FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole Source Justification and Approval
1. Contracting Activity: Mission Installation Contracting Command- Ft Sam Houston
(MICC-FSH)
2. Description of Action: BAMC requests a firm-fixed priced contract with OVID Technologies, Inc. The Government projects award for OCT 2018 and fiscal year 2019, DHP funds will be used.
X An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
approved an acquisition plan in accordance with DFARS 207.103(d)(i)(B) on 14 April 2018.
The required acquisition plan in accordance with DFARS 207.103(d)(i)(B) is currently awaiting Regional Health Command, MICC-FSH Mission Division approval.
This action is a follow-on to contract W9124J-18-P-0003. That contract was not competed under authority FAR 13.106-1(b)(1). Paragraph, “Actions to Increase Competition” of the previous justification, stated: For subsequent acquisitions this requirement may be solicited/ synopsized through FedBizOpps as intent to sole source to determine if any other companies can provide an all-in-one access service for these materials. Previous competitive actions have elicited no other bids or interest. The bid has to meet the requirement to provide all the titles and the years required; OVID is the only company that can provide all the titles and years for the attached list.
3. Description of Supplies/Services: This request is to continue support of online services with the contractor for full text medical reference materials. This service supplements contracts with this contractor at MEDCOM and Wilford Hall Ambulatory service Center (WHASC). A list of the titles requested is attached.
Medical personnel at Brooke Army Medical Center (BAMC) are required to use current, biomedical information for research and in treatment of patients. A current, biomedical database must be easily accessible to the medical personnel, BAMC. The titles in this online database will be utilized with the titles provided by the MEDCOM Army wide enterprise contract and online titles shared between BAMC and Wilford Hall Ambulatory Service Center (WHASC). There is no duplication of titles between the different contracts supplied by BAMC, WHASC, and MEDCOM; each contract supplements the available online, full-text titles.

Total: $587,535.85
4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5.
5. Reason for Authority Cited:
a. OVID Technologies, Inc. is the only responsible source and only one responsible source and no other supplies or services will satisfy agency requirement that provides a single online database that contains all the attached list of titles that are needed to be accessed by Medical personnel to obtain degrees, ensure patient safety, provide patient care, and maintain the BAMC accreditation by the Joint Commission. In addition, OVID Technologies Inc. is the only source for certain titles on the attached list. Market research has determined that no other companies offer online, the OVID exclusive titles.
Also, market research has determined that no other companies offer all the required titles for the online database due them having smaller libraries or OVID being the sole source of certain titles. As such, OVID Technologies, Inc. is the only source for obtaining all the required titles in a single online database.
b. Impact: These journals support policies, GME programs, research, and regular staff by providing in-depth reference and procedural material that supplement the MEDCOM Medical Library. Without this service, BAMC will not be compliance with standards utilized across the AMEDD. If this contractor is not given the award, we would have to look for these references from several different sources (most titles are specific to OVID with no other source) or develop them in-house (i.e., maintain the print journal collection for the years covered by the listed title). Again, OVID is the only source that offers these materials in one online access. Journal back files can no longer be provided through the library in print, as this collection was eliminated due to BRAC and downsizing the library to a minimal space to provide a virtual library. Using several different sources or developing the materials in house would mean we would have to train our physicians, nurses, and clinical staff on their use. With over 5000 care providers, this effort would be costly and time consuming. Personnel would have to be hired to provide the print journals to the medical personnel, some in remote locations. As such, not contracting with OVID for a single online database that provides all the required attached titles willrequire the use of multiple other companies, databases, printed journals, training, and medical personnel to replicate the services provided by OVID.
6. Efforts to Obtain Competition: The Contracting Officer shall publish the notices required by FAR 5.201, and this action will be synopsized.
7. Actions to Increase Competition: For subsequent acquisitions this requirement may be solicited/ synopsized through FedBizOpps as intent to sole source to determine if any other companies can provide an all-in-one access service for these materials.
Previous competitive actions have elicited no other bids or interest. The bid has to meet the requirement to provide all the titles and the years required; OVID is the only company that can provide all the titles and years for the attached list.
8. Market Research:
(1) A Google search of the World Wide Web did not uncover any other companies that provide these services in full. Individual organizations may provide their own area of specialty but do not include the services for access and updates. OVID is the only source known to provide these services on a wide range of specialties and they own most of the titles. Any other vendor will subcontract through OVID and the cost will be inflated because of that.
(2) The market research was conducted on 18 July 2018.
(3) No responses were received via email from FedBizOpps sources sought posting. OVID has no authorized resellers at this time.
