Source Selection Information - FAR 2.101 and 3.104
Justification For Other Than Full and Open Competition
1. The Defense Logistics Agency (DLA) Troop Support, Construction and Equipment Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.
3. Following are the supplies required to meet DLA’s needs:

Item Description: Heat Detector Assembly consisting of Meggitt Control Systems Part Numbers 905108-01 and SAH-04563-02 Quantity: 775 Each Unit Price: $4,661.76 Estimated Contract Value: $3,612,864.00
4. The applicable statutory authority permitting other than full and open competition is
10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1, only one responsible source and no other supplies will satisfy agency requirements.
5. The use of this authority is necessary because Meggitt Control Systems is the only approved source of supply for the required item. This heat detector assembly is uniquely designed to fit the Arleigh Burke Class Navy Vessels in compliance with Occupational Safety and Health (OSHA) requirements for safety systems. The assembly is an electro-mechanical heat detector.
The device works similar to a smoke detector but also detects heat and flames by using infrared technology and is designed to meet the dimensions and higher fire safety component electrical specifications of the design authority. It is hard wired and connects to pre-installed fire safety systems and mounted to either a wall or the ceiling. It is normally placed in areas such as an engine room, kitchen, sleeping quarters and hallways. The principle of detection is heat measurement by a thermistor. The normal operating functions are temperatures 40 degrees to 158 degrees Fahrenheit. The customer determines the equipment they are protecting, material flash point for fires and then selects the proper detector for the location based on temperature rating (either 125 degrees Fahrenheit or 105 degrees Fahrenheit). There are no other manufacturers approved by the Navy to make this exact heat detector assembly. Meggitt is the owner of the technical data for this NSN. The approved source Meggitt Control Systems will be quoting through their authorized distributor Jamaica Bearings Co Inc.
6. This acquisition was synopsized in Sam.gov. A Sources Sought Notice was issued on July 11, 2022 and closed on August 11, 2022. No vendors responded to the sources sought notice.
Furthermore, justification will be made available for public inspection, with the solicitation, in
Page | 2 accordance with FAR 6.305(c).
7. As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be determined fair and reasonable based on a favorable analysis of other than cost or pricing data.
8. Market research was conducted on July 11, 2022 to July 27, 2022 with Meggitts authorized distributor Jamaica Bearings Co Inc. Market research was not conducted with the approved source Meggitt Safety Systems as they no longer quote directly to the Government. An internet search was conducted to see if additional sources for this NSN were available. Based on the internet search no additional manufacturers of comparable heat detector assemblies were found.
In addition, on October 14, 2021, the Engineering Support Activity advised that Meggitt Control Systems is the only source for this particular heat detector.
9. There are no other facts supporting the use of other than full and open competition.
10. Jamaica Bearings Defense expressed interest in the proposed acquisition.
11. In an effort to increase competition, the Navy ESA was contacted for additional sources prior to the start of this procurement. The ESA evaluated the matter and advised that there were no other sources at this time. Any alternate offers submitted in response to the proposed procurement will be reviewed by this office and referred to the ESA for evaluation.
