J&A Number: 20-0108 c01mnunications ( data & phone) required to make each building complete and useable must begin immediately upon delivery of the shelters. As a result, of the immediate timeline, only South Bay has the training and experience of the "RapidBuilt" shelters to ensure a seamless transition from assembly of the structure to the complete and useable build out detailed in the contract specifications. Utilization of South Bay not only ensures a certified "RapidBuilt" installer will execute the builds, it also ensures a seamless transition to outfitting the shelters interior and exterior components for a safe and functional turnkey facility. South Bay installers will be onsite for the installation of the "RapidBuilt", "MMG" modulars, and "Adamo" secure modular structures from the DLA contract and will then be able to immediately transition to the construction portion of the requirement at each site concurrently fo11owing the insta11ation. It was estimated, based on historical procurement lead-time and current construction schedule, competition of the requirement would delay the project 300 days. A delay of 300 days in the completion of the buildout contract due to competing the requirement would result in unacceptable delays in fulfilling the agency's requirement of getting useable space to maintain the VX-31 aircraft displaced by the damage from last year's earthquakes.
Further, supporting the award to South Bay is their factory certification for the "RapidBuilt" product. South Bay is the only certified vendor in the California region to which the learning cunre, costs, and risk associated with using a non-certified contractor could not be mitigated through competition of this requirement. "RapidBuilt" steel buildings are not traditional buildings and have different requirements for modifications. The buildings are designed to last decades as a safe structure meeting designed wind loads and seismic specifications. Their construction requires more care and precision due the patented connections, and technical details. "RapidBuilt" has clearly stated they will only warranty the structures when installed by one of their trained and certified installers. Failure to use a certified installer could lead to improper connections and degraded structural integrity. An improperly installed structure in a high wind event or large seismic event can lead to structure damage and/or co11apse. Tf occupied in such a scenario, people can be injured or ki11ed. As a result, the cost of voiding the manufacturer's warranty and potential loss of mission readiness is not expected to be recovered through competition.
As a result of the aforementioned justification, only one responsible source and no other supplies or services wi11 satisfy agency requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In accordance with DFARS PGI 206.302-l(d), a Sources Sought announcement was posted to the Contract Opportunities (beta.sam.gov) website on 17 January 2020. One response was received from [REDACTED] on 22 January 2020. The Point of Contact (POC) expressed that the company could not meet the criteria set forth in the Sources Sought regarding the "RapidBuilt" certification and was therefore was not considered a viable source. In accordance with FAR 5.20l(b)(l), the proposed contract was synopsized on the beta.sam.gov website on 17 January 2020 to which South Bay expressed an interest in this requirement. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any company other than South Bay to provide the required supplies and services.
