LIMITED SOURCE JUSTIFICATION
70Z07919FPT107200
This acquisition is conducted under the authority of Section 201 of the Federal Property and
Administrative Services Act of 1949 (40 U.S.C.501) Multiple Award Schedule Program FAR 8.401 and is justified by the following facts and rationale required under 8.405-6(b)(1) as follows:
(1) Agency and Contracting Activity.
The Department of Homeland Security (DHS), U.S. Coast Guard (USCG) Telecommunication and
Information Systems Command located at 7323 Telegraph Road, Alexandria, VA 20598-7320.
(2) Nature and/or description of the action being approved.
It is the intent of the USCG to award a limited source, brand name call under the Department of
Homeland Security (DHS) Enterprise Software Solutions (ESS) Enterprise License Agreement (ELA)
Blanket Purchase Agreement (BPA) to procure brand name McAfee additional hardware and software licensing maintenance support to continue operations on USCG owned systems; Cyber Command
Security Operations Center (CSOC), Enterprise Network Infrastructure Product Line (ENI PL) and
Security Information & vent Management (SIEM) systems Coast Guard wide. On the DHS ESS ELA
BPA, only one vendor, Immix Technology, Inc. is an authorized reseller of McAfee products and maintenance.
(3) Description of Supplies/Services.
This requirement is for the acquisition of additional brand name hardware and software license and maintenance support for McAfee products. The addition of McAfee products allows for continued hardware and software maintenance support for IDPS alerts, network security analysts to have complete oversight to all network activity, thus strengthening security and improving situational awareness while capturing and reporting the active security posture of the CGOne to senior management on systems Coast Guard wide. This procurement is also to provide continued McAfee
SIEM support for compliance reporting, threat detection, and security incident response through real-time collection and historical analysis of security events from a wide variety of IT sources. Currently the scope of SIEM includes enterprise assets, mission essential systems, critical network security devices, & district servers. The estimated amount for this award is $263,087.60.
(4) Identification of the justification and the rationale.
This acquisition is being conducted under the authority of the Multiple Award Schedule Program in accordance with FAR 8.405-6(b), Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
The US Coast Guard requires renewal of maintenance for existing licenses of McAfee software.
McAfee is a brand name item peculiar to one manufacturer. McAfee software is currently utilized throughout the Coast Guard Infrastructure. McAfee is the only source that can provide upgrades and security patches for McAfee software products. McAfee Software updates are required for continued operations. Failure to maintain system support exposes Coast Guard data systems and networks to potential intrusions, malware, and incidents that threaten the integrity, availability, or confidentiality and can result in them being disconnected from the network.
The DHS ESS ELA BPA is a mandatory source for McAfee software licenses, software maintenance, training and consulting in three capability areas: application infrastructure, backup storage and security.
Immix Technology, Inc., is the only authorized reseller of McAfee products and maintenance on the
BPA and is thus, the only one capable of providing the brand name products and maintenance.
(5) Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d).
The Contracting Officer determines that anticipated pricing will be fair and reasonable based on previously competed McAfee Product Support and Maintenance in the award of HSHQDC-11-A-
00043. The General Services Administration (GSA) has already negotiated fair and reasonable pricing.
The DHS BPAs have negotiated additional discounts to the GSA schedule prices and those prices were determined fair and reasonable. The Contracting Officer will also perform a price analysis to determine that the price at the time of award is fair and reasonable and is consistent with the BPA and contract terms.
(6) A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
Market research was conducted among the holders of the DHS ESS ELA BPA to determine if any vendor is an authorized McAfee reseller. As the BPA is mandatory and one vendor, Immix
Technology, Inc., is capable of meeting the requirement, further market research was not conducted.
(7) Any other facts supporting the justification.
None.
(8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made.
Currently, McAfee is proprietary and is being used on the Coast Guard network. The Coast Guard will continue to utilize competition for McAfee software until a requirement arises to and will continue to monitor the marketplace to identify products that are manufactured by other companies that can successfully be integrated into virtual desktop and server application capabilities for continued enhancements, scalability and manageability.
(9) Contracting Officer’s Certification.
In accordance with FAR 8.405-6(c)(2)(ix), I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
Richard J. Murphy Date
Contracting Officer
(10) Technical/Requirements Personnel Certification.
I certify that this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for the justification, is accurate and complete.
