Justification and Approval for Other than Full and Open Competition Sole Source Acquisition
J&A Tracking No. 20-0125
1. Identification of the agency and contracting activity: Defense Health Agency (DHA), Enterprise Medical Support - Contracting Division (EMS-CD), Joint Base San-Antonio, TX 78234
2. Nature and/or Description of Action being approved: The DHA EMS-CD requests approval to award a sole source contract for the purchase of Identiprise Snareworks software and maintenance support.
3. Description of Supplies/Services: Defense Health Agency, (DHA) Solutions Delivery Division, (SDD) has requested SPAWARSYSCENLANT, Defense Health Information Management System (DHIMS) Integrated Product Team (IPT), to continue facilitating renewal of SnareWorks software licenses and maintenance currently being provided by Identiprise.
SnareWorks provides a means to authenticate and manage role based access into the Department of Defenses' (DoD’s), Armed Forces Health Longitudinal Technology Application (AHLTA) system and the Central Data Repository (CDR). SnareWorks is an Identiprise proprietary toolset tightly integrated into more than ninety (90) various software applications in the AHLTA Enterprise, supporting Military Health Systems (MHS) operations globally. This procurement is necessary to ensure existing Software Upgrades/Technical Assistance (SU/TA) is sustained and that operational and engineering requirements are met and supported without interruption or loss of service to support Defense Medical (DefMed) treatment facilities. Identiprise will also be responsible to provide enhancements and new releases for SnareWorks as they are made available.
The resultant contract will have an estimated value of $3,424,792.00 with a base period of twelve
(12) months and (2) 12-month option periods. The contract type is Firm Fixed price (FFP) and will be funded with O&M dollars.
4. Statutory Authority Cited permitting other than full and open competition: Acquisition of commercial item(s) conducted pursuant to FAR Subpart 13.5 in accordance with 41 U.S.C.
1901 Simplified Acquisition Procedures.
5. Rationale Justifying Use of the Statutory Authority Cited: SnareWorks is an Identiprise proprietary toolset tightly integrated into more than ninety (90) various software applications in the AHLTA Enterprise, supporting Military Health Systems (MHS) operations globally. Within the AHLTA enterprise, SnareWorks provides a means to authenticate and manage role based access which is a critical function. Sustainment of the AHLTA enterprise is mandatory until the MHS Genesis platform is online and operational. DHA Senior Leadership has established a moratorium which restricts the ability to change any of the current software on the legacy systems. Because of the moratorium, there is no switching to different OEMs because the current
DHA PGI 213.5, Attachment 1 (06-21-2018) systems will be decommissioned when MHS Genesis comes online fully in 2025. The MHS must provide health care perpetually without lapse. Thus, the AHLTA systems will have to remain running and in place until the new MHS Genesis system is operational. The AHLTA application is to be decommissioned in the near future once MHS Genesis is completely rolled out in 2025, so SDD has been directed to sustain the current systems as is.
Identiprise is the architect, developer and owner of the software application SnareWorks and as such, is the only vendor authorized to provide all associated licensing rights and SU/TA required to keep the software operational during the deployment of MHS Genesis. Identiprise has perpetually developed features and functionality of the SnareWorks solution which are customized to the AHLTA implementation including specialized Organizational Administration, Account Creation, Security Matrix and Multi-Site Access. As the proprietary software manufacturer, Identiprise offers unique expertise not available in industry. SnareWorks support is not currently available through any other reseller or distributor. Therefore, Identiprise is the only vendor capable of providing needed software, upgrades, licensing and support for unimpeded operation of the application.
In addition, DHA has a current Authority to Operate (ATO) Identiprise brand software, and this satisfies the Risk Management Framework (RMF) by providing immediate notification of attempted access or configuration changes. MTFs and other DOD users utilize Identiprise designed architecture and equipment along with corresponding hardware to transition to DHA IT infrastructure.
6. Efforts to Obtain Competition: Due to the proprietary nature of the software being procured no efforts to obtain competition were taken. The notices required by FAR 5.202 will be posted.
7. Determination that Anticipated Cost to the Government will be Fair and Reasonable: In accordance with FAR 13.106-3(a)(2) in acquisitions where the contracting officer receives one offer in response to a solicitation, the contracting officer may base the statement of price reasonableness on market research; comparison of the proposed price with prices found reasonable on previous purchases; current price lists, catalogs, or advertisements. However, inclusion of a price in a price list, catalog, or advertisement does not, in and of itself, establish fairness and reasonableness of the price; a comparison with similar items in a related industry;
contracting officer’s personal knowledge of the item being purchased; comparison to an independent Government estimate; or any other reasonable basis. The contracting officer intends to utilize one or a combination of the mentioned methods in determining the proposed price as fair and reasonable.
8. Market Research: Due to the proprietary nature of the software being procured, market research was limited to identifying sources capable of providing the required software. A query of the internet, Small Business database, GSA Advantage, and NASA SEWP did not identify any potential sources capable of fulfilling this requirement. Communication with the software developer via telephone established that they are the only provider of the required software and there are no authorized resellers.
9. Other Facts: The Department of Defense (DoD) on behalf of the Defense Health Modernization System (DHMS) recently awarded a $4.3B contract to modernize the EHR.
Building the new system will be complicated and implementation does not simply mean turning off one system and turning on another. The new system will replace up to 50 legacy systems and there is a transition plan for each one of those systems.
10. Interested Sources: To date, no sources have expressed interest in this requirement.
11. Actions to overcome barriers: Until the infrastructure changes other sources are not viable. DHA continuously monitors the commercial IT market and will reassess brand requirements on a regular basis.
