Justification and Approval for Other than Full and Open Competition – FAR Part 6

1. Contracting Activity: U.S. Army Contracting Command – New Jersey (ACC-NJ)

2. Description of Action: Program Executive Office Enterprise Information Systems (PEO EIS), Program Management Office (PMO), Integrated Personnel and Pay System-Army (IPPS-A) intends to award a Firm Fixed Price (FFP), and Cost Plus Fixed Fee (CPFF) modification to Contract Number W15QKN-15-C-0049 with CACI-ISS, Inc. (CACI) 14370 Newbrook Drive, Chantilly, VA 20151-4206 for the alignment and re-baseline of Release 3 of the IPPS-A Increment II (Inc II) Program. IPPS-A’s objective is to deliver a fully integrated personnel and pay system to the Total Force Army. The purpose of this action is to modify Release 3 of the existing contract to ensure the re-baseline of the overall IPPS-A Inc II Program aligns with Army Acquisition Executive (AAE) guidance received via briefing on 31 August 2021, as reflected in the 5 November 2021 Acquisition Decision Memorandum, to include a nine-month period of performance extension of the Release 3 efforts. The Government projects the Undefinitized Contract Action modification award for December 2021, and Fiscal Year (FY) 2022 Research, Development Test & Evaluation (RDT&E) funds will be used. An Acquisition Plan (AP) Amendment (Amendment 03) is currently in staffing for PEO approval.

3. Description of Supplies/Services: The purpose of the Inc II contract, W15QKN-15-C- 0049, is to deliver a fully integrated personnel and pay system to the Total Force Army. The functionality is broken out into discreet releases: Release 2 Human Resource (HR) to the Army National Guard (ARNG); Release 3 Minimum Viable Solution (R3 MVS) HR to the US Army Reserve (USAR) and Active Component (AC), and Release 4 MVS Pay (which was subsequently removed as detailed below) to all Army Components. The scope of contract W15QKN-15-C-0049 includes the design, development, test, deployment and sustainment of Release 3 with a current scheduled period of performance end date of 31 December 2021. The purpose of this action is to modify the existing IPPS-A Inc II System Integrator contract to ensure the re-baseline of the overall IPPS-A Inc II Program aligns with AAE guidance received 31 August 2021, which includes the extension of Release 3 by nine months.

Background

The subject contract was initially designed to support the Army’s strategy for incremental development and fielding of Inc II. This strategy included the simultaneous development of multiple Releases in parallel. The initial strategy was reviewed and revised in 2019 by the AAE. The concurrent development was suspended, and a stop work order was issued for Release 4 MVS. The IPPS-A program modified the Inc II contract for the Release 3 Build / Test phase in November 2019. The remaining releases were re-baselined in December 2019, and resulted in the schedule and funding for Release 3, Release 4, and Capability Support to be re-forecasted. In early 2020 the Release 4 MVS, and all additional work including enhancements requested by the functional user and the capability support necessary to sustain the system was assembled into a new Acquisition Requirements

Program: IPPS-A Release 3

Package. The Government intends to release the newly developed Release 4 package for competition during Fiscal Year 2022. Accordingly, the requirements associated with Release 4 are not part of this justification.

Current Program Status

Since the 2019 re-baseline, CACI resumed development of Release 3 functionality and subsequently entered the Developer Integration Test (DIT) phase. At the conclusion of Release 3 DIT, CACI met the contractual exit criteria for DIT in regards to the Non-classified Internet Protocol (NIPR) portion of the Release 3 MVS solution, but did not meet the milestone exit criteria for the Secret Internet Protocol router Network (SIPR) portion. The SIPR portion remained in DIT, while the NIPR portion progressed into the beginning stages of System Integration Test (SIT), the first phase of Government Acceptance Test (GAT). As a result of the performance delay a bilateral modification was executed that permitted entry into the SIT Phase while SIPR development remained in DIT. On 1 May 2021, Release 3 MVS entered GAT Phase for NIPR, consistent with the original intent to Go-Live in December 2021.

SIT was originally scheduled to be completed on the NIPR portion of the Release 3 MVS on 30 June 2021. However, CACI still did not meet key DIT exit milestone criteria for the SIPR portion of the Release 3 MVS. Additionally, CACI did not meet the System Problem Reports (SPR) severity test criteria. Recognizing and accepting potential risk, the Government moved forward and entered System Acceptance Testing (SAT), the second phase of GAT,.

