5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY

Lister Chain & Forge is the only company in the United States that can forge and produce the size of chain required to meet military specifications and provide Objective Quality Evidence to ensure the product meets military specifications and is compatible with the Spreadmoor anchoring system. Lister Chain and Forge is the last standing US Domestic ABS (US Naval Specifications) qualified anchor chain manufacturer that could provide the required fleet mooring chain at the FM3 grade specification. Lister strictly conforms to DFARs 225.7007 and the Buy American Act. All manufacturing and material for Lister stud link anchor chain and components are 100% US domestic source. Although it appears that there are other ABS qualified companies, they are not domestic thus not eligible for award pursuant DFARS 252.225-7019.The items to be procured are long lead time material with an expected manufacturing time of eight months. The material to be procured is needed to meet repair timelines and the availability start date of April 22, 2022. If the material is not received by the required delivery date it will affect the Navy’s mission to repair small boats that are required for security of our harbors. In order to meet the April 2022 availability, the materials must be ordered NLT 3 Sept 2021 to satisfy the eight month lead time. The need for these material has an impact on the environment, oil containment on crafts, dive boats, and all small craft assets in the Hampton Roads area. The Spreadmoor System is an essential part of the Dynamic and without it the Service Craft Dynamic is essentially useless. Without the Spreadmoor System, the Dynamic will not be able to perform its mission as a service craft and dry dock. Also, it will present a safety risk to the dock. The dock has a high freeboard area and high winds (i.e. tropical storms and hurricanes) will have a drastic impact on the dock. Without the Spreadmoor System, there is no means to moor the Dynamic safely.

Based on current market research and acquisition strategies; coupled with extenuating security conditions surrounding this requirement, it has been determined that no other source is able to meet the requirements of the Government. Award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable delays in fulfilling the Navy’s mission.

6. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY

OFFERORS AS PRACTICABLE

An exception is made under FAR 5.202(a)(2). This procurement is made under the conditions described in FAR 6.302-2, Unusual and Compelling Urgency.

7. DETERMINATION OF FAIR AND REASONABLE COSTS

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The estimated cost of this work item is based upon the Independent Government Estimate and the Project Manager’s technical knowledge. The information provided should be sufficient to support the fair and reasonable price determination of this procurement.

8. ACTIONS TO REMOVE BARRIERS TO FUTURE COMPETITION

For the reasons set forth in paragraph five and the urgent nature of this requirement, MARMC has no plans to take any actions to remove barriers to future competition.
