About this file
This is a Brand Name, Limited Source Justification document for a Blanket Purchase Agreement (BPA) call issued by the Naval Surface Warfare Center, Carderock Division (NSWCCD) under J&A Number N00167-26-SIMACQ-CD-104-0034.
NSWCCD intends to award a BPA call against existing BPA No. N6601-21-A-0029, established by Naval Information Warfare Center (NIWC) Pacific on behalf of the Department of Defense Enterprise Software Initiative (ESI). The BPA was originally awarded on a limited source basis to Lyme Computer Systems Inc. and issued against GSA Federal Supply Schedule Contract GS-35F-465GA. The acquisition seeks to procure SolidWorks software licenses manufactured by Dassault Systemes Americas Corp. for fiscal year 2026, with a performance period from July 1, 2026 through June 30, 2027. The Government requires 368 total licenses distributed across three departments: 116 licenses for Department 60, 120 licenses for Department 70, and 132 licenses for Department 80. The Product Service Code is 7A21 (Business Application Software—perpetual license software).
The justification is based on statutory authority under 41 U.S.C. 152(3) (Multiple Award Schedule Program) and regulatory authority under FAR 8.401(b) and GSAR 538.7104-4(b), citing that SolidWorks is essential to NSWCCD's requirements for computer-aided design, computer-aided engineering, and Finite Element Analysis capabilities for naval engineering projects. NSWCCD notes that decades of proprietary SolidWorks files cannot be transferred to alternative software, that the workforce is proficient in SolidWorks, and that software uniformity is required for file interchange among cooperating agencies and commercial associates. Compliance with DFARS 208.7402 mandates fulfillment of commercial software requirements through the DoD ESI, under which the BPA with Lyme Computer Systems is the only available source for SolidWorks licenses. The Procuring Contracting Officer will determine fair and reasonable pricing using proposal analysis techniques under FAR 15.404-1 and will seek price reductions from DoD ESI pricing. The justification will be posted on SAM.gov.

4. Statutory Authority Permitting Other Than Full and Open
Competition
The statutory authority permitting other than full and open competition is the Multiple Award Schedule Program per 41 U.S.C. 152(3). The regulatory authority permitting limited sources is FAR 8.401(b) and GSAR 538.7104-4(b) Items peculiar to one manufacturer; “the particular brand name, product, or feature is essential to the ordering activity’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the need; and the file is documented accordingly.”
5. Rationale Justifying Use of Cited Statutory Authority
NSWCCD supports Department of Navy (DON) engineering and fabrication projects. In order to fulfill critical mission requirements, NSWCCD engineers require access to current CAD drawing and analysis tools.
These engineers also require access to the software simultaneously, and the only software in the commercial marketplace that allows this is SolidWorks software. These professional licenses and modelling design packages grant engineers the ability to perform required Finite Element Analysis (FEA) of DON designed parts and structures.
FEA modelling is required to perform detailed structural and thermal engineering analysis on designed critical parts, which would fail without proper in-depth analysis. Additionally, NSWCCD engineers utilize the 2D CAD software DraftSight for ship layout drawings and simple mechanical parts, allowing for less operational risk and improved productivity.
The specific brand of SolidWorks is required to maintain common design software among cooperating agencies and commercial associates, as well as maintaining the ability to build on and modify existing SolidWorks documents. The purpose of the uniformity is to provide a common software package so drawing files can be interchanged among the command's engineers that work projects on a day-to-day basis.
NSWCCD has historically utilized SolidWorks as its sole 3-D and 2-D CAD software, and primary engineering analysis tool. All of the CAD mechanical design performed and documented for NSWCCD has been accomplished with the SolidWorks proprietary file format. If NSWCCD were to switch to another process or try to identify a new CAD source in the commercial marketplace, decades of work and files will be lost, and non-transferable data will be considered obsolete and not usable. This would lead to an immeasurable amount of additional cost and is not an acceptable means of proceeding for NSWCCD. The command workforce for NSWCCD is proficient in the operation and functionality of the SolidWorks CAD package, and no additional labor hours would need to be spent in training and learning a new type of CAD software.
6. Description of Efforts Made to Solicit Offers from as Many
Offerors as Practicable
In accordance with FAR Part 10, the Government conducted market research and while there are other re-sellers to purchase the software from, the Government found that the requisite Solidworks software licenses are available through DoD ESI, under an existing BPA (i.e., BPA No. N6601-21-A-0029) awarded to Lyme Computer Systems, Inc. In accordance with DFARS 208.7402, “Departments and agencies must fulfill requirements for commercial software and commercial software services, such as software maintenance, in accordance with the DoD Enterprise Software Initiative (ESI).” A review of the DoD ESI website reveals that the aforementioned BPA is the only source on DoD ESI where SolidWorks software is available. Accordingly, as DoD ESI is a required source, the Government is purchasing the requisite Solidworks software licenses through the DoD ESI BPA established with Lyme Computer Systems, Inc.
Pursuant to FAR 8.401(b) and GSAR 538.7104-4(b)(2), the Government will make this Justification available on the Government point of entry (SAM.gov), the Government will ensure that the contract file will be documented as to any responses received from making the Justification available.
7. Determination of Fair and Reasonable Costs
In accordance with DFARS 208.470(d) and Class Deviation 2014-O0011, the Procuring Contracting Officer (PCO) will determine whether the order represents the best value using the proposal analysis techniques found at FAR 15.404-1, to establish a fair and reasonable price. In accordance with DFARS PGI 208.7403, DoD ESI pricing was reviewed by the PCO and determined to be the best value to the Government. Additionally, the ordering activity will seek a price reduction from the DoD ESI BPA pricing in accordance with FAR 8.401(b) and GSAR 538.7102-2(c)(2).
8. Actions to Remove Barriers to Competition
APPROVAL BLOCK (FAR 6.104-2(a) for a proposed contract between $900,000 - $20,000,000, the Advocate for Competition approval)
Upon the basis of the above justification, I hereby approve, as the solicitation of the proposed procurement(s) described herein using other than full and open competition, pursuant to the authority of 41 U.S.C. 152(3).