This risk to the R3 MVS reached a point where CACI could no longer maintain the schedule due to SIT delays. As a consequence CACI could not exit SAT testing milestone criteria in order to enter into the Limited User Test (LUT) phase, the third phase of GAT. Therefore, a modification is required in order to implement a revised schedule that would allow CACI to complete the remaining requirements of DIT and SAT and then complete LUT and Go-Live.

Re-Scheduling of SAT and LUT

SAT was originally scheduled to be completed on 31 Aug 2021 and now needs to be re- scheduled under this justification. SAT is the test and evaluation of the fully integrated IPPS- A system, to include all applicable interfaces, using typical end users in their operational environment. The test is planned, organized, conducted and led by the IPPS-A PMO Test & Evaluation (T&E) Branch with the assistance of the program’s Integrated Test Team (ITT) which includes representation from Army Test and Evaluation Command (ATEC), Joint Interoperability Test Command (JITC), Developmental and Operational Test & Evaluation (DOT&E), the functional proponent and other stakeholders as required. The SAT provides information to ATEC as to the readiness of the system for LUT and serves as a dry run for LUT with end users. SAT, as conducted during this contract modification and schedule adjustment, will be the second instantiation of this test and is intended to show readiness for LUT. The PMO T&E team, with key stakeholders from the G1 Functional Management Division (FMD) (i.e. Functional User), developed Operational Mission Scenarios to conduct an operationally realistic, mission-based evaluation of the system.

Program: IPPS-A Release 3

CACI supports SAT by providing training and help desk support to end users, application security account administration, interoperability test support and defect resolution to include fixes to the Release 3 MVS solution as discovered and required during testing.

The purpose of the LUT, which is estimated to take two months, is to address IPPS-A capabilities and limitations with respect to the system life-cycle functions and operational profiles, in order to determine the system’s Effectiveness, Suitability, and Survivability (ESS) under realistic operational conditions. The LUT is designed to collect ESS data of the system as it interacts with users and other systems to accomplish tasks in support of Soldiers conducting day-to-day, real world mission requirements. LUT is conducted by ATEC in representative Army locations with real end users. ATEC provides an Emerging Results Brief for the Operational Evaluation Report to inform the Release 3 Limited Deployment Authority to Proceed (within two months of the completion of LUT).

The CACI efforts to support SAT / LUT of Release 3 MVS are represented on the existing contract but must be extended to complete the critical testing efforts prior to Go-Live in September 2022. IPPS-A didn’t meet key SAT exit criteria in August 2021 and it was determined that critical LUT entrance criteria could not be met – thus delaying the start of LUT. IPPS-A notified the AAE that the program needed more time to correct deficiencies in critical areas dealing with data and Trading Partner interfaces in addition to correcting solution defects and engineering change requests. SAT / LUT efforts will continue under this contract modification with LUT for the Release 3 MVS software which will be required to begin no later than 13 June 2022 to meet the required Go-Live date of 23 September 2022.

All Release 3 non-MVS requirements (i.e. enhancements) will be included in the future IPPS-A Release 4 contract and are not part of this scope of work. On 31 August 2021, the AAE authorized a 9-month schedule adjustment for this effort, as detailed in the below charts.

Program: IPPS-A Release 3

The goal of Release 3 is to establish a consolidated system that provides accountability and tracking of Soldiers in all three Components: ARNG, USAR, and AC (to include deployed Soldiers). The system integrator has completed design and build efforts for the Release 3 MVS but needs to complete testing and deployment and then sustain the Release 3 MVS capabilities identified in the PWS.

The estimated value of this modification is $XXXXXXXX, and extends the Release 3 MVS by establishing Contract Line Numbers’ (CLINs’) 8003, 8004, 8005 and 8006 with a period of performance (PoP) from 1 January 2022 to 23 September 2022. 5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2)(iii)(A) and (B), for Department of Defense (DoD), National Aeronautics and Space Administration, and the Coast Guard, services may be deemed to be available only from the original source in the

Program: IPPS-A Release 3 case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition or unacceptable delays in fulfilling the agency’s requirements.

Unacceptable Delay

The Government’s requirement is to Go-live by 23 September 2022. A new competitively awarded contract for the completion of the Release 3 Minimum Viable System (MVS) would delay the deployment of Release 3 MVS by at least 33 months as detailed in the chart below.

