J&A No. 50,200 Ser 02/4075
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity
Naval Sea Systems Command, Naval Surface Warfare Center, Corona Division (Corona Division), Contracts Department, Code 02.
2. Description of the Action Being Approved
Award of a Firm-Fixed-Price, Indefinite-Delivery Indefinite- Quantity contract on a sole source basis to Fluke Electronics Corporation (Fluke) for the purchase of Fluke Kelvin Varley Divider (KVD) upgrades, part number (P/N) 720AN. Authority to act under this J&A shall be effective from the date of approval to the end of the contract term.
3. Description of Supplies/Services
The Naval Air Systems Command (NAVAIR) Metrology and Calibration (METCAL) Program has a requirement for up to a maximum of 138 KVD upgrades, P/N 720AN. The Fluke KVDs provide precise and repeatable ratios of voltage for the calibration test instruments that include but are not limited to pH meters, load cell indicators, digital voltmeters, portable mill-volt potentiometers and multi-function calibrators. The Fluke KVD upgrades will be procured over a five-year ordering period with an anticipated completion date of July 2026.
The total estimated value of this acquisition is and will be funded with Aircraft Procurement, Navy (APN) funds. The table below depicts the type of funding as well as the estimated amount per fiscal year.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
Ser 02/4075
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements as implemented by Federal Acquisition Regulation (FAR) 6.302- 1(a)(2).
5. Rationale Justifying Use of Cited Statutory Authority
NAVAIR METCAL currently utilizes the Fluke P/N 720A KVDs in over 1,500 annual calibration workload hours in support of intermediate level calibration laboratories ashore and afloat.
The Fluke P/N 720AN KVD and will be used as a direct replacement to the Fluke P/N 720A KVD, which has lost functionality due to broken and aging internal components. Upgrading the Fluke P/N 720A KVD to the P/N 720AN KVD offers the Government enhanced reliability and maintainability in the same type of operational and physical footprint currently fielded to the fleet.
Additionally the Fluke P/N 720AN KVD is the only KVD with an accuracy of 0.1 parts per million. This accuracy measurement meets the test requirements to support the existing infrastructure of onsite calibration equipment for Navy operations.
The Fluke P/N 720AN KVD is the only existing KVD that works in the existing NAVAIR METCAL Infrastructure. Currently, NAVAIR METCAL has over 92 Instrument Calibrations Procedures (ICPs) written for the Fluke P/N 720A. Since NAVAIR METCAL is procuring upgrades to the existing Fluke P/N 720A, current ICPs will be revised rather than re-written. The estimated historical labor cost to revise the current ICPs is
Per ICP X 92 ICPs). If a unit other than the Fluke P/N 720AN KVD were procured, the estimated historical labor cost to re-write ICPs would be approximately Per ICP X 92 ICPs). Thus, the difference between revising the current ICPs and having to re-write the ICPs, if an alternative KVD other than the Fluke P/N 720AN was procured is cost to re-write the ICPs less the cost to revise the ICPs).
In addition to the cost to re-write the ICPs, if a KVD other than the Fluke P/N 720AN KVD were procured, a loss of time to
Ser 02/4075 fielding would occur within the fleet. Each ICP would take up to four (4) months to progress from start to issuance, with only two (2) ICPs being created concurrently by no more than two (2) engineers for a particular model number. Preparing for fielding an alternative APC will add a minimum delay of 184 Months (4 months X 92 ICPs X .5 engineers). This delay would cause a 20% loss of calibration capability for 23 classes of general purpose electronic test equipment. By contrast, it would only take up to one (1) month per ICP or 46 Months to revise all ICPs in the current NAVAIR METCAL inventory (1 month X 92ICPs X 0.5 engineers). In addition, the Fluke P/N 720A KVD will be in use while ICP revisions occur, therefore not causing any additional delay in the fielding of these units. Based on the information above, the Government would not yield enough savings through competition to offset the costs and risks of delays in fielding an alternative unit.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was conducted to determine if a KVD capable of meeting the Government’s requirement was available in the commercial market place. Market research using web-based searches including GSA Advantage, Google, Bing, and NAVICPmart did not reveal any sources for the requested equipment other than Fluke, the original equipment manufacturer. The market research that was conducted revealed that Fluke produced the only KVD capable of meeting the Government’s minimum requirements.
A Sources Sought Notice (SSN) was posted on the beta.SAM website indicating the Government’s intent to sole source this requirement to Fluke. The posting was issued on 19 August 2020 and closed on 03 September 2020. At the close of the SSN, one
(1) response was received from Fluke. A capabilities analysis was performed by the certifying technical and requirements personnel, which concluded that Fluke was able to meet the Government’s minimum requirement in the Statement of Work.
Additional market research was conducted to verify if Fluke has authorized distributors with the ability to provide the Fluke P/N 720AN KVD. An email was sent to Fluke on 24 September 2020
Ser 02/4075 requesting information on any authorized distributors or resellers with the ability to produce the Fluke P/N 720AN KVD.
Fluke responded on 24 September 2020 stating that they do not have any authorized distributors capable of providing the Fluke
P/N 720AN KVD.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the items covered by this J&A will be fair and reasonable. The Contracting Officer will use price analysis, including commercial price lists and historical information to determine that the final price to the Government is fair and reasonable.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, Corona Division has no plans at this time to compete future requirements for the types of supplies covered by this document. If another potential source emerges, Corona Division will assess whether competition for future requirements is feasible.
