DEFENSE LOGISTICS AGENCY J&A: SPRDL1-16-R-0327
DEFENSE LOGISTICS AGENCY
JUSTIFICATION FOR OTHER THAN
FULL AND OPEN COMPETITION
The Defense Logistics Agency (DLA Land-Warren) is the procuring activity for this action. The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c) (1), as implemented by FAR 6.302-1, "Only One Responsible Source and no other supplies or services will satisfy requirements."

o) ACQUISITION METHOD CODE: 3-- Acquire, for the second or subsequent time, directly from the actual manufacturer.
p) ACQUISITION METHOD SUFFIX CODE: H--The Government physically does not have in its possession sufficient, accurate, or legible data to purchase this part from other than the current source(s). This code is applicable only to parts under immediate buy requirements and only for as long thereafter as the deficiency is under review for resolution and appropriate recoding. This code is only assigned at the conclusion of limited screening, and it remains assigned until the full screening process resolves physical data questions and results in assignment of a different AMSC. If one source is available, AMCs 3, 4, or 5 are valid. If at least two sources exist, AMCs 1 or 2 are valid.
PART II - Technical Information and Certification:
1. The US Army TACOM LCMC requires the acquisition of the above item. The only approved source for the above item is:
Contractor: Curtiss-Wright Controls Integrated Sensing, Inc. – dba Predator Systems 1150 N. Fiesta Blvd, Ste. 200 Gilbert, AZ 85233-2283
CAGE Code: 0CFU1
2. Reasons the item is not suitable for full and open competition:
a. Status of the Acquisition Data:
The subject item is a high standard, high demanding integrated Hydraulic System Access Manifold (“Manifold”) used in the Hydraulic/Electric Upgrade (HEU) Program, to optimize the launch system of the Armored Vehicle Launched Bridge (AVLB). The listed CAGE is the Original Equipment Manufacturer (OEM). The Government does not own the Technical Data Package (TDP) for this Manifold. The subject manufacturer’s part number is an approved source to buy. The Government does not have drawings to reference for competitive procurement. The Government does not own patent rights to their data that would be required to produce a competitive TDP. Additionally, the Government did not fund them to prepare fully detailed TDPs after source approval. The drawing is source controlled to Predator Systems, Inc. The technical data required to manufacture this part belongs to Predator Systems, Inc.
The above identified approved sources have tested and obtained Government's approval of the Manifold. This Manifold has proven to demonstrate conformance to stringent reliability, durability and maintainability for U.S. Army User requirements. As such, Predator Systems, Inc.
is the sole owner of the drawings and technical data rights and the Government does not own proprietary rights to the TDP that would be required to produce a competitive TDP.
b. Efforts to Increase Competition or Qualify a New Source in Relation to this Procurement:
Reverse Engineering and qualifying another source does not appear to be feasible. The estimated cost based on required manpower and time to analyze, reverse engineer, detail and build with required tooling, instrumentation and materials for this item could be as much as $250K, as well as including the final TDP preparation, and result in an estimated delay of at least 12 months.