IPPS-A Sole Source (SS) versus Full & Open Competition (F&OC) –

Unacceptable Delays

Transitioning Design to new SI N/A 6 months 6 months Subtotal 33 months 33 months

Remaining activities to Go Live 9 months 9 months N/A Total Duration 9 months 42 months 33 months Total Unacceptable Delay 33 months

It is estimated that it would take approximately 42 months to complete the Release 3 MVS with another vendor, which would result in a 33 month unacceptable delay. Activities that would occur during those 42 months include:

1) Preparation for and issuance of a new competitive contract (16 months). The 16 month estimate includes the following activities: Acquisition Requirements Package (ARP) to include initial requirements assessment, requirements documentation development and approvals as well as supplemental reviews required to evaluate the portions of Release 3 that are finished as opposed to those that remain to be completed. These estimates are based on recent experience with programs of similar size and complexity.

2) Source selection and award of the contract (five months). This estimate is based on DoD Procurement Acquisition Lead Time (PALT))

3) On-boarding of a new SI (six months) This estimate includes the hiring of personnel, Common Access Card provisioning, providing building access, equipment provisioning, Program: IPPS-A Release 3 and subsequent access to Defense Information Systems Agency infrastructure systems.

The six month time frame was based on General Fund Enterprise Business System transition work from Accenture to IBM.

4) Transitioning the completed Release 3 MVS, Build / Test portions (six months). This work is complex and requires any new contractor to have a thorough understanding of the Release 3 MVS design, including the intricacies of the system interfaces and integrity of the data. Previously, CACI needed approximately six months to create protocols to cleanse, and migrate data. The six month time frame was based on General Fund Enterprise Business System transition work from Accenture to IBM. It is reasonable to estimate that a new contractor would require a similar amount of time to execute a comparable approach to validate the data.

Sustainment of an information technology system is tightly coupled to any development effort being performed on the same system baseline. Sustainment of Release 2 is directly tied to the Release 3 software development effort. The addition of a second contractor to take over development of Release 3 MVS while CACI sustains Release 2 would introduce unacceptable risk into the Release 3 software baseline and the overall integration of the software Releases into a unified baseline. The Release 2 Capability Support (Sustainment) phase began with the deployment of Release 2 and continues in parallel with the development of Release 3 software. Having separate contractors responsible for system integration and product development, in conjunction with maintaining the sustainment baseline, jeopardizes the integrity of the system by duplicating efforts, which will add time to an already aggressive software development schedule. Any delays limit the program’s ability to provide a state-of-the-art HR and Talent Management to the Army Total Force.

Duplication Costs

Costs Associated With the Continued Use of Legacy Systems

As described in FAR 6.302-1(a)(2)(iii)(A), services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. Any postponement of Release 3 software deployment would result in delays for when the Government can begin to phase out legacy HR systems and would result in a substantial duplication of costs being incurred by the Government. The annual cost of maintaining these legacy HR systems and the efficiencies gained by their elimination is estimated to be XXXXX per year, which averages XXXXX per month. This estimate was derived from the summation of individual Return On Investment savings of fifteen legacy systems. These systems include; Enlisted Distribution Assignment System - XXXXX; Integrated Capabilities Development Team - XXXXX, Integrated Total Army Personnel Database - XXXXX, Military Occupational Specialty Code - XXXXX, Promotion Point Worksheet - XXXXX,Total Army Personnel Database (TAPDB) -– Active Enlisted - XXXXX, TAPDB- Active Officer - XXXXX,; TAPDB- Army National Guard - XXXXX, Unit Identification Code - XXXXX,; Electronic Military Personnel Office - XXXXX, Personnel

Program: IPPS-A Release 3

Assignment Management Solution Ft Hood - XXXXX, United States Army Europe Personnel Database - XXXXX, Full Time Support Management Control System - XXXXX, Reserve Component Automation Systems - XXXXX, and TAPDB- Army - XXXXX. The Government cannot recoup the cost of running redundant legacy systems or utilize the efficiencies gained from the full deployment of Increment II while Releases 3 is in development. The deployment of Release 3 will decrease the duplicative cost of operating legacy HR while increasing process efficiencies. A new competition to complete Release 3 SAT and LUT would result in serious injury to the Government as a result of the further delay in the deployment of the release and therefore, defer the cost avoidance associated with maintaining legacy systems and inefficient processes. The Army would continue to pay legacy system costs associated with 33 months of delay at approximately XXXXX per month for a cost of XXXXX. These costs are considered duplicative and substantial and they would not be expected to be recovered through competition.

Costs Associated With Maintaining Inefficient Pay Systems

The development and deployment of the IPPS-A software releases are sequential efforts.

