SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS

AUTHORITY: FAR 13.501(a), FAR 13.106-1(b) and 41 U.S.C. 1901

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Sole Source Justification.”

Contracting Activity: This document is a justification for other than full and open competition for the Department of the Interior, Bureau of Indian Affairs, Bureau of Indian Education (BIE)

2. Nature and/or description of the action being approved.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

The Speech /Language Therapist works with special needs students that have been referred through the Student Assistance Team process or have been in another therapeutic speech or language program within another district receiving services. Speech refers to students who have articulation problems that make access to education difficult due to unintelligibility of letter and word pronunciation. Language refers to deficits in both expressive and receptive language that impedes academic performance. The Speech/Language Therapist must be licensed and have present knowledge of the unique needs of the students on Taos Pueplo. The Speech Therapist will provide all supplies and materials to perform designated work. Contractor should have experience working with the unique needs of Native American students.

Contractor will provide 20 hours/week for 37 weeks throughout the school year.

The estimated total value of this procurement is $204,610.00 inclusive of a base plus four (4)

4. An Identification of the statutory authority permitting other than full and open competition.

FAR 13.106-1(b) - Soliciting from a single source

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

The requested vendor will build upon already established relationships and trust to further student’s growth. The incumbent provider has been providing these services for the past year.

Changing providers would cause hardship on the students, parents and staff at the school.

In accordance with the Class Determination and Findings (D&F) under 41 U.S.C. §3304(c)(l);

Public Law 114-95; and 48 C.F.R. §1.703, these services must be issued on a sole source basis.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

A Notice of Intent to Sole Source was posted to the Government Point of Entry (GPE). To date, no responses have been received.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable. The contracting officer determines that the anticipated price(s) will be fair and reasonable based on rates available in the commercial marketplace.”

8. A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

A current review of the Small Business Administration (SBA) Dynamic Small Business Search (DSBS) resulted in no Indian-owned Small Business Economic Enterprises (ISBEEs) or other Small Business concerns with the capabilities to provide these specific services.

9. Any other facts supporting the use of justification of other than full and open competition, such as:
