Justification and Approval (J&A) for Other Than Full and Open Competition
Contracting Activity.
This Justification and Approval (J&A) requests authority for Other Than Full and Open Competition to support requirements generated for the Air Force Life Cycle Management Center, Agile Combat Support Program Executive Office (PEO), Electronic Warfare and Avionics Program Office, Global Positioning System (GPS) Joint Service Support Management Office (JSSMO), AFLCMC/WNYB. The Contracting Activity for this requirement is AFLCMC/WNKF. The Purchase Request number supporting this action is FD2060-20-31627.
Nature and/or description of the action being processed.
Due to the circumstances described herein, the activity requests authority to procure the items listed in Section III of this document using Other Than Full and Open Competition prescribed by FAR 6.302-1, “Only One Responsible Source and No Other Supplies and Services Will Satisfy Agency Requirements." This individual J&A authorizes the use of other than full and open competition procedures to add items to the existing sole source Indefinite Delivery Indefinite Quantity (IDIQ) contract, FA8540-18-D-0005, which was awarded 28 September 2018 with a performance period of five years at an estimated value of $81.8M. The instant requirement to be added is in the final three year period of performance at an estimated cost of . This estimate was derived from utilizing the most recent purchase price and applying an inflation factor. The estimated contract award is 2 202 , with Period of Performance (PoP) ending 27 September 2023.
This document describes a J&A for the addition of two Firm-Fixed Price (FFP) contract line items (CLINs) for quantities associated with the Miniaturized Airborne GPS Receiver 2000 (MAGR-2K) Mounts. This sole source requirement will be procured from the following company:
Raytheon Company 2000 East El Segundo Blvd El Segundo, CA 90245-3507
(CAGE: 4U884)
Large business
III. Description of supplies/services required to meet agency needs.
This acquisition is to add logical related requirements to IDIQ contract FA8540-18- D-0005, specifically the purchase of isolated and unisolated MAGR-2K Mounts
The receivers are already included on the aforementioned IDIQ contract; the mounts should be delivered two months prior to the receivers.
The instant requirement is as follows:
Isolated mounts: NSN 5975-01-386-6836; P/N 6450725-1 120 each (BEQ)
Unisolated mounts: NSN 5975-01-387-6762; P/N 6450726-1 30 each (BEQ)
This requirement will be for a PoP of three years.
IV. Statutory authority permitting other than full and open competition.
10 U.S.C. 2304(c) (1) as implemented by FAR 6.302-1, “Only one or a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements.”
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
The agency's minimum needs can only be satisfied by the unique supplies available from Raytheon, which possesses the distinct capabilities as follows. As the developer and original equipment manufacturer of the family of MAGR-2K variants since 1998, Raytheon is uniquely qualified to continue production to satisfy the Government's requirements of the highly specialized items described in Section III above.
Previous purchase of isolated and unisolated MAGR-2K mounts was accomplished via IDIQ contract FA8807-13-D-0001, issued 20 Sept 2013 by Space and Missile Systems Center as a sole source contract to Raytheon. In addition, a one-time source-directed purchase (Raytheon) of FMS requirements of these mounts was made 05 September 2019 via contract FA8576-19-C-0002 issued by Robins AFB.
No company other than Raytheon is currently manufacturing or has provided these mounts to the Government in several decades. Rockwell was a provider in the 1980's prior to Raytheon, however they have not expressed interest in this line of business in the recent past.
Accordingly, Raytheon Company is the only firm capable of providing the supplies required without the customer experiencing unacceptable delays in fulfilling its requirements.
Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Request for Information (RFI) was posted in the Federal Business Opportunity (FEDBizOpps) site on 19 February 2020 under Solicitation number FA8576-20-R-0003. The RFI stated the Government was conducting Market Research to identify potential sources which may possess the expertise, capabilities and experience to perform production of the MAGR-2K isolated and unisolated mounts. Responses were due to be received by 20 March 2020; results are addressed in section VIII below.
This requirement will be synopsized on the FedBizOpps web page as required by FAR 5.201. It is anticipated that sources having an interest in subcontracting may be identified through synopsis. Any source who responds to the Government as a result of this synopsis will be identified as a potential source.
Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The overall price of this acquisition will be fair and reasonable to the Government. In accordance with FAR 15.403-3, the contractor will utilize other than certified cost or pricing data in supporting the Government's evaluation of the proposed price. The contract price will be negotiated in accordance with the procedures in FAR Part 15, ensuring the ultimate price to the Government is fair and reasonable.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
Market Research was conducted 19 Feb 2020 through 20 March 2020 in accordance with FAR part 10.001.
Techniques utilized are as follows, with the results of each stated herein:
As described in Section VI above, an RFI was posted with results as follows: Raytheon, the OEM and prior provider, did not respond. Science and Engineering Services (SES) a small business, w the only respondent , however they are not a viable source at this time, and would have to undergo a qualification process; they do not currently manufacture this item.
Further details can be found in the accompanying Market Research report.
Internet searches were performed using keyword searches of mounts, MAGR-2K, electrical/electronic equipment and mounting base using Google, FEDLOG and Yahoo. All results showed Raytheon as the provider of the equipment.
Review of prior market research reports revealed no other source other than Raytheon.
Vendor Survey: Raytheon El Segundo, CAGE 4U884, a Large Business, is the only known vendor in the marketplace today. However, a vendor survey was conducted SES are currently not a viable source.
The mounts are considered a non-severable item, compatible and necessary with the purchase of the MAGR-2K receivers due to production install requirements. Once the mounts have been purchased for production, they rarely break, negating the need for the DoD supply systems to keep more than a few, if any, spares on hand. No spares are being procured on subject acquisition. Government data was purchased from OEM (Rockwell Collins) for this product in the early 1990s. In the mid-1990s, a second source (Raytheon) was qualified to standards identified in Government owned drawing package. Raytheon is the only qualified manufacturer of this item. Market research revealed no source other than Raytheon, nor did it indicate any possibility of acquiring the product in the commercial market sector. The mounts are currently in production by only one source, Raytheon Company.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
None
X. List of any sources that expressed, in writing, an interest in the acquisition.
See Section VI above.
A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
This is a low-dollar acquisition being added to the proprietary MAGR-2K receivers, as the mounts are needed for the receivers as they are delivered. Procurement history over several decades, accompanied by thorough market research, has proven that Raytheon is the only known source in the market. Due to the fact that less than $700K over a three-year period will satisfy known requirements, it would not be economically feasible to further pursue breaking barriers to competition at this time, nor would it be feasible to invest in qualifying an additional source. As long as the receivers are sole source, the mounts will be sole source as well
