is one (1) year.
The sole-source contractor is:
The Front Line Group
5 Shaw’s Cove
Suite 220
New London, CT 06320
(3) Description of Supplies/Services.
This is a non-personnel services contract to provide furnished fitting, alteration/tailoring and garment pressing services (henceforth called tailoring services) for Accession Personnel
(trainees/recruits) at the USCG Training Center, Cape May, NJ (TCCM).
Performance Period
Item Period Unit Price Total
Tailoring Services 12 months $568,756.00 $568,756.00
Twelve Month Period of Performance Total: $568,756.00
(4) Identification of the justification and the rationale.
The statutory authority permitting other than full and open competitions, 41 U.S.C. 1901(e)(2), specifically Federal Acquisition Regulation (FAR) Subpart 13.501(a), “Sole Source (Including
Brand Name) Acquisitions”.
(5) Demonstration that the nature of the acquisition requires use of the authority cited.
In a letter dated 09 February 2018, Court House Cleaners, located in Cape May Courthouse, NJ, provided notice to the Contracting Officer that on 20 April 2018 they will be closing their facilities and therefore discontinuing services under contract HSCG23-16-C-PUD611. Based on this notification, the option period for this contract, which expires on 24 April 2018, will not be exercised.
The flow of recruits through TCCM will not stop, in fact, a Direct Entry Petty Officer Training
(DEPOT) company will arrive in Cape May, NJ on 23 April 2018. These new recruits will immediately require properly fitting uniforms. To ensure this vital mission is accomplished, and remove the possibility of a Coast Guard-wide impact, a contractor with current knowledge of military uniform tailoring, who is nimble enough to start work at the earliest possible date and is capable of handling the volume of work, is needed.
The Front Line Group is the only apparel cut and sew tailoring contractor that meets these requirements within the necessary timeframe. They are the only contractor with the knowledge, skills, staff and equipment to perform this critical and mandatory mission in the requisite timeframe.
As the time required to ensure continuity of services is critical, five (5) companies, including the current contractor, were contacted by phone as market research and to gauge capabilities, all stated they could not currently perform in the timeframe and volume needed. These companies are listed below:
Courthouse Cleaners, 1027 S Route 9, Cape May Court House, NJ 08210, (609) 463-
8020, POC: Jennifer Armstrong (current contractor)
Youngs (Sharp) Cleaners, Bayshore Mall 3845 Bayshore Rd, North Cape May, NJ
08204, (609) 898-9894, POC: Janice
Kim’s Cleaners, 602 E Landis Ave # A, Vineland, NJ 08360, (856) 696-3391, POC:
name refused
Jimmy’s Tailor Shop, 22 E Vine St, Millville, NJ 08332, (856) 825-7790, POC: Bill
Bendix Cleaners, 632 West Ave, Ocean City, NJ 08226, (609) 391-7666, POC: Jim
(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable.
The USCG posted this requirement to the Acquisition Planning Forecast System (APFS) record
(# P2018041130) to notify all potential offerors.
There were no responses received from any vendors in regard to the APFS posting.

(7) Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will determine that the anticipated price(s) will be fair and reasonable based on a sampling of similar prices from like vendors. The Independent Government Cost
Estimate (IGCE) for this one (1) year period of performance is $568,756 and will form the basis for pricing submitted by The Front Line Group. These services are not available on the General
Services Administration (GSA) Schedule.
(8) Description of market research.
As noted previously in Section (6), the USCG posted an APFS record regarding this requirement.
No responses were received from vendors in regard to the posting. The Coast Guard also verbally queried several vendors in the Cape May, NJ area as to their capability and willingness to perform these services. All companies contacted responded that they were either unable or unwilling to provide these mission critical services.
(9) Any other facts supporting the use of other than full and open competition.
None.
(10) A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.
None.
(11) A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for required supplies or services.
Per FAR 13.501(a)(1)(iii), this justification will be published on FBO within fourteen (14) days of contract award.
A long term contract will be established utilizing competitive procedures in order to provide continuous services for the Training Center in Cape May, NJ.
