JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(10 U.S.C. 2304(c)((2))

Pursuant to requirements of the Competition in Contracting Act (CICA) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.3 and in accordance with the requirements of FAR 6.303-2, the justification for use of statutory authority under FAR Subpart 6.3 is justified by the following facts and rationale required under FAR 6.303-2 as follows:

1. Agency and Contracting Activity – The United States Coast Guard Shore Infrastructure Logistics Center (SILC), Commercial Support Services, proposes to enter into a bridge modification on a basis of other than full and open competition.

2. Nature and/or Description of the Action being Approved – The Coast Guard has an unusual and compelling urgent requirement for bridge modification for Facilities Maintenance Services at Aviation Training Center Mobile, AL. This modification will extend current Contract HSCG84-09-N-AA8323 performance period 13 days, in the amount of , using FY16 34 KM funds. These services are currently being performed by Satellite Services, Inc., 7547 Waterside Loop Road, Suite B, Denver, NC 28037. The current contract is due to expire November 30, 2015; and no further options to extend are available.

3. Description of Services – The requirement is to provide, for 13 days, Facilities Maintenance Services at U.S. Coast Guard Aviation Training Center Mobile, AL, for a total of . The bridge modification will allow the established and consistent facilities maintenance services already being performed to continue without any interruption, until a new contract takes effect December 14, 2015.

Unit

Period Price Total December 1, 2015–December 13, 2015 13 Days

4. Identification of Statutory Authority Permitting Other Than Full and Open Competition - The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(2) implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-2 entitled “Unusual and Compelling Urgency”. Period of performance applies to one-year limitation at FAR 6.302-2(d).

5. Demonstration that the Nature of the Acquisition Require Use of the Authority Cited - This requirement is to bridge services for Facilities Maintenance Services at U.S.

Coast Guard Aviation Training Center Mobile, AL. The facilities maintenance program at ATC Mobile is mandated by COMDTINST M11000.11A, Civil Engineering Manual under Chapter 18, Facilities Engineering Organization and Management. As such, this acquisition for comprehensive commercial facilities maintenance services is in direct support of this mandate. Work will be performed at or dispatched from the U.S. Coast Guard ATC, its tenant command, the Gulf Strike Team (GST), and Coast Guard Exchange System (CGES). The ATC is located on the north side of Bates Field, Mobile, Alabama. The specific objective of this solicitation is to ensure ATC Mobile’s physical assets are maintained in accordance with government and industry standards.

The scope includes comprehensive commercially-available facilities maintenance and repair services for ATC Mobile. These services provide for upkeep of ATC Mobile’s buildings, roads, grounds and other miscellaneous structures. They ensure buildings receive adequate maintenance to ensure supplies of water, sewer service, electricity, heating, ventilation and air conditioning (HVAC) to enable students, staff and faculty to execute training and ancillary services (messing, barracks, gym, generators, etc.) at its highest efficiency. The services must be performed by trained and experienced HVAC mechanics, electricians, plumbers, carpenters, grounds personnel, tractor operators, maintenance workers, janitors, motor mechanics and food service appliance mechanics to ensure industry standards are met.

This unusual and compelling urgency is not a result of lack of advance planning. The Solicitation HSCG84-15-R-AA8453, to provide recurring services at ATC Mobile, was issued on January 7, 2015; and closed on February 17, 2015. Adequate competition has been received and fair and reasonable pricing has been established. The Government had anticipated evaluation of proposals would be completed to make award for a July 1, 2015 start date; however, a more thorough and complete evaluation was deemed necessary to ensure evaluation was performed in strict compliance with evaluation criteria. A start date of October 1, 2015 was established. An award decision had been made pending legal review board. Upon review by the board, an issue was identified in the evaluation scheme, in regards to the estimated $800K for Level III work, which is included in the Schedule as a per lot award. The board has determined rather than crediting offerors with $800K for the Level III work, making an assessment of how much each offeror would charge based on their personnel and other cost as they related to the particular work is needed. They recommended having the offerors respond to a sample work order. This would allow the assessment of the number of hours used of a particular skill set and would be used to perform specific task. This will provide for a more thorough and complete evaluation of the requirements portion of the contract. The bridge modification is deemed necessary to allow time to complete evaluation of added criteria and make an award decision that represents the most advantageous offer to the Government, USCG and ATC Mobile. It would also allow required transition time of 20 days, to secure trained and experience personnel, equipment, and other required administrative matters for December 14, 2015 start date; avoid duplication of start-up cost; and allow services to continue, uninterrupted.

The incumbent contractor, Satellite Services, Inc., has proven its ability to provide quality services, sustaining stability of support and consistency in operation for facilities maintenance services. They have been performing these services at the base for the past 25 years.

6. Description of Efforts Made to Ensure that Offers are Solicited From as Many Potential Sources as is Practicable – A FedBizOps notice was not publicized as required by FAR Subpart 5.2, as proposed action is made under the conditions of unusual and compelling urgency; and the Government would be seriously injured if the agency complies with the time periods specified in 5.203.

7. Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable – The Contracting Officer anticipates incumbent prices to be consistent with current contract pricing, already determined to be fair and reasonable, and will experience very little change.

8. Description of Market Research – No Market research was deemed necessary, as previous market research conducted reveals incumbent contractor and several sources capable of rendering services. The incumbent is the only known source that is capable of providing services at this immediate time.

9. Any Other Facts Supporting the Use of Other Than Full and Open Competition

– The recurring requirement was solicited as a 100% small business set-aside competition, and anticipate award decision to be made by December 13, 2015.

Competitive pricing was received, and will be made to the offer representing the most advantageous to the Government.

10. A Listing of the Sources, if Any, That Expressed, in Writing, an Interest in the Acquisition – Due to proposed contract action being made under conditions of unusual and compelling urgency no synopsis was issued, as the Government would have been seriously injured if the Coast Guard had complied with the time period specified for publicizing and response time for proposed contracts.

11. A Statement of the Actions, if Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition For the Services Required – The Government awards a bridge modification to Satellite Services, Inc. for 13 days, to start December 1, 2015 through December 13, 2015.

12. Contracting Officer’s Certification. I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.

REGINALD B. HENDERSON Date Contracting Officer

13. Technical/Requirements Personnel Certification. I certify this requirement meets the Government’s minimum need and that the supporting data, which forms a basis for this justification, is complete and accurate.