Following the Release 3 MVS Limited Deployment Authority to Proceed, the Release 4MVS design effort will begin. Any delay to the deployment of the Release 3 software will cause further delays to the design, development, and deployment of the Release 4 MVS (Pay for all Army Components). Additional estimated savings from delivering and deploying Release 4 include eliminating more legacy systems, and integrating personnel and pay functionality, resulting in approximately XXXXX per year. This savings estimate averages to XXXXX per month. This estimate was derived from the remaining R3 and R4 legacy systems that will be subsumed and the costs/fees associated with them. Specifically, the savings reflect a reduction in the following: the cost of the remaining legacy systems to be subsumed XXXXX, reduced fees paid to DFAS to provide payment services to the Army XXXXX, and over/erroneous payments which include overpayment of benefits and non-deducted leave XXXXX. The deployment of Release 4 will further decrease the duplicative cost of operating legacy pay systems while increasing process efficiencies. The Army will continue to pay to sustain multiple legacy pay systems until the total IPPS-A solution is implemented. The Army will continue to pay approximately XXXXX per year, or XXXXX per month for 33 months to maintain HR and pay legacy systems while executing inefficient processes, for a cost of approximately XXXXX. These costs are considered duplicative and substantial and they would not be expected to be recovered through competition.

Failure to approve this Justification and Approval (J&A) will result in delays of approximately 33 months. As described above, the total costs of those months that would not be recoverable by competition are estimated to be XXXXX (Continued legacy system payments XXXXX and maintaining pay systems with inefficiencies XXXXX.

6. Efforts to Obtain Competition: The Contracting Officer published the notices required by FAR 5.201. No bids or proposals were received.

a. Effective competition: Because this is a sole source action, effective competition is not applicable

Program: IPPS-A Release 3

b. Subcontracting Competition: Subcontracting opportunities will be maximized to the fullest extent possible as outlined in CACI’s subcontracting plan under contract W15QKN-15-C-0049, which was approved in accordance with FAR 52.219-9, Small Business Subcontracting Plan. A revised Subcontracting Plan will be incorporated into the contract.

7. Actions to Increase Competition: In parallel with the Release 3 MVS software development and testing, the Government will pursue a separate competition for the Release 4 MVS design, development, testing, training and deployment. The Government intends to release a draft RFP for the newly developed Release 4 package for competition during Fiscal Year 2022, along with a final full and open competition Solicitation in Fiscal Year 2022. The new contract is planned for award in Fiscal Year 2023 and will also include continued sustainment for Releases 2 and 3.

8. Market Research: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance, and Information 206.302-1(d), ACC-NJ posted a Request for Information (RFI) on 17 May 2021. Responses from the XXXX vendors listed below were received and reviewed by the INC II Acquisition Manager for the Army Project Management Office. However only the incumbent contractor is deemed capable of meeting the required schedule for Release 3 without substantial duplication of cost to the Government and unacceptable delays in fulfilling agency requirements.

Respondents were assessed on their capability of designing, developing, and deploying IPPS-A Inc II.

2. Sole Source.

3. FAR 6.302-1.

4. Summary of Paragraph 7 of Previous J&A: In parallel with the Release 3 software development and testing, the Government will pursue a separate competition for the Release 4 design, development, testing, and deployment. The new contract will also include continued sustainment for Releases 2 and 3, which will have been deployed by that point.

Explanation of the Results: Due to the current delays to Release 3 MVS the competition for the Release 4 design has also been delayed and is now planned for FY22 with a contract award in FY23.

5. Contract W15QKN-15-C-0049 was accomplished using full and open competition. Subsequent modifications to rebaseline have required limiting the source to the incumbent due to the fact that another SI could not utilize the CACI Release designs without significant rework. New competitions would have further delayed deployment of the releases and therefore deferred the cost avoidance associated with maintaining legacy systems and inefficient processes.

6. No unusual patterns existed in the procurement history.

7. A justification was approved on 26 SEPT 2019 for a re-baseline executed

Program: IPPS-A Release 3 under Modification P00062. This J&A was for a re-baseline of IPPS-A Increment II’s cost and schedule to deploy Release 3 (HR capability), and Release 4 software (Pay capability) to all Army components. This re-baseline incorporated lessons learned from the development, testing, and deployment of the Release 2 software. This approach was justified as award to any other source would result in substantial duplication of cost to the Government that would not have been expected to be recovered through competition and would have resulted in unacceptable delays in fulfilling the agency’s requirements. The changes that have since occurred include delays for the Release 3 MVS which require a re-baselining of the program.
